Hong Kong Government Disqualifies At Least 12 Pro-democracy Candidates in LegCo Election

As of 16:11 on July 30, 2020, the following pro-democracy candidates have been barred by the government from running for the Legislative Council election to be held supposedly on September 6, 2020:

- Kenneth Leung (Accountancy)
- Gywneth Ho (New Territories East)
- Ventus Lau (New Territories East)
- Tiffany Yuen (HK Island)
- Fergus Leung (HK Island)
- Alvin Cheng Kam-mun (HK Island)

and 4 members of Civic Party including
- Alvin Yeung (incumbent lawmaker)
- Derek Kwok (incumbent lawmaker)
- Kwok Ka-ki (incumbent lawmaker)

Government Disqualifies Pro-democracy Candidates For Not "Truly and Sincerely" Supporting the Basic Law

Gwyneth Ho Kwai-lam, former Stand News reporter running for LegCo election, received a letter from the Electoral Officer of New Territories East, ruling that she did not "truly and sincerely support the Basic Law" and the nomination was invalid.

According to the letter, "The candidate clearly opposed the Hong Kong National Security Law, which made us doubt whether she truly upholds, promotes and supports the basic principle of 'One Country, Two Systems', and if she sincerely supported the Basic Law at the time of election nomination."

The excuse they use is that I describe national security law as a draconian law, which shows that I do not support this sweeping law.

Despite 610,000+ HKgers voting in HK’s primary, Beijing now staged the biggest-ever crackdowns on the city’s election, by disqualifying nearly all pro-democracy runners, from young progressive groups to traditional moderate parties.

Clearly, Beijing shows a total disregard for the will of the Hongkongers, tramples upon the city’s last pillar of vanishing autonomy and attempts to keep HK’s legislature under its firm grip.

In order to safeguard the city’s future, HKers will not surrender. Our resistance will continue on and we hope the world can stand with us in the upcoming uphill battle.//

The most alarming part is how Kenneth Leung and the Civic Party, the mild faction of the democracy camp, were 'disqualified'. Considering that the reasons cited [by the Electoral Affairs Commission] are mostly related to 'opposition to the National Security Law', it means HK's legislature has become part of the [PRC's] National People's Congress: Any voice opposing Beijing and the tyrannical regime is going to be silenced.

Today, it is through disqualification. Tomorrow, it could be by imprisonment.//

Commenting on the disqualifications of 12 pro-democracy candidates, Chris Patten, the last British governor of Hong Kong, said: 

"This is an outrageous political purge of Hong Kong's democrats. The National Security law is being used to disenfranchise the majority of Hong Kong's citizens.”

“It is obviously now illegal to believe in democracy, although this was what Beijing promised in and after the Sino-British Joint Declaration. This is the sort of behaviour that you would expect in a police state." 

Johnny Patterson, Director of Hong Kong Watch said: 

"The political screening of moderate democrats brings home the reality of the new status quo. The idea that it is unconstitutional for lawmakers to  oppose the National Security Law is totally absurd. International governments must respond proportionately to this attack on Hong Kong's freedoms."

Returning Officer Cites Protest Against National Security Law as Reason of Disqualification

According to the Electoral Affairs Commission's Returning Officer (New Territories East) Yeung Wai-sum, pro-democracy candidate Gywneth Ho does not pledge “genuine allegiance" to the Hong Kong Special Adminstrative Region, even though Ho signed a declaration opposing the National Security Law after its enforcement on June 30.

The said declaration was signed and released by pro-protest, pro-democracy candidates on July 15, 2020. The declaration includes statements such as "whether the candidate's declaration mentioned the National Security Law or not, we oppose the National Security Law, regardless."

Among the 16 people who joined the declaration, 6 have been disqualified from running the Legislative Election.

Taiwan's First Directly Elected President, "Mr. Democracy" Lee Teng-hui Passes Away at the Age of 97

Lee Teng-hui, Taiwan's first directly elected president, passed away in Taipei at 19:24 on July 30, 2020 at the age of 97.

Lee was known to have brought democracy to Taiwan as we know it today. Lee was born in Taiwan in 1923 during the Japanese colonial era and later obtained an agricultural economics PhD from Cornell in 1968.

During his presidency from 1988-2000, he spearheaded the end of the 38-year long martial law period, implemented full democratization and advocated for localization in Taiwan.

Lee was reelected in the country's first free and fair presidential election in 1996, amidst military threats from China. He had openly denounced the proposed "One Country Two Systems" policy, instead redefining Taiwan's relationship with the People's Republic of China as one of state-to-state relations.

Chung Kim-wah: CCP intends to disqualify Democratic candidates by all means

Several pro-democrary candidates of the LegCo election received letters from the Returning Officer, requesting a response to whether they oppose the National Security Law and whether they will continue to request the United States to sanction China, in order to consider whether their nomination is valid.

Chung Kim-wah, assistant professor in the Department of Applied Social Sciences of the Polytechnic University, said that the CCP bypassed the Legislative Council to enact the National Security Law, and even the new Secretary of the Constitutional and Mainland Affairs Bureau Erick Tsang Kwok-wai said in an interview that he questioned the loyalty of candidates who opposed the National Security Law, coupled with today's extensive questioning of the candidates' positions. These all reflect that the regime intends to use all means to disqualify democratic candidates.

National Security Fears Halt #Breakazine's Latest Edition

In consideration of the new Hong Kong National Security Law, Breakazine had suspended printing of the July edition of their magazine titled "Dangerous Reading". Their editorial department announced today that this edition would not go to print, and that work on the next edition of Breakazine was also put on hold. Breakthrough, the organization which publishes Breakazine, cited the various uncertainties regarding how the new law will be enforced in Hong Kong, and the organization's wishes to protect all parties who have participated in the magazine's production.

According to Breakazine's Facebook page, the "Dangerous Reading" edition began production in May, and was sent to the printers near the end of June, at which time the National Security Law was not yet promulgated. As the organization provides services under the laws of Hong Kong, the magazine consulted legal advice and found that they could not ascertain how the new law would be enforced. In order to protect their contributors, the magazine had decided to halt printing of the July edition; refunds and other follow-up arrangements would be announced at a later date.

The next edition, slated to be published in October, is also put on hold. Brekazine's editors stated that their team will continue to explore issues that call upon honest and critical thinking, and the magazine is planned to resume early next year. Brekazine's social media and website would continue normal operations. They offered sincere apologies for all who are affected, and thanked their readers and collaborators for their understanding and support in recent times.

The "Dangerous Reading" edition, previously slated for mid-July release, was open for pre-order earlier. Its introduction on Brekazine's website reads: "Under the looming shadow of the National Security Law, we might be entering a period where our voices are silenced. [...] Hongkongers have never felt so powerless, as if we were caged in a giant prison." It included book sharing by various people who found the books had changed their worldview, a response to the changing times.

An excerpt from the edition's introduction was also posted to Brekazine's Facebook. Titled "Readings that Respond to the Times", a passage read, "Everyone is concerned for books whose stance deviate from that of the establishment: can they continue to be shown and sold on different platforms, just as before? Perhaps, under the guillotine of the National Security Law, the air of freedom seemed thinner, and we all feel closer and closer to suffocation." "Historically, totalitarian regimes have all restricted publications, because they know that free thoughts is a person's greatest resource, and an invisible weapon."

Breakazine is published quarterly by Breakthrough, a Christian youth organization, and frequently discusses social issues. Issue 59, published in Oct 2019, was titled "Hong Kong in Tears", with a scene of police teargassing protesters as its cover photo, and various articles discussing injuries caused by tear gas as well as its usage guidelines. Public libraries removed the issue from its shelves, under orders from the Leisure and Cultural Services Department. The next issue titled "Unyielding Courage", published in January 2020, focused on the courage needed to face fears under totalitarianism. It was quickly accused by pro-Beijing newspapers Wen Wei Po and Tai Kung Pao for advocating "black violence" and inciting Christians and youths to continue street protests.

Police arrest a family, on suspicion of sending a letter of threat to the police

On July 30, 2020, superintendent Chan Kong-Ming, Organised Crime and Triad Bureau (OCTB) Team D, said that the police headquarters had received an anonymous letter which showed hostility toward the police.

According to the police, the letter said there were bombs in different locations in Hong Kong. After investigation, the police arrested a family of three living in Cheung Sha Wan and they are charged with posting a threatening letter and conspiring to post a threatening letter separately.

Judge Calls Out Prosecutor's Usage Of Half-truths As Evidence

A 24-year-old man was charged with wounding a police officer with intent at Causeway Bay (CWB) on July 1.

On the very same night, the police received an anonyomous call, tipping them off regarding the whereabouts of the accused.

He was intending leaving Hong Kong to London that very night. In the end, he was arrested on the plane. The prosecutor asserted that he attempted to abscond, and that he had bought a one-way ticket. The defendant's lawyer objected against the accusation, as the prosecutor already knew that accused had an electronic return ticket sent to his email, which was purchased by his girlfriend. The judge stated that the prosecutor was not telling the full truth based on the evidences gathered, and questioned the fairness and impartiality which was supposed to be upheld in the court.

Convener of Student Localism Released on Bail: I was abducted by several unknown persons in Mong Kok and was asked to unlock my mobile phone

At around 1531, Tony Chung Hon-lam, the convener of #Studentlocalism, was released on bail. He was arrested two days ago by members of the Department for Safeguarding National Security of the Police for inciting others to subvert the country.

Chung alleged that on the day of his arrest, he was abducted by several unknown persons in Mong Kok and was asked to unlock his mobile phone in a fire escape route of a shopping mall. Chung described that the officers acted like the gangsters, as they pressed on his face and ordered him to unlock his phone.

Later, someone issued a search warrant and asked for a search of his residence in Yuen Long, and stated that the police searched many unrelated items, including transcripts and entry permits.

Chung said the police had collected his saliva sample for DNA test.

New Zealand suspends extradition treaty with Hong Kong

//The New Zealand Government has suspended its extradition treaty with Hong Kong and made a number of other changes in light of China’s decision to pass a national security law for Hong Kong, Foreign Affairs Minister Winston Peters says.

//“China’s passage of its new national security legislation has eroded rule-of-law principles, undermined the ‘one country, two systems’ framework that underpins Hong Kong’s unique status, and gone against commitments China made to the international community,” 

//“New Zealand can no longer trust that Hong Kong’s criminal justice system is sufficiently independent from China. 

//“Firstly, we are changing how we treat the export of sensitive goods to Hong Kong.

Anti-China movement goes viral around the globe

In recent months, protests against China are occurring regularly in different parts of the world; London, New Dehli, Toronto...you name it.

On Sunday, there was a massive protest against the communist regime held in Vancouver near the Chinese consulate. Many of the Canadians who participated are from other parts of the world, such as Hong Kong, Tibet, India, and the Philippines, to name a few. The protesters stood in opposition to China’s treatment towards people in Hong Kong and Tibet, and urged the international communities to intervene to get two Canadians, who have been held hostage by the Chinese government, released. Many nations are now banning apps from China, putting a stop to Huawei or 5G networking business, as well as reviewing their relationships with China.

Carrie Lam Uses Emergency Law to Delay Hong Kong's Legislative Election for One Year, Further Arrangement to be Made by Beijing

The Hong Kong SAR Government announced the postponement of the Legislative Election one day after 12 pro-democracy candidates, including incumbent lawmakers of Civic Party, were barred from running in the election.

The HKSAR government has particularly cited the difficulty for 600,000 senior citizens and registered Hong Kong voters in China to cast their ballots during the coronavirus outbreak in Hong Kong.

This is the second time Carrie Lam invoked the Emergency Regulations Ordinance in less than a year. In October 2019, the HKSAR government bypassed the legislature to enforce a mask ban at the height of the Anti-ELAB movement.

In a survey result released by Hong Kong Public Opinion Research Institute (#PORI) on the same day, 73% of the respondents with a pro-democracy orientation did not want to postpone the LegCo election.

The nomination period ends on 31 July, but many nominees have yet to receive any confirmation of their candidacy.

Tam Yiu Chung, member of the Standing Committee of the National People's Congress, had stated on 21 July that many Hong Kong citizens had moved to the Greater Bay Area, and have no permanent residence in Hong Kong. According to data from the Census and Statistics Department, as of mid-2019, about 540 thousand Hong Kong citizens usually stay in Guangdong Province, with only 129 thousand (24 %) being part of Hong Kong's resident population.

According to article 28 of the Legislative Council Ordinance, "A natural person is not eligible to be registered as an elector in the register of geographical constituencies unless, at the time of applying for registration, the person satisfies the Electoral Registration Officer that the person ordinarily resides in Hong Kong; and that the residential address notified in the person’s application for registration is the person’s only or principal residence in Hong Kong.

For the time being, the new date Carrie Lam set for the Legislative Election is September 5, 2021.
