Justice BR Gavai is the next CJI of India
The Chief Justice of India (CJI) plays a pivotal role in the Indian judiciary. According to Article 124 of the Indian Constitution, the CJI is appointed by the President of India based on the recommendation of the outgoing CJI.
The senior-most judge of the Supreme Court is typically chosen to succeed the CJI, as per the Second Judges Case (1993). A CJI must have served at least five years as a High Court judge or have been an advocate for at least ten years. The SC Collegium, comprising the CJI and four other senior judges, is responsible for recommending the appointment of judges to the Supreme Court.
The CJI serves until the age of 65 years, while High Court judges retire at 62 years.
Key aspects include:
Constitutional provisions under Article 124.
CJI's qualifications and appointment process.
The role of the outgoing CJI and the SC Collegium.
Tenure and retirement ages for CJI and High Court judges.
