Members of the European Parliament (MEPs) and the Council reached a provisional agreement on the Artificial Intelligence Act, aiming to ensure AI in Europe is safe, respects fundamental rights and democracy, and promotes innovation.
The rules include prohibitions on certain AI applications, such as biometric categorization systems using sensitive characteristics, untargeted scraping of facial images for recognition databases, workplace and educational emotion recognition, social scoring based on personal characteristics, and AI systems manipulating human behavior to circumvent free will.
The legislation establishes obligations for high-risk AI systems, such as mandatory fundamental rights impact assessments, and guardrails for general artificial intelligence systems, including transparency requirements and stricter obligations for high-impact models with systemic risk.
The rules also include measures to support innovation and small and medium-sized enterprises (SMEs), such as regulatory sandboxes and real-world testing. Non-compliance can result in fines ranging from β¬7.5 million or 1.5% of turnover to β¬35 million or 7% of global turnover, depending on the infringement and company size.
