Starting December 1st, China’s new MLPS 2.0 cybersecurity laws will require a submission of facial scan to receive internet access.


(14 Oct) China will implement its new MLPS (Multi-level Protection of Information Security) 2.0 cybersecurity laws on December 1st, 2019. This new rule means every new mobile number and internet user will be associated with a facial scan, and the Chinese Ministry of Public Security can browse all data on Chinese networks, including foreign owned businesses, through the use of big data techniques. China is attempting to destroy anonymity on the Internet.

China has been increasingly using facial recognition technology as a surveillance tool and to silence opposition, such as spotting criminals in the crowd and evaluating how attentive students are in classroom. It is associated with the social credit system, which China is putting the surveillance in a new height. Recent laws in Hong Kong to ban the use of face masks also showcase the prevalence of such facial recognition technology in the ongoing privacy battleground. The extension of China’s internet rules and preferences on previously free internet space is worrying.

Police Arrested a man for "spreading rumours about police beating protestors to death during detention"

On October 16, the police arrested a 37-year-old man, claiming that he spread rumours on the internet including that "protestors were beaten to death during police detention" and provoked people to surround the Government Complex.

Leung, the officer in charge of the case, refused to disclose related speech content but claimed that the man's laptop and phone were taken away for further investigation.

Police Once Classified the Death of the 15-year-old Girl as a Murder Case

On September 27, the police applied to the court for a warrant to obtain the CCTV footages near Hong Kong Design Institute (HKDI), the school the girl studied in. It was written on the warrant that the purpose was to investigate a murder case.

A few days later, the Police requested for the CCTV footages again, but referred the case as 'Dead Body Found' instead of a murder case.

Witness Report: Deceased Girl's Belongings Found at School and MTR

[Editor's note: Witness suggests the CCTV footage from Block B may have captured the "blank 30mins". The police once classified the case as a murder and had yet released any result of the investigation.]

A schoolmate of Chan, the 15-year-old girl whose body found naked in the water, recalled that she discovered Chan's bag at around 18:15 on September 19 and had it picked up at around 19:00.

The bag was found on the podium of Block B and it contained Chan's student ID card, purse and a phone without any sim card. Since the time of this discovery was close to 17:51 (the moment Chan left the elevator), her schoolmate believes the CCTV in Block B should have captured how the bag was left there. This footage might also explain whether Chan took off her shoes on the campus.

In the same evening, a janitor from MTR also claimed to have found Chan's belongings including another phone and stationery near Exit A of Tiu Keng Leng Station. MTR confirmed this claim and stated that they have returned the items on September 21 to the girl's family.

[Statement for the attack on Civil Human Rights Front convenor]

1. The Civil Human Rights Front convenor, Jimmy Sham, was attacked in Mong Kok Arran Lane by 4-5 people with hammers this evening at around 7.30pm. Staff working at a nearby garage had tried to intervene and stop the attack, but were threatened at knifepoint. The perpetrators then boarded a seven-seater car after the attack and fled.

2. Jimmy Sham lie on the ground with a bleeding head and injury to the joints in his hands and feet. He was awake while being sent to the hospital, and is currently receiving emergency treatment and will have to be admitted into the hospital for further treatment.

3. The Civil Human Rights Front strongly condemns this incident, and has asked the police to conduct a thorough investigations to bring the perpetrators to justice.

4. Jimmy Sham has expressed “Five demands, not one less!” to Hong Kong people on his way to the hospital in the ambulance.

5. The protest by the Civil Human Rights Front will still be held this coming Sunday, and we are waiting for the Letter of No Objection from the Police. In such a bloody era painted by horror, we cannot be defeated by political terror. We call for more people to come out to stand their ground and show the perpetrators and this regime that we will not stand down.

Jimmy Sham Under Attack, Said "Five Demands Not One Less" when Taken to Ambulance

Civil Human Rights Front (CHRF) convener Jimmy Sham was attacked today (Oct 16) in Mong Kok. Attackers smashed his head with hammers, causing heavy blood loss.

CHRF vice-convenor Figo Chan told the press that the attackers had threatened passers-by with knives to prevent them from rescuing Sham, and that Sham said "Five demands, not one less" while being taken onto the ambulance.

Chan stressed they are determined no matter who gets attacked. The demonstration will continue as planned on October 20.

Convenor of the Pan-democractic Camp Tanya Chan pointed out that in August Sham and his friend have already been attacked, but the police have made no arrest so far. "What is Hong Kong becoming? Can Carrie Lam see that?" she questioned. Chan urged the police to retain a professional attitude, and not to allow political differences to interfere with their investigation work.

How did the death of a 15-year-old girl become suspicious in Hong Kong?

Part 1
Chan Yin-lam, aged 15, was a swimming athlete and had participated in the recent protests.

On September 19, she parted with her friends in Mei Foo at around 2pm. She sent a text message saying that she was going home.

As captured by CCTV, Chan appeared in Hong Kong Design Institute, her school in Tiu Keng Leng, before she went missing.

On September 21, her family made a report to the police. On the same day, her family picked up her belongings kept at the lost-and-found of the MTR.

On September 22, the body of Chan, naked, was found floating in the sea close to Yau Tong.

On September 27, the police called it a murder case on the warrant request submitted to the court.

A few days later, the police re-classified it as a "dead body discovery" case.

On October 11, news about the case was for the first time disclosed by Apple Daily. Chan's body was cremated one day before (October 10).

On October 14, students and the public demanded the release of CCTV footages. On the same day, the school announced the suspension of class from October 15 to 18 (3 days).

Part 2
The suspicion built up reflects the population's untrust of the police force and the authorities in general, especially after the 8.31 Prince Edward Station incident.

The following are some questions that are left unanswered regarding the case:

Question #n1
The police said Chan's death was not suspicious.

According to Forensic Doctor in the field, the discovery of naked female corpse is generally classified as suspicious case. Investigation should be conducted.

Question #n2
According to Apple Daily, Chan's handbag, purse and a phone without simcard were spotted on campus by a schoolmate at around 18:15 and her another phone* and stationery near Tiu Keng Leng MTR station (by a janitor).
*MTR used the phonebook of this phone to contact her family.

The police said Chan left her belongings at school and walked barefoot to the waterfront.

The school said a man and a woman brought Chan's belongings to the school's office in the evening she went missing.

Question #n3
On October 14, the school upon request disclosed only two footages (one in the lift and one near the car park) with inconsistent timestamps and missing parts.

On October 15, the school released the extended version of the two footages, but they did not explain how Chan left her belongings and became barefoot as the police account suggested.

On October 16, the school released 16 CCTV footages; however, the recordings between 17:51:31 and 18:13:36 (around 22 minutes) and 18:31:05 and 18:36:48 (around 5 minutes) are missing. Although Chan was seen leaving the campus barefoot, the missing parts are precisely when the changes took place. Hence, the footages still cannnot explain how or why she left her belongings and became barefoot.

Nearly 70% Support Restructuring the Police Force in Hong Kong

The Centre for Communication and Public Opinion Survey (CCPOS) of the Chinese University of Hong Kong released the survey result of public opinion towards the Hong Kong Police Force and the government conducted in October 2019.

Nearly 70% of the respondents support restructuring the police force. In terms of trust, 49% of the respondents gave a score of 0 to the government and 52% gave the same score to the police. On a scale from 1 to 10, the government and the police receive an average score of 2.3 and 2.6 respectively.

81% of the respondent support political reform to democratically elect the head of the government and the entire legislature.

The Taiwan R.O.C. Ministry of the Interior described Hong Kong Police as “Black Cop” 1 of 2

The Taiwan R.O.C. Ministry of the Interior, which is in-charge of the nation’s internal affairs, described Hong Kong Police as "Black Cop".
It wrote on its official Facebook page that web users were saying that Black Cops from Hong Kong and their families are planning to migrate to Taiwan.

The Ministry assured citizens that they have strict vetting procedures to keep out undesirable persons and criminals. If applicants are suspected to have criminal intentions, including damaging the nation’s interests, threaten public safety and order or are involved in terrorism, their migration applications will not be approved.

It also clarified rumours about buying a NT$6 million flat being one qualification to migrate are misleading.

Taiwan politician Tong Hui-chen asked during a questioning section, "some people call the Hong Kong Police "Black Cop". Is this term appropriate in our social media?" Su Tseng-chang responded that he respects the term created by the people of Hong Kong and will continue to use it to describe the Hong Kong Government and the Hong Kong Police.

Tong Hui-chen further questioned the Ministry of Internal Affairs of Taiwan on using terms like "Black Cop" and "Mob" to describe Hong Kong police on it's official Facebook page. She said that it is not suitable to use these words on an official Taiwan government website. Shee believed that it is a Hong Kong internal affair. In this regard, the Minister of the Interior, Xu Guo-yong said that the vocabulary used on Facebook is quoted from the news media reports, so it is better not to change the words for the sake of true presentation.

Su Tseng-chang said that Tong Hui-chen may not know much about Taiwan. The police enforcement in Taiwan will not use real guns and will not shoot at the chest of the protesters.

Tong Huichen asked how the Ministry of the Interior will handle Taiwan protesters and the use of petrol bombs in the future. Xu Guoyong said that according to the Law on Assembly and Parade, the police can warn, stop, and order the dissolution of the activities beyond the assembly. In fact, the police in Taiwan will not and has never carry armfire to handle protesters. Tong asked again, what if someone throw a petrol bomb? Xu said, "Our police will not take the gun out and our people will exercise restraint."
