HK Gov't Files Review, Court Increases Sentence of Civilian Charged with "Unlawful Assembly" from 2 Weeks to 7 Months

An assistant to the Board of Director of a trade company who allegedly helped to move the crowd control barrier when he passed by the protest site at Admiralty on June 12, 2019. The 34-year-old man was charged with joining an "unlawful assembly".

He pleaded guilty and was sentenced to two weeks in jail at the Eastern Magistrates' Courts in June 2020.

The Department of Justice (#DoJ) applied for a sentence review. Athough it was overruled by the magistrate, the DoJ continued to bring up the case to the Court of Appeal for review.

The Court of Appeal ruled that the original magistrate Lam Tze-kan was "wrong in principle", citing that the "sentence was apparently too light". The sentence was increased from 2 weeks to 7 months. The court said written reasons for the decision will be given later.

Father of pro-democracy student asks for citizens' valor and information to uncover truth of his son’s death

Stepping into the second week of the Coroner Inquest of 22-year-old #ChowTszlok’s death, witness Mr Mon was summoned and appeared on the 6th day of the inquest.

Chow’s father thanked Mr Mon for testifying in court. He also called on those who witnessed the incident leading to the death of his son to provide information.

Mr Chow expressed that many enthusiastic citizens have contacted him since Monday, November 23, 2020 after he made the first call for information via mass media.

He mentioned that footage of surveillance cameras has shown many passersby in neighboring areas when the incident happened last year.

He also quoted Judge of the Coroner's Court, Ko Wai-hung, who also asked for more witnesses to provide their accounts of the incident.

Chow’s father said in surveillance cameras footage, there were two citizens going in a hurry to the 3/F of the carpark. In another footage of C28 surveillance camera, a black-clad man suddenly appeared nearby the elevator at 01:03:29 on November 4 last year. The man looked around and walked towards the camera before turning right and left the location where Alex Chow was lying after fell down from height. He asked for their courage to provide any information to this case.

Due to COVID-19, the Chinese University of Hong Kong had arranged to hold this year’s graduation ceremony online. However, more than a hundred graduates initiated a “graduation rally” on campus to bid farewell to their school.

A Stand News photographer invited graduates to take instant photographs, on which they could also write down their thoughts and wishes. Among them were Media and Journalism graduates and aspiring photojournalists; one was an incumbent district councilor; yet others were graduating from Social Science and wanted to become a teacher.

Last year on the night before Hong Kong Police laid a brutal siege to the pro-democracy students at #CUHK, graduates marched from the Statue of Lady Liberty to the main building, stridently chanting anti-ELAB slogans.

A year has passed, and although no ceremony was held on campus this year, defiant new graduates marched along the same route, holding up a banner that read, “No one in this movement will win in the end; but please carry on and bear witness (這一場革命最終無人取勝 但請你留低一起作見證).”

Australian Prime Minister Visits Japan, Signing Security Pact to Counter China's Influence

Australian Prime Minister Scott Morrison arrived in Japan on Tuesday for a visit. Reuters reports that Morrison is expected to sign a historic military cooperation agreement with Japanese Prime Minister Yoshihide Suga to cooperate in countering the growing influence of China in the region.

Morrison arrived in Japan on Tuesday, and an official from the Ministry of Foreign Affairs of Japan said that the meeting would include an announcement, but did not reveal any details. Some security experts estimate that Morrison and Suga will sign the Reciprocal Access Agreement, establishing a legal framework to allow mutual military training visits and joint exercises.

Japan has been negotiating the agreement for over six years, and still needs to be ratified by the Japanese Parliament. It will be the first military cooperation related agreement since the U.S.-Japan Treaty of Mutual Cooperation and Security in the 1960s, allowing the U.S. to base warship, fighter jets and set up military bases in and around Japan.

Poland Charges Former Huawei Top Executive with Spying for China

Polish authorities formally charged Wang Weijing, former sales director at the Polish branch of the Chinese telecoms giant Huawei, with spying for China on Tuesday, 17 November.

The authorities announced last January that they had arrested Wang and former top Polish national security official Piotr Durbajlo for espionage. A spokesperson for Poland’s special services coordinator said on Wednesday, 18 November that an indictment had been filed to the Warsaw district court on Tuesday, accusing the two of espionage against Polish interests.

Diane Francis: Trudeau fiddles as Beijing burns us

Canada is the only Five-Eye country that has not banned Huawei from its network. The Conservatives introduced a motion last week seeking to force Prime Minister Justin Trudeau to make a decision on Huawei in the next 30 days.

China has held two innocent Canadians hostage since 2018, as payback for the arrest of a Huawei executive on a U.S. extradition warrant. China has also abrogated billions in agricultural trade contacts with Canada. Yet the prime minister ignores the fact that four out of five Canadians want actions taken against China for these and other misdeeds.

Vice Chair of the All-Party Parliamentary Group on Hong Kong and a Parton of human rights group Hong Kong Watch say,

Hong Kong Police Announces the Upcoming Arrest of All Civilians Paying Tribute to Police Brutality Victims

On August 31, 2019, riot police barged into the subway trains in Prince Edward station and indiscrimately assaulted passengers and pro-democracy protesters on their way home.

Many civilians were gravely injured, and many others were seen went down on their knees, or begging the police to stop pepper-spraying and hitting them. Known as the 831 Prince Edward Incident, this was one of the most brutal incidents during the Anti-ELAB movement in Hong Kong.

Since then, members of the public voluntarily go to the #PrinceEdward train station on the last day of every month, bringing white flowers to pay tribute to the casualties and the victims of #PoliceBrutality in the pro-democracy movement.

On Nov 28, 2020, it was reported that Hong Kong police will arrest any civilians paying tribute outside the Prince Edward Station starting from Nov 30, 2020.

District Councilor Lam Siu-ben told reporters that since beginning of 2020, police officers often sweep away white flowers as soon as civilians put them down. Other police officers were seen closely monitoring onlookers from nearby Mong Kok Police Station. When a civilian put down a flower, they would immediately be threatened for committing littering.

Lam quoted a source saying the police will tighten enforcement from this month to disperse citizens gathering nearby Prince Edward Station and arrest those refuse to leave.

Lam said that from his observation, “police do not want to see white flowers being placed at Prince Edward station and around the area of Mong Kok Police Station".

Medical Practitioner: False Positive COVID-19 Cases by China-funded Lab are Medical Malpractice

A testing laboratory designated by Hong Kong government produced a series of false positive COVID-19 test results.

The lab involved is KingMed Diagnostics, a China-funded company which was designated by the authorities to undertake testing by the government’s mass screening project. The false positive cases involved four professional drivers.

Dr. David S.C. Hui, an expert adviser to the government and a professor of respiratory systems at the Chinese University medical school, suspected that these were the result of sample contamination at the lab.

The four drivers tested negative after being hospitalized, and no COVID-19 antibodies were detected in their bodies.

A registered medical lab technologist said that the incident constitutes medical malpractice. He pointed out that re-testing a sample would take only 1–2 days, yet the government had not made any announcement about the false positive, and only stated that they tested negative and were released. He questioned whether the government is trying to cover up this malpractice by the Chinese-funded testing lab.

Authorities Demand All Civil Servants to Pledge Allegiance; Refusal will Jeopardize Chances of Promotion

The Hong Kong Government announced new guideline recently requiring all new civil servants who joined on 1 July, 2020 or after to swear allegiance to the city and its mini-constitution, “Basic Law”.

On November 26, 2020, Secretary of Civil Service Patrick Nip Tak-Kuen clarified that all existing civil servants should sign declaration or take an oath of loyalty in one round.

Nip also stated that chances of promotion would be affected for those reject signing the declaration.

Nip stressed that he is in consultation with the Department of Justice (#DOJ) to discern whether those refused to sign the declaration of loyalty will be terminated.

Patrick Nip pointed out that advocating “Basic Law” and pledging loyalty to the Hong Kong government is an essential requirement and responsibility of a civil servant, which is also in line with social expectation.

Senior civil servants, including Director and permanent secretary of a department might be asked to take oath separately. In due course, details of the arrangement will be communicated to the Civil Service Union.
