Hong Kong security law: Police handed power to do warrantless searches, freeze assets, intercept comms, control internet

//Hong Kong police will be authorised to conduct searches at private properties without a warrant, restrict suspects’ movements, freeze their assets, intercept communications and require internet service providers to remove information, as the city’s leader handed more powers to the force for implementing the new national security law.

On Monday night, the government gazetted the details of Article 43 of the controverisal legislation, which criminalises secession, subversion, terrorism and foreign interference. It came after the first meeting of the Committee for Safeguarding National Security of the HKSAR, chaired by Chief Executive Carrie Lam.//

Peaceful protestors Intercepted and Intimidated by police: "Ask the higher-ups for decision to arrest or not"

On July 6, more than 10 citizens chanted slogans in the IFC Atrium in a "Lunch With You" protest. Some civilians held printed text messages and some only held blank paper.

Soon, about 20 riot police officers entered the mall and intercepted at least 5 civilians who participated in the rally. In addition to checking the civilians' backpacks, they also carefully checked the held papers and ordered the intercepted civilians to remove their masks to record their appearances.

Some civilians holding polka dot pictures stated that after being intercepted, police officers said, "Ask the higher-ups for decision to arrest or not." The officers also said that all the personal information is available to them now and "We'll find you if anything happens." However, the person being intercepted said that the police officer never stated which law they had violated. "They never mention the National Security Law or any other laws." "The police officer only explicitly discussed to 'do them or not' (meaning whether arrest him or not, mostly without sufficient evidence)."

Police Allegedly Set Roadblocks with Cars Carrying Civilians, Causing Tragedy

In February 2018, police officers were suspected to use civilians’ cars as “human road block” to stop a van from travelling at high speed in Fanling, causing 5 cars to collide in the end. The driver and a male passenger on the van were killed, and the driver of the “human road block” vehicle became unconscious due to the incident.

The Coroner's Court started a hearing on this case earlier. It was ruled that the driver and the passenger were killed on accident. The cause of the accident was cars driving slowly according to instructions of police officers.

Magistrate Chow Wai-choo advised the Hong Kong Police Force to train officers and make sure they understand regulations related to their work. The Hong Kong Police Force shall submit a written response within 6 months regarding these suggestions.

First Person to Be Charged With Violation of National Security Law in Hong Kong

A 23-year-old man driving a motorcycle with a ”Liberate Hong Kong Revolution of Our Times” flag on 1 July has been subdued by the police and charged of two crimes, namely, inciting subversion of state power and terrorist activities. He is the first accused for the violation of the National Security Law (NSL).

Due to his numerous fracture injuries, he was hospitalized and subsequently absent during a hearing last week. He was brought to the court in a wheelchair on 6 July, wearing a volunteer first-aider jacket (the same one worn at the scene). The prosecution proposed to adjourn the hearing and chief magistrate Victor So Wei-tak accepted the request.

The hearing is postponed until 6 October. Judge So, who was appointed by the Chief Executive to handle NSL cases, considered a risk of fail scheduled surrender under Article 42. The accused has remained in custody.

Germany’s Latest Travel Advisory Urges German Nationals in Hong Kong to Watch Their Words as China Imposes Sweeping National Security Law

Germany has updated its travel advisory to Hong Kong with China defying international protests and unilaterally passing the Hong Kong national security law.  Germans in the city are urged to watch their words to avoid breaking the draconian law.
 
In its message on the safety of travelling to Hong Kong, Germany’s Federal Foreign Office notes that the law covers such ‘new and vaguely defined’ crimes such as secession, subversion, terrorist activities and collusion with foreign powers.  These crimes carry a maximum penalty of life imprisonment, and it is possible for a foreigner to break the law outside of Hong Kong.
 
German nationals in the Hong Kong are reminded to be cautious and beware of the possible consequences of making political statements. The Office further urges them to be mindful of what they say, even on social media platforms.
 
BDI, The Federation of German Industries, has also pointed out that the National Security Law greatly extends the Chinese central government’s intervention in Hong Kong, worsening an already very tense situation.  In the past, European business have set up branch offices in Hong Kong in faith that the Basic Law promises rights such as freedom of speech.  If these rights were no longer guaranteed, European industries would not feel safe to continue running their businesses in Hong Kong.  BDI urges China to uphold the promise of “One Country Two Systems” instead of letting go of its international credibility easily.

China’s CGTN found in serious breach of UK broadcasting rules Chinese state TV network had aired allegedly forced confessions of British citizen Peter Humphrey

//The UK’s media regulator has found China’s state broadcaster to be in “serious” breach of its rules on fair treatment and privacy after it aired allegedly forced confessions, putting the network at risk of losing its licence to broadcast in the country.

Ofcom said on Monday that China Global Television Network’s two programmes China 24 and News Hour had breached rules “both in connection with the obtaining of material included in the programmes, and in the programmes as broadcast”.

In May, Ofcom found CGTN had broken its broadcasting rules on impartiality and failed to present alternative viewpoints to that of Beijing after separate investigations into its coverage of pro-democracy demonstrations in Hong Kong last year.//

Patriotic Banner Surfaces at Entrance of Cross-Harbour Tunnel

The "National Security Law" in Hong Kong was effective on 30 June. A giant banner appeared at the entrance of Cross-Harbour Tunnel today (6 July), as a joint statement from alumni of Diocesan Boys' School and La Salle College at the entrance of the Cross-Harbour Tunnel. It stated "We all come from the same family and unite as one. Love China & Love Hong Kong".

The banner further remarked in fine print that it does not represent the official opinion of the two schools.

Editor's Note: It must be noted that the slogan is quoted from a poem written in the Three Kingdoms period. the line is followed with "why do we burn each other alive so earnestly?"

China-India Conflict:  Unarmed Indian Soldiers Encircled and Throat Slashed According to Indian Government and Families in Reuters Report
 
A bloody clash broke out at the Ladakh region on the border between China and India last month.  Reuters quoted reports from Indian government officials, 2 soldiers deployed to the area and family members of the fallen solders, that the Indian soldiers were unarmed at the point of conflict and encircled by a larger army at a ridge. 
 
The father of a deceased Indian soldier was informed that his son had his throat slashed in the dark with metal nails.  Relatives of other fallen soldiers were also informed by witnesses that Indian soldiers fell into the Galwan River located at the west of the Himalayan valley. 
 
Reuters interviewed the relatives of 13 deceased Indian soldiers, 5 of which presented death certificates listing the horrifying injuries sustained by the casualties in the six-hour conflict.  The death certificates showed 3 soldiers sustained arteries ruptured in the neck while 2 other soldiers suffered fatal head injuries caused by sharp or pointed objects.  5 of them had visible scars on their necks and foreheads. 
 
Reuters contacted the military hospital in Ladakh, India, where the bodies were transported.  However, the hospital declined to comment on the causes of death but mentioned that the bodies and death certificates were already delivered to the families.  2 soldiers from the Bihar Regiment, who were deployed to the area but were not directly involved in the border conflict, accompanied the bodies to their hometown.  The identities of the 2 soldiers accompanying the bodies were undisclosed due to military regulations.  All family members also had requested to remain anonymous in the interviews.

In a meeting in Hong Kong's Legislative Council that is dominated by pro-Beijing lawmakers on July 6, 2021, Secretary for Security #ChrisTang referred the 2019 pro-democracy movement to "color revolution" that aimed at subverting the regime. The former police commissioner also urged citizens to condemn and report.

Tang said, "We will make not only the terrorists, but also the supporters and those who attempt to tone it down, live like rats."

On July 1, 2021, a 50-year-old Hong Kong man called #LeungKinFai died after knifing a police officer and stabbing himself reportedly on the chest. In following days, many Hongkongers mourned the man and brought flowers to the site.

The authorities claimed that mourning as well as posting comments about the man's death could breach the #NationalSecurityLaw.

Law professor #JohannesChan at the University of Hong Kong (#HKU) disagreed and pointed out that mourning the deceased out of sympathy is not a criminal act. Chan criticized that the "red line" drawn by the government is "way too unreasonable".

Secretary for Security Chris Tang, however, insisted that sympathy is a form of support and support is a form of participation.

Tang said, "depending on individual cases, we will see whether we have evidence to make arrests and take our prosecutions."

With reference to Prof Chan, Tang said, "I hope this legal scholar can sleep at night. because you might have painted Hong Kong in blood."

In addition, Tang said that the next target is the Internet Forum #LIHKG because it is "filled with illegal information". Tang claimed that authorities will make arrests and force the websites and the users to remove their messages.
