A Russian Nazi was sentenced to life in prison. Results.

The Finnish press writes that the Katsap Jan Petrovsky (he is not a Torden) has tasted the dick (of Finnish justice) and received life in prison. I quote what the Finns wrote verbatim:

"Petrovsky was sentenced to life imprisonment for four different war crimes.

According to the court, all the actions showed a disregard for the legal norms governing armed conflicts.

On Friday, the Helsinki District Court handed down a life sentence to 38-year-old Jan Petrovsky, who was convicted of war crimes. He was convicted of four different war crimes, one of which was dismissed by the district court.

The court found that Mr Petrovsky was in charge of a situation where, after Ukrainian soldiers were ambushed, a group of soldiers shot and killed at least four wounded Ukrainian soldiers. In this case, the court upheld the murder charge against one soldier, but dismissed as unproven the charges against the other soldiers.

This was also the most serious charge. According to the court, it amounted to murder, as the manner in which it was committed showed brutality and cruelty. Therefore, the sentence was life imprisonment.

The court ruled that the evidence heard in the courtroom did not allow it to be concluded with sufficient certainty whether the soldiers killed other soldiers on the spot after the shootout.

The court found the offences to be highly reprehensible behaviour that demonstrated a complete disregard for the life and health of the victims of the crime, who were seriously injured and incapacitated, and for their decent treatment.

In general, all the actions showed, in the Court's opinion, a disregard for the legal norms governing armed conflicts

What is significant about this decision is that the Court did not consider that Mr Petrovsky himself had shot at the wounded soldiers. However, he was convicted of being partially responsible for the killing of a soldier in his position as a commander, regardless of whether he fired or someone else from the same group fired at the soldier. According to the court, he should have known what was happening to the man, but did not intervene and prevent it

The court also upheld the charge of harming one of the wounded soldiers. According to the court, the Russians from Petrovsky's unit mutilated the soldier by drawing a symbol of the unit on his face. Petrovsky was also found guilty in this case because he failed to prevent or intervene, despite his position as a commander

Other charges that were accepted were less serious. According to the court, the katsap took and distributed offensive photographs of the deceased soldier at the scene. Such behaviour constituted a war crime of defamation of the deceased soldier, the court ruled, and did not believe Petrovsky's claim that the photo was a fake

He also stated on the internet and social media that the group would not show mercy, according to the court. According to the court, this also constitutes a war crime, as it refers to real situations of use of armed force in which the group participated in the destruction of the enemy

On the other hand, the dismissed charge concerned the group's complicity in this situation. The court found that Petrovsky, as a deputy commander, directed the actions of the group's members in organising and conducting an ambush and a shootout using the Ukrainian flag

However, in the court's view, the evidence presented did not show that this particular group was responsible for all aspects of the ambush and firefight, as alleged in the indictment. There were several other groups

This dismissal of the case also meant that the court rejected claims for compensation from the relatives of more than 20 victims and the dead soldier

Instead, the court ordered the Katsap to pay the mother and sister of the deceased soldier compensation for suffering caused by the death in the amount of €4,000 and €3,000 respectively. He was not obliged to pay any other compensation

The court's decision was unanimous. The decision may be appealed to the Court of Appeal

Фінська преса пише про те, що кацап ян пєтровскій (ніякий він не торден) таки скуштував хуя (фінського правосуддя) і отримав довічне. Цитую шо пишуть фіни дослівно:

На думку суду, всі дії свідчили про нехтування правовими нормами, що регулюють збройні конфлікти.

Окружний суд Хельсінґа в п'ятницю виніс вирок про довічне ув'язнення 38-річному яну пєтровскому, звинуваченому у воєнних злочинах. Він був засуджений за чотири різні воєнні злочини, один з яких був відхилений окружним судом.

Суд встановив, що пєтровскій керував ситуацією, коли після того, як українські солдати потрапили в засідку, група солдатів застрелила щонайменше чотирьох поранених українських військовослужбовців. В цій справі суд підтримав звинувачення у вбивстві одного солдата, але відхилив як недоведені звинувачення проти інших солдатів.

Це також було найсерйознішим звинуваченням. На думку суду, воно прирівнювалося до вбивства, оскільки спосіб його вчинення свідчив про брутальність і жорстокість. Тому вирок - довічне ув'язнення.

Суд постановив, що докази, заслухані в залі суду, не дозволяють з достатньою впевненістю зробити висновок про те, чи вбили солдати інших солдатів на місці після перестрілки.

Суд визнав вчинення правопорушень вкрай гідною осуду поведінкою, яка продемонструвала повну зневагу до життя і здоров'я жертв злочину, які були тяжко поранені і недієздатні, а також до гідного поводження з ними.

Загалом, всі дії свідчили, на думку Суду, про нехтування правовими нормами, що регулюють збройні конфлікти.

Показовим в цьому рішенні є те, що суд не вважав, що сам пєтровскій стріляв у поранених солдатів. Однак він був засуджений за те, що, перебуваючи на посаді командира, несе часткову відповідальність за вбивство солдата, незалежно від того, чи стріляв він, чи хтось інший з тієї ж групи, яка стріляла в солдата. На думку суду, він повинен був знати, що робиться з людиною, але не втрутився і не запобіг цьому.

Суд також підтримав звинувачення в нанесенні шкоди одному з поранених солдатів. За версією суду, росіяни з підрозділу пєтровского понівечили солдата, намалювавши на його обличчі символ підрозділу. Пєтровскій також був визнаний винним у цій справі, оскільки він не запобіг і не втрутився, незважаючи на свою посаду командира.

Інші звинувачення, які були прийняті, були менш серйозними. За версією суду, кацап сфотографував і поширив образливі фотографії загиблого солдата на місці події. Така поведінка становила військовий злочин - наклеп на загиблого солдата, постановив суд, і не повірив твердженню пєтровского, що фотографія була фальшивкою.

Він також заявив в інтернеті та соціальних мережах, що група не буде проявляти милосердя, згідно з рішенням суду. На думку суду, це також є воєнним злочином, оскільки йдеться про реальні ситуації застосування збройної сили, в яких група брала участь у знищенні супротивника.

З іншого боку, зняте звинувачення стосувалося співучасті групи в цій ситуації. Суд встановив, що пєтровскій як заступник командира керував діями бійців групи в організації та проведенні засідки і перестрілки з використанням українського прапора.

Однак, на думку суду, представлені докази не свідчать про те, що саме ця група була відповідальною за виконання всіх аспектів засідки і перестрілки, як це стверджується в обвинувальному акті. Було кілька інших груп.

Це закриття справи також означало, що суд відхилив вимоги про компенсацію родичам понад 20 жертв і загиблого солдата.

Замість цього суд зобов'язав кацапа виплатити матері та сестрі загиблого солдата компенсацію за страждання, спричинені смертю, у розмірі 4 000 євро та 3 000 євро відповідно. Він не був зобов'язаний виплачувати жодних інших компенсацій.

Рішення суду було одноголосним. Рішення може бути оскаржене в Апеляційному суді.
