Fill in the following template and sent it to bosses:
As a permanent worker, I am entitled to be paid for my contractual hours in full and on time. This is your main obligation as a contractual partner towards me, even if you are in default of acceptance, i.e. if you do not call for my labour.
My contractual working hours are _ hours per week. From the _ calendar week to the _ calendar week, you have only called up _ hours from me. You are therefore in default of acceptance with ___ hours according to §293 BGB and §615 BGB.
You are obliged by the contract of employment pursuant to §293 BGB and §615 BGB to pay me for my full contractual working hours, i.e. also the working hours which you did not call up.
I assert the following:
1. A total of _ working hours in the _ calendar week to the _ calendar week equalling to __ Euros per hour, i.e. a total of ____ Euros due to default of acceptance (§293 BGB and §615 BGB).
2. My right - in the event of non-fulfilment of your contractual performance through incorrect payment of my salary - to withhold my work performance in accordance with §273 BGB or §320 BGB from the issue of an incorrect salary certificate or receipt of an (incomplete) salary payment (depending on which occurs earlier).
