An Example of How Scholars Can Derive Different Rulings from the Same Evidence.

Background of the issue: When performing wudhūʾ (ablution), how much of the head is required to be wiped? Should you wipe the entire head, or is it sufficient to wipe only part of it? This question has led to differing opinions among scholars based on their interpretation of the same Qurʾānic evidence.

In discussing the verse:

"وامسحوا برؤوسكم"
"And wipe over your heads." [5:6],

Scholars have differed on the Fiqh issue regarding how much of the head must be wiped during wudhu (ablution). The differences arise due to varying interpretations of the Arabic letter "بـ" (bi-) in the verse. Here are the main opinions:

1 The Maliki and Hanbali opinion: The entire head must be wiped. They interpret "بـ" (bi-) as باء التعدية (for emphasis), making it equivalent to saying, "وامسحوا رؤوسكم" (And wipe your heads), meaning the entire head is included.

1 The Shāfiʿī opinion and an opinion of Ahmad: It is sufficient to wipe only part of the head, even if it’s just a few strands of hair. They interpret "بـ" (bi-) here as باء التبعيض (for partiality), indicating that wiping a part of the head fulfills the obligation.

1 The Hanafi opinion: A quarter of the head must be wiped. They interpret "بـ" (bi-) as باء للإلصاق (for attachment), meaning it denotes the direct contact between the hand and the head; and the obligatory amount of wiping is fulfilled by physically wiping a quarter of the head with the hand.

Author's Note: Just to be safe, it is recommended to take the safer opinion and wipe the entire head during wudhūʾ to ensure that the obligation is fully met.

حَدَّثَنَا بِشْرُ بْنُ مُحَمَّدٍ، أَخْبَرَنَا عَبْدُ اللَّهِ، أَخْبَرَنَا مَعْمَرٌ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ إِيَّاكُمْ وَالظَّنَّ، فَإِنَّ الظَّنَّ أَكْذَبُ الْحَدِيثِ، وَلاَ تَحَسَّسُوا، وَلاَ تَجَسَّسُوا، وَلاَ تَحَاسَدُوا، وَلاَ تَدَابَرُوا، وَلاَ تَبَاغَضُوا، وَكُونُوا عِبَادَ اللَّهِ إِخْوَانًا ‏”‌‏.‏

Narrated Abu Huraira: The Prophet (ﷺ) said, “Beware of suspicion, for suspicion is the worst of false tales; and do not look for the others’ faults and do not spy, and do not be jealous of one another, and do not desert (cut your relation with) one another, and do not hate one another; and O Allah’s worshipers! Be brothers (as Allah has ordered you!”)

“Islām has protected the Muslim woman and safeguarded her, keeping her away from places of destruction, disgrace, loss, and violation.

It has warned of places that lead to ruin, with the utmost caution due to the severe consequences, both general and specific.

So, where is the one who is seduced by the deceit of the enemies now?!

Does she expose herself to all of this?”

However, were you to frown upon the people, they would stay away from you and not feel comfortable sitting with you or talking to you.
You may even become afflicted with a dangerous condition: high blood pressure. Having a tranquil chest and a pleasant smile is the most wholesome remedy and best preventative measure for this condition.

For this reason, physicians advise people who have this condition to stay away from what disturbs and angers them, since those things only agitate this condition. A pleasant smile actually has a remedial effect on this condition, since it leads to a tranquil chest, and it cause others to love you.
