A message from Education Bureau to Parents and Students of Government Secondary Schools in Hong Kong

Dear parents and students,

We have been working hard to build a campus filled with love and care, so that our students can learn, grow and bond with each other under mutual aid in a tolerant and considerate environment. With the assistance of school principals and teachers, students can explore their potentials, build confidence and positive values.

However, the recent social strife has caused many students distress and affected their studies. Some students' radical behavior has made other students very stressful, panic and even created conflicts. Our teachers and staff feel pained for the students who were injured or arrested when participating in political events outside school. I hope students could stop and think for a bit and feel the caring and cherishing from our teachers, not to hurt the relationships between family, friends, and teachers due to political movements. I also hope sincerely that parents, school principals, and teachers can all together provide mental aid and the correct guide to healthy growth for our students.

The Education Bureau, as an institution for education matters of government secondary schools in Hong Kong, has been communicating with the schools about the solution for the effect of students and their study caused by the social affairs. All school principals and teachers have stayed on their posts to maintain normal school operations for the students. I hope all parents and students can help maintaining harmony at school with us so that students can focus on their studies. A school is a place for students to learn, we should not use it as a platform to express political demands. I hereby explain once again to all parents and students, we should not organize or participate activities to express personal political stance in school, including strike, singing, shouting slogans, human chain demonstration and giving out political promotion materials. All events inside school must be organized with the school’s approval; school uniforms represent the school, and also all teachers and students, if students misbehave in their school uniforms, that is a form of defacement to the school reputation. Participating in political events outside school wearing school uniforms is inappropriate as this may cause misunderstanding to the public that those events represent the stance of all teacher and students. The school will handle cases of violating school regulations according to the principles and policies.

Besides, government secondary schools always pay attention to the moral education of students. I would like to remind students to respect yourself and others: foul language should not be used while talking; always distinguish right from wrong, obey the law and be a responsible citizen. Under all circumstances, students should not disturb the social order. Recently, some students intentionally blocked train doors from closing and roads for cars. these acts are not only dangerous and will cause inconvenience to other citizens, but also considered as serious illegal behaviors. Putting harm on oneself and others are not acceptable. I call for students to treasure yourself and the others, and ask parents to advise your children away from dangerous and illegal activities to avoid lifelong regrets.

I sincerely hope that all students, parents, school principals and teachers can face the challenge side by side and protect our schools so that our students can learn inside a safe and orderly school campus, and enjoy a pleasant, harmonious and caring school life.

The Secretary for Education
Kevin Yeung

Hong Kong Education Bureau oversteps its authority to settle scores, at least 10 teachers accused of professional misconduct without justification - Part 1 of 2

[Abstract] The Education Bureau previously stated that investigation into 60 complaints of teachers’ professional conduct relating to recent social affairs had been completed, of which about 30 were preliminarily confirmed cases of misconduct and would likely lead to revocation of the involved teachers’ registered designation. Apple Daily was informed that the Education Bureau accused at least 10 teachers of misconduct but did not contact those directly implicated in the investigation. Instead, they only adjudicated based on the schools’ own findings. The Education Bureau sent letters informing these teachers that they were presumed guilty of alleged misconduct. They had to respond in writing and were given no opportunity for a scheduled hearing. Some lawyers have criticized the Education Bureau’s move as “outrageous”, that it was unjust and should be appealed.

Apple Daily was informed of at least 10 similar complaint cases against teachers that the Education Bureau delegated to the schools involved to make initial investigations. Education Bureau has yet to contact these teachers directly. It has only issued letters based on preliminary findings from schools that the teachers expressed biased opinions and incited hatred. It stressed that these actions had a negative impact on the professional image of education and alleged that they were a form of misconduct. The letter specified that the teachers were not required to meet with officials and only needed to respond in writing. It also stated that the Bureau would consider disciplinary action according to the Education Ordinance. It was reported that the identities of complainants were never disclosed to the teachers involved, which dismayed some schools that were hoping to conclude the investigation quickly and minimize the disruption to normal school operations.

According to Apple Daily, the Education Bureau has not been consistent in its response to teacher complaints relating to the Anti-ELAB movement. Apple Daily also contacted a teacher against whom a complaint was lodged for online posts earlier in the movement. He revealed that the Education Bureau had invited him for a meeting and was denied when he requested a union representative or lawyer to accompany him. It relegated to asking him for a written response instead. The Bureau did not respond in turn, rather choosing to notify the teacher directly that he was indeed charged with misconduct with no explanation as to why his written defense was not accepted. The teacher denounced the Education Bureau for lack of transparency and due process in its ruling.

Hong Kong Education Bureau oversteps its authority to settle scores, at least 10 teachers accused of professional misconduct without justification - Part 2 of 2

Chong Yiu-Kwong, a lawyer and the vice-president of the Hong Kong Professional Teachers’ Union, pointed out that teacher registration is issued by the Education Bureau to teachers on an individual basis. Should a problem arise, the Bureau should deal with the teacher in question directly. He found it inappropriate and unfair that schools had to carry out investigations and described the Education Bureau’s handling of complaints as “outrageous”. He indicated that cancelling a teacher’s registration was “a big deal” for teachers and that issues pertaining to it deserved a proper hearing, not just in writing. He continued to say that the teachers implicated had the right to know the complainant’s identity. Withholding it violated the principles of natural justice and kept the teachers from knowing if the relevant incriminating data was obtained through illegal means like hacking.

Chong explained that if a teacher’s registration is cancelled, the aforementioned injustices could be grounds for challenging Education Bureau’s future decisions; under the Education Ordinance, teachers could appeal to the Chief Executive and Executive Council and any further disagreements could undergo judicial review.

In a newspaper article, Winnie Yu - an honorary professional consultant of the Department of Educational Administration and Policy from the Chinese University of Hong Kong - warned that Education Bureau had been investigating complaints of teachers criticising the police online since June. In some cases, the offending information was never divulged to the teachers, leaving them no opportunity to defend themselves. Yu also pointed out that most of the proof came from screenshots of teachers’ personal social media accounts, which was a violation of privacy. This meant that Education Bureau was an “accomplice” in using illegally obtained evidence to accuse teachers of professional misconduct.

Yu stated that the Education Ordinance did not authorize Education Bureau to use verbal warnings, condemnations or punishments against teachers accused of misconduct. Minor cases that do not warrant the cancellation of registration should be terminated. To do otherwise would “overstep its authority”.

A spokesperson for the Education Bureau responded that the implicated teachers had ample opportunity to explain themselves to their schools. They also stated that schools were responsible for reporting to Education Bureau, which would then review and determine the validity of a case. If a case was proved to be convincing, the Bureau would inform the teacher involved and invite them to write a statement. The option of requesting a meeting would be open as necessary. The spokesperson claimed that the Bureau has never ruled out the possibility of speaking directly with the teachers involved.

The spokesperson also denied that coercing, warning and condemning teachers should be misconstrued as “overstepping authority”. Rather, such actions were the hallmarks of responsibility for all teachers, schools, students and the entire education system.

Lawmaker: Authorities Impose White Terror in Education sector

Education sector lawmaker Ip Kin-yuen criticised that the bureau is forming “White Terror”. He pointed out that teachers enjoy freedom of speech, however, the bureau adds extra regulating conditions such as disallowing hate speech and regulating teachers’ private comments. He described it as “censorship of thoughts” that creates panic among the public. “It is unreasonable for one to sacrifice freedom of speech for being a teacher” Ip said. He pointed out that “White Terror” is caused by unreasonable requests. “How can teachers exchange their ideas freely with their fellow? Even for initiating a conversation with students, all is required to censor their own thoughts in advance”.

Teacher Dehumanized Protestors and Cussed in Class; Suspended only for 14 Days

A male teacher from Ma On Shan Tak Sun Secondary School was accused of swearing at his students last month. In the conversation, he also used “cockroach” to describe the protester. The school said that further investigation will be done.

The principal, Law Chun-ping, issued a statement today (January 5) stating that the Incorporated Management Committee (IMC) ordered the teacher to be suspended from his post for 14 days from January 3. He will also receive salary deduction during the suspension period as a penalty.

The statement mentioned that the IMC acknowledged the teacher should not use vulgarities under any circumstances, "It is also inappropriate to use politically and socially biased terminologies and opinions in a classroom."

The school management committee also ruled that the teacher "violated the code of conduct of school staff", and therefore issued a written warning to "seriously instruct" the teacher not to commit the same offence. "His employment will be terminated in the case of a repeated offence."

The statement also said that the teacher agreed with the incident report, and "was willing to accept the penalty," and that he also "expressed remorse" and he promised not to violate the staff code of conduct in the future.

The statement stated that as an educator, "each teacher must maintain integrity and follow strictly the best practices in education." For politically sensitive or controversial social issues, the school asks teachers to exercise their "professional judgement" and consider whether or not it is appropriate for the students’ age, and whether or not it meets the specific curriculum requirements. A balanced and objective approach should always be adopted so that students can learn to express themselves in a rational and objective manner.

State Media : English homework’s mention of water pollution in China was derogatory

A netizen uploaded an English worksheet from Sha Tin Stewards Pooi Kei Primary School, illustrating a stream in the U.S. Yellowstone National Park and a river in China with captions. The worksheet was written in the first-person narrative. The river in Yellowstone National Park said, "I am a stream in Yellowstone National Park in the USA. The Park was set up on 1st March 1872. I am happy every day. Flowers and grass grow on my sides. They look nice and healthy. People are kind to me. Nobody disturbs me. Only animals come to visit me when they are thirsty. I am crystal clear all the time."

But the stream in China said, "I am a stream in China. Don't come near me because I am very dirty and smelly. People never protect me. They throw rubbish and waste water into me. The water is black. Can you imagine how sad I am? Trees and grass all die after drinking my water. Animals run away from me. I am dying. Please help me."

The netizen who uploaded the worksheet criticized the content, saying it was promoting hate towards China and that the teacher did so with "evil intent" to "brain-wash" the students. She demanded the school take punitive action against the teacher.

Stewards Pooi Kei released a statement saying the school “has always placed an importance on informing students of Chinese history and culture.” Further, amid the recent social unrest in Hong Kong, the school has given the teachers very clear instructions, that “they must remain impartial when dealing with any delicate or controversial matters.”

The school was deeply regretful about the English worksheet, which led to such controversy and promised to follow up on the incident. After “serious communication” with the teacher, they believed it was not the teacher’s intent to show any political inclination, and that it was simply a misunderstanding due to an oversight. They apologized and promised to “adopt a more meticulous approach when selecting teacher material.” The worksheet was re-issued to rectify the situation.

Despite the clarification and apology made by the school, state-media China News Service and People's Daily (Hong Kong) continued to condemn the English worksheet as “glorifying the West by denigrating China”.

Experts in Education Sector Criticise the Hong Kong Government for Firing a Teacher without Allowing Him to Defend

A teacher at Alliance Primary School, Kowloon Tong was deregistered by the Education Bureau for "promotion of Hong Kong independence" in early October.

James Hon, former chairman of the Council on Professional Conduct in Education (#CPCE), explained that normally if a case is handled by the CPCE, the decision of firing the teacher would be made after considering the complainant's and defendant’s statement at a hearing. However, in this case, the teacher was fired without being given a chance to defend.

Hon criticised the Education Bureau for treating the teacher unfairly and that it was very inconceivable for the teacher to be fired just because of one discussion section.

Leung Yan-wing, former council member of the CPCE, criticised that there was no academic rationale for the Education Bureau to fire the teacher. He also suspected that the Bureau’s decision was based on political correctness considering the fact that the Bureau has announced to change the contents of textbooks in Liberal Education recently.

Leung worried that this case would serve as a warning to teachers and stop them from initiating discussions of controversial topics from their professional perspective, which in turn will cause a huge damage to the profession of education.

China Wenzhou launched "Teacher Ethics Code" to monitor teacher performance, points will be deducted if they violate code of ethics

(20 Nov) The quality of teachers has always been a matter of greatest concern to parents. Recently, Wenzhou, China has launched a "Teacher Ethics Code" program to monitor teachers' performance in order to evaluate and divide teachers into different levels. This approach has aroused heated discussion among netizens.

According to reports from China’s media, the Wenzhou Education Bureau recently launched the "Ouyue Teacher Ethics Code". The Education Bureau said that this "Teacher Ethics Code" will collect different data on all teachers in real time, and include both positive and negative reviews. Each teacher will get his own QR code.  Teacher’s ethics score will be displayed in one of the three colors: green means good ethics, no bad records such as violations to rules or code of ethics, etc. Yellow means that they have been criticized and disciplined for violations; In the end, red means that they have been warned, demerited, downgraded, dismissed or expelled due to violations.

The Chinese Education Bureau stated that it will provide teachers with a "disciplinary probation period" according to the degree of violation. If the performance during the "disciplinary probation period" is good, the color can be reverted to the original color . The Education Bureau stated that even if teachers change schools, they cannot change the color of the code. If a school has too many teachers with code yellow and red, the Education Bureau will issue a warning to the school, requesting the school to improve the construction of teachers' ethics and style. The Education Bureau emphasizes that the information on the "Teacher Ethics Code" is only for schools and teachers and will not be made public.

After the release of the news, heated discussions aroused among netizens. Some expressed their support and believed that it would help improve the quality of teachers. "This Teacher Ethic Code in Wenzhou is very good! It is recommended that it can be promoted nationwide" and "This can have a vigilant effect for teachers. "But there are also others who believe that the measures will only make it more difficult for teachers to teach attentively. "This is not a reason for schools to force teachers to do work other than teaching." "This decreases the rights of teachers, and becomes powerless against students who violate regulations.. The ultimate impact is on the quality of student education."
