Brief;

End of 2020, in Qld, had some fines go to SPERs for unpaid speeding fines due to me moving home and not getting them in mail.

Attempt to pay SPERs over the phone to clear the debts, but when dialling the listed number for SPERs comes up on my phone as [PRIVATE SOLE TRADER BUSINESS NAME REMOVED]. I figure I've keyed in the wrong number, so hang up and try again. Nope, same again. Do some checks on [PRIVATE SOLE TRADER BUSINESS NAME REMOVED] - listed as sole trader and not registered for GST. Not real keen on paying a sole trader, stupid corporate infringements made up by a fake government.

It's the weekend, I need a break from work and researching all this stuff. So put off paying SPERs.

Aust Day 2021, pulled over for speeding (had been at work at my own business). Comes up my license is suspended due to not paying the SPERs debts. Summons for a court appearance.

Knowing the system and courts are corrupt, I don't show up to court. My understanding is the system works on consent. By showing up, you are consenting.

Few weeks later, plain clothes police come with warrant to arrest me for the court no show. Take me to watch house where they leave me for a couple of hours before 'making' me sign a document agreeing I will turn up to court (they tell me they will put me back in cell if I don't sign - coercion anyone?). Then drive me back home where I catch them speeding in the same spot I got caught speeding and they run through a stop sign.

So, turn up to court (out of curiousity to experience what actually happens) next time where I stated to magistrate as to why I hadn't paid my SPERs fines due to the irregularity of a private companies phone number ([PRIVATE SOLE TRADER BUSINESS NAME REMOVED]) being listed on a supposed government organisation in direct relation to paying the fine.

I'm pretty good at reading someone's body language when I want to. The magistrate paused and then laughed and then mocked me and said something along the lines of "oh that's a first. That's the first time I've heard that excuse". Laughing. He then goes on to say in a more serious voice "I hope you've got a good lawyer".

I could see the game he was playing. Even if I were wrong, any professional in a role would have the decency not to laugh at you - especially in a court over a legal matter. Supposed to be a serious matter isn't it? He actually stated at one stage that speeding doesn't actually cause that many accidents (already knew this fact)

From that I instantly pleaded guilty - no point wasting my own time playing their silly games. That kind of took him by surprise. I think he was expecting me to try fight a bit more. He states a $fine that will be added to my SPERs and I'm good to go.

Being a stickler for principles, I've since continued refusing to pay any SPERs debts they put against me.

I'd prefer not to pay any monies to a corrupt fake government but I do still pay my car rego for 2 reasons.

1. Automated plate recognition, or no plates has the potential to have me being pulled over and harassed

2. My understanding of the corporate law (pretending to be government law) is that they can eventually impound and then crush your car if not registered. Although if it's not registered with them then they have no right to cease it right? Still got to test this theory out. Although given how dumb and brainwashed/compliant road policing is, they do illegal stuff that they think is law anyway....

So get pulled over again maybe a month later. Didn't physically have license on me. Cop looks up to see license is suspended and another court summons is given to me over it. Plus I have 7 days to go to local police station to prove my identity seeing as I had no ID on me.

Turn up at police station wearing Hazmat suit, goggles, gloves and the only time ever I've worn a mask - was worth it for the response as I walked through the station.

The date for the court summons ended up being during a lockdown, so I get a text saying the court will call me and the session will be done over the phone on that date.

So I block that number texting me and report it as spam. Who needs stalkers and spammers!

Sure enough on the day I get a phone call..... which I ignore and go about my day.

Maybe a few months pass, I'm on my motorbike. Pulled over and license check (didn't physically have any license on me) comes up as a warrant again for no show at court. Off to watch house to sit for a couple of hours - this time they give me the infared heat detection gun to the forehead before I enter [cause covid right]. Same drill, sign form to agree to show up to court. This time ask a few more questions to the watchmen... Form refers to the 'Crown' so I ask which crown it refers to. I'm very calm, collected, well spoken and softly spoken when need be. The question instantly triggered the two watchmen. Instead of simply answering the question, they start trying to mock me (seems like the only way all these frauds know how to operate). Before I know it they are calling me a sovereign citizen to which I calmly tell them there is no such thing and what's made them so worked up and has them jump to that conclusion over one simple question about which crown. During the interaction I sign the form with 'Under Duress'. When one of the watchmen tells the other to get me out. So as he pushes me out the door, I can't help myself but ask him why is he getting so worked up, so rude and being so aggressive, at which point I'm out the door.

So I must of broken my phone and had a new one, as a few days before this Court date I get a text message reminding me of it. So I promptly block the number and report it as spam again. This is perhaps Oct or Nov 2021.

So I carry on with life.

Not until about 2 weeks ago, I've been pulled over again. Once again, no drivers license or identity on me. When he's asked for my name and DOB to do the check I thought "here we go, arrest again". Nope not this time. Gave me a breath test then tells me the fines are electronic now and whether I want it emailed or texted to me.... then lets me drive off.

What I've concluded so far is; that the whole legal system is a privately owned system (broken up in to seperate entities - police, magistrates, debt/fine collect).

Police are too dumb/compliant and have guns and back up - so no use fighting them.

Courts/Magistrates have no actual power over you - hence why all they can do is issue a warrant to get those dumb/compliant goons mentioned above to blindly come after you. Their only other role is to convince you (primarily though fear, consent, shame and gas lighting) to believe that you have to pay the fines.

Fines/Debt Collectors - just a privately owned business who the system tries to make you believe you must pay.

I truly believe that if the population, on mass, starts (respectfully) ignoring these goons and stops funding them (paying fines) the power dynamic can be changed. Change of mindset. Make them work damn hard to get nothing from you. It will come down to a business decision for them - if the return (nothing) on their investment (chasing people, court run arounds, fuel, employee wages etc) becomes negative, then they'll be forced to look for better returns else where.

By feeding a tyrant/narcissist when he demands you to isn't going to encourage them to stop the behaviour.
Not a bad idea holding these individuals accountable…

Freedom Cells & Mutual Aid Network Australia introduce the following group ~

Freedom Fairs 🤝 Exchange ~ Organisers/Facilitators
https://t.me/+e2K9bxPB6OhiYWQ1

Freedom Fair Exchanges are an integral component of establishing and maintaining functional parallel communities/society across Australia.

It is important that we establish independent Fair Exchanges (market places) and have them functional and flourishing by the introduction of the Central Bank Digital Currencies (possibly 2023/2024) and the social credit scores attached to them which limit where you can spend the digital currency such as the distance from your house, what stores, only certain products (GMO and synthetic food and clothing) and when your digital currency expires (they will place expiry dates on money so you cannot save).

Freedom Fair Exchanges are also a great place for communities to have fun and socialise, enjoy a picnic, make important connections and network for everything that you need, in a private and enjoyable space, often with live music and valuable homesteading and exercise demonstrations 🪕🪓 🍉🥖🥧🧀🍯 👨‍👩‍👧‍👦

Creative forethought, planning and preparation goes into Freedom Fair Exchanges on a voluntary basis which is also very rewarding.

If you would like to organise a Freedom Fair Exchange in your area we invite you to join our collaboration page where other organisers can support and assist you with ideas and strategies to help get you going.

We invite everyone who is running a Freedom Fair Exchange (otherwise known as a Market, Swap Meet) to join the page and collaborate by sharing ideas and supporting one another, so that no matter how big the failures and successes there are others there to assist, support and celebrate with you.

Ruth, who runs Easy Edible Gardens and the Bathurst Mutual Aid Group/Freedom Cell has organised four successful Freedom Fair Exchanges, and is currently available to help new organiser and support and exchange ideas with other organisers.

If you are ready to run a Freedom Fair Exchange in your community please join the page. We want to help you in overcoming the hurdles so that you can succeed and create a basis for independent trade and exchange in your area 🤝🐓🍎🥑📋

Note:
• Groups are transitioning away from the word 'Market' due to the legal implications opening organisers and stall owners up to council fines and taxation.
• Anyone who joins the group and is not working on a Freedom Fair Exchange or something similar will be removed from the group.

YOU DO NOT HAVE TO PAY TOLLS
01 April 2017 - A Pomona man's legal challenge over allegedly refusing a breathalyser test is not the first time a Sunshine Coast resident has taken on the law. Christopher James David Summers is currently locked in a legal battle over his alleged refusal to provide a sample of breath when pulled over by a police officer on the Sunshine Coast.
Before Summers, there was pensioner and former Noosa councillor Bob Jarvis, 70, who has not paid a toll for six years. Jarvis has refused to pay a toll since coin baskets were taken away and eToll introduced in 2011.
When he received a toll breach in 2011 with a court summons to pay, he elected for a court hearing. The Department of Transport and Main Roads emailed Jarvis before the hearing to say it would offer no evidence and would request the court formally dismiss charges. Neither he nor his wife has paid for a toll since. When Jarvis's brother was also sent a notice for refusing to pay his toll, he used the "Jarvis Defence" and the toll notice also disappeared.
Jarvis has used Chapter 5 'The States' Section 115 of the Constitution as his defence. "A State shall not coin money nor make anything but gold and silver coin a legal tender in payments of debts" was his backing. Jarvis, who said that he knew the Constitution better than most, believed Summers probably made a vital flaw when allegedly refusing to take a breathalyser test.
"There is a big chance the poor bugger has a driver's licence," Jarvis said. "The Australian Constitution tells you that you don't need a driver's licence to drive a car, but once you have signed up for one, you have to abide by the Transport Act."
However, where Summers may have been following the Constitution was in refusing to enter a plea when he was before a magistrate. This is a part of the constitution Jarvis has tested himself when he was 20 and refusing to go to Vietnam. "In Common Law, you don't have to enter a plea," Jarvis said. "I went to court when I was 20 and conscripted to Vietnam and said I wouldn't go.
"I said I was not giving a plea. The judge at the time said 'what are we going to do with you'? I said, 'I don't care, I'm not going to Vietnam' and the Australian Constitution clearly states you cannot mass conscript a person to do anything unless Australia is in immediate threat of invasion. Vietnam had nothing to do with an immediate threat to Australia. The magistrate adjourned the case to make some phone calls. He came back in and said 'point of law, Mr Jarvis you are free to go'."
Jarvis also believed everyone should refuse to pay the toll, as it was illegal. "When you pay a $1.40 for a litre of petrol, you are actually paying 53 cents plus GST petrol excise for roads, bridges and tunnels," he said. "So they are taxing us for road, bridges and tunnels, and the Constitution clearly states in black and white that if the Federal Government taxes something like roads bridges and tunnels then no other government or council is allowed to tax the item."
CARR COMMENTS
This report is not an April Fool's Day gag - it is for real. CARR has previously reported about Bob Jarvis and how he has been driving on toll roads for years without paying tolls. In fact he not only has the Australian Constitution to back him up, he also has Section 16 (Legal Tender) of the federal Currency Act 1965 that states, "A tender of payment of money is a legal tender if it is made in coins that are made and issued under this Act and are of current weight"
Essentially, this means that items such as cheques, credit cards and especially toll tags are not legal tender. Yes, people accept payment by these methods, but that is only by agreement. The only legal tender that can be used to pay debts is "coin of the realm" - real money issued by the Government of Australia and produced by the Australian Mint.
Forwarded from Rami T
The Currency Act 1965 is a federal Act and therefore overrides any conflicting state laws. So if a toll road operator has not provided facilities to collect such "coin of the realm" at the entrance to a toll road, then a motorist can consider that the toll debt is "forgiven" and he can proceed to drive on that toll road for free.
Bob Jarvis has been proving this principle for many years. The Department of Transport and Main Roads sent him numerous demands for payment and he was even summonsed to court, however the Department saw that it was going to be thrashed and abandoned the action against him. This merely proved that Jarvis was right and to this day, he drives on toll roads for free and no government or toll road company bothers to try and prosecute him.
So it shows that the Constitution would have to be amended by referendum and the Currency Act 1965 would have to be repealed to allow payment other than "coin of the realm" to be considered legal tender. Until that happens, anybody can drive on any toll road without paying the toll and use the "Jarvis Defence" to counter any demands for payment.
As for the breathalyser issue, this brings up some interesting things to consider. Bob Jarvis stated, "The Australian Constitution tells you that you don't need a driver's licence to drive a car, but once you have signed up for one, you have to abide by the Transport Act."
A CARR subscriber actually confirmed that to me the other day when he stated that the State can only prosecute people for driving without a licence because they have entered into a "joinder" with the State. The application of Joinder is usually used when two or more parties to a legal action are "joined" and act as one entity, however the principle seems to apply to contracts and agreements.
In other words, when a person applies for a driver's licence in a particular state, he agrees to abide by the road laws of that state. Of course that person is not bound by those road laws if he has not agreed to abide by them and the Constitution allows him to drive on roads. This is what Bob Jarvis claims and although I have not heard of any person without a licence who was booked for driving unlicensed using this defence, but I sure would be very interested to see a few precedents.
Bob Jarvis also stated, "In Common Law, you don't have to enter a plea." However, I have read a mountain of reports of criminal cases where a defendant has refused to enter a plea and the magistrate or judge has entered a plea for them, usually a "Not Guilty" plea. Furthermore, I received advice from the NSW Attorney General who stated that statute law superseded common law, so it's hard to know what to believe.
On one hand, I am told by many people that Common Law supersedes Statute Law and the Attorney General has told me the exact opposite. On top of that, I have seen defendants go to court and argue that they have Common Law rights and magistrates have just dismissed their arguments and applied Statute Law of the particular state and convicted them, whereas Common Law would have seen those matters dismissed. Who do we believe?
So the conclusion that I draw from all this is that nobody needs to pay tolls when driving on toll roads and the proof is in the pudding, so to speak. Bob Jarvis has proven this time and time again. As for the Constitution saying that you don't need a licence to drive on the roads and beating an "Unlicensed Driving" charge in court using that defence, I want to see some hard evidence of somebody successfully doing that. Talk is cheap - for me, only hard evidence works.
VACRON UPDATE
I have received orders for four more units of the fabulous Vacron CDR-E07-WiFi car black box recorder and the shipment should be well and truly on its way.
I am ordering them in lots of 4 units because it is a cheaper to get them this way without incurring a whopping Australian Customs AQIS Air Entry Charge plus the Import Declaration N10 Charge.
Forwarded from Rami T
The freight charge is more for such a smaller order, but the cost of each unit works out to be much the same, but the bureaucracy and paperwork is nil, compared to ordering a shipment of 20 units. And believe me, I am doing this without profit, so I don't need any more paperwork in my life...... LOL
A number of CARR subscribers have indicated that they wish me to acquire this fantastic device for them, so if you are still interested in getting a Vacron black box, please let me know and I will send you payment details. Once I get another 4 payments, I will order another shipment from the manufacturer.
