"The court was approached by a wholesaler who was trying to enter into a contract with a farmer he knew to buy flax. After the buyer sent the farmer a screenshot of the contract, the latter sent a "thumbs up" emoji. However, the farmer did not fulfil his obligations, and flax prices jumped. As a result, the wholesaler demanded compensation from the farmer.
The judge considered the meaning of the "thumbs up" emoji and found that it expressed approval or agreement. In his view, the emoji in this case fulfilled the function of a signature and evidenced the conclusion of a contract between the parties. The farmer will now have to pay liquidated damages.
The judge said the court "cannot stop the advancement of technology and the general use of emoji." This seems to be a new reality in Canadian society, and the courts must be prepared to deal with new problems that may arise from the use of emoji and the like."
