The #SupremeCourt of India on Friday (March 13) #refused to entertain a public interest litigation seeking a nationwide policy providing #menstrualleave for women students and workers, observing that making such provisions mandatory could unintentionally reinforce gender stereotypes and affect women's employment prospects.
A bench comprising CJI Surya Kant and Justice Joymalya Bagchi said pleas of this nature could create fear and portray menstruation as something negative for women. The court also expressed concern that mandating menstrual leave through legislation could discourage employers from hiring women.
During the hearing, the Chief Justice said that while voluntary policies offering menstrual leave were welcome, making such provisions compulsory in law could have unintended consequences for women's careers.
The bench disposed of the PIL, stating that the competent authority may examine the representation and take an appropriate decision after consulting all relevant stakeholders.
