Al-Imām Muhammad ibn Sirīn (d. 110 AH) said:

Do not argue or debate except with a person whom, if you speak to them, you hope they will reconsider and return (to the truth). As for the one whom you speak to and they simply argue and debate back, then beware of speaking to them.

Questioner: May Allāh reward you and bless you. A question has been raised regarding whether compensation (diyah) is due if a person assaults another and shaves his beard, especially if the beard does not grow back again?

Sheikh Sulaymān Ar-Ruhaili waffaqahaullah:

The beard is considered a full, honourable organ of a man. If someone damages a full, honourable organ of a man, full compensation (diyah) becomes obligatory (i.e. 100 camels). Therefore, the correct opinion among scholars is that if a person assaults a man and shaves his beard, compensation is due, even if the beard will eventually grow back. The key consideration here is the act of aggression itself. The shaving of the beard is an assault that requires compensation, which is currently estimated at 100,000 (Saudi) riyals.

Many Muslims, however, willingly offer their cheeks and beards to barbers for a fee of five riyals, neglecting the honour that Allāh has bestowed upon them with their beards. Some Muslims are heedless of this honour. ’Ā'ishah (may Allāh be pleased with her) used to say, "By Him who adorned men with beards, and by Him who honoured men with beards."

One of the honours of the beard is that if it is trangressed/damaged, full compensation is due. This is a principle recognised by the reputable scholars: that every full and honourable organ of a person, when assaulted, warrants full compensation. If the organ is one of a pair, then the compensation for one is half. This principle has been established by the authoritative jurists.

We shall conclude here for tonight. And Allāh knows best. May peace and blessings be upon Muḥammad, his family, and his companions.

A sad yet funny story about the oxymoronic Takfīri Khâriji Algerians by Muhammad Hisham Al-Tahiri

"Do you bear witness to the misguidance of the one better than you?"

This is from the conditions of the Khawârij. Do you want to become one of them? From their conditions is that you testify to the disbelief of your fathers, grandfathers and those that oppose them. If you don't, they will not accept you.

In the year 1990, I was the Imam and Orator for the Saudia Arabian Red Crscent Hospital in Quetta, Pakistan. At the same time I was the secretary for the Directory of the Hospital.

There was a night, I was sitting at the head of the dining table. Sitting in my normal seat was the Treasurer of the Red Crescent Hospital, this man was an Algerian who was influenced by the doctrine of the GIA, Khawârij.

A guest who claimed himself from the Mujahideen entered upon us and sat infront of the Treasurer. They started to speak in Algerian, which is a difficult dialect, so I understand only so much. Even so, from what the little I understood, I was able to deduce they made Takfīr of King Fahd.

I said "My honorable brother, am I mistaken or did you make takfīr of King Fahd?"

The Algerian guest said non-chalantly "Of course he is a Kâfir."

At that time, King Fahd was alive and he was the ruler, may Allâh have Mercy upon him.

I said "One moment, one moment. Patience, patience. Imam Bin Baz is greater than us in stature and knowledge and Bin Baz did not declare King Fahd to be a Kâfir."

The Algerian said "Bin Baz is Kâfir"

By Allâh the One who is worthy of worship in truth, my hair stood up. This was the first time in my life having this feeling to the point my headdress was going to fly off.

This was the first time I heard someone ever making takfīr of Bin Baz.

I said "One moment, one moment. Let us leave off King Fahd, may Allâh protect him with His wisdom and mercy. Let us be with Shaykh Bin Baz, why is Bin Baz a Kâfir?"

I have heard about the Takfiriyyeen amongst our people in Kuwait and other places however I've never heard of anyone making Takfīr of Bin Baz. Bin Baz is the remnants of the Salaf.

The Algerian asked me "where does Bin Baz work?" I answered him "Presidency of the administration for Permanent Committee for Scholarly Research and Ifta."

The Agerian said "See, he works for King Fahd. King Fahd is an asset of America. America's asset is a Kâfir and anyone who works with him is a Kâfir."

So he's making chain takfir and this is something our teachers taught us about the Khawârij. Lawazim is takfir by necessity.

So I said "Your friend, the Algerian treasurer works for the Saudi Arabian Red Crescent."

So the Algerian guest made takfir of his friend for his work. They started to argue with each other for around 15 - 20 minutes. Each one making takfīr of one another.

After arguing, they became quiet and calm. They turned to me and said "This is ghaneemah, war booty. This is not considered disbelief."

So I said "Beautiful, so consider Bin Baz' work as Ghaneemah, don't say he is a Kâfir."

The Algerian said "Uff, if I had a gun, I would have shot you in your head."

By Allâh I had no response. The Algerian is ignorant, compounded ignorance.

By Allâh the Algerian was a memorizer of the Qur'an.

Afterward I was told this man died in the Algerian Civil War with the Khawârij in 1992 or 1994.

So listen "Do you bear witness to the misguidance of the one better than you? What will you say to Allâh tomorrow when Allâh puts you on the stand?"

Takfīr doesn't stop, don't assume that Takfīr ever stops.

Ibn Mas’ūd (may Allāh be pleased with him) said: “Whoever comes to you with the Truth, accept it from him, even if he is someone far from you and hated.

And whoever comes to you with falsehood, reject it from him, even if he is someone close to you and beloved.”

“Some of the people today have innovated regarding Surah al-Fātihah and have began closing their supplications and beginning their sermons with it and reciting it on (what they consider) special occasions, and this is incorrect.

You’ll find, for example, if one makes Du’ā they’ll say to those around them, ‘al-Fātihah!’, as a command for them to recite Surah al-Fātihah.

Those who begin their khutbas with it and select specific occasions for reciting it are in error, because worship is built upon that which is confined to textual evidence along with compliance with the Sunnah.”
