The development of AI technologies continues to amaze. But their use may not always be for the better. Dmitry Smirnov, a lawyer at EvenBet Gaming, shares his commentary on the impact of these processes on the KYC system:
The rise of advanced AI technologies like Sora presents new challenges for KYC regulations in the iGaming industry. As AI-generated videos become harder to tell apart from real ones, conventional biometric identification methods are being questioned.
To address this, the industry should focus on improving biometric authentication by incorporating more factors than just facial recognition, such as voice or behavioural biometrics recognition. Security measures can be strengthened by using robust liveness detection techniques, such as challenge-response tests or dynamic facial movements, to tell the difference between real people and AI-generated videos.
Additional security measures might be achieved by exploring blockchain technology that provides tamper-proof records and decentralised authentication, reducing the chances of fraud. Finally, AI-driven detection systems specifically designed to identify and flag AI-generated videos or deepfakes can continuously analyse and adapt to evolving techniques used in generating deceptive content, providing a proactive defence against fraudulent attempts.
By embracing these strategies, the industry can navigate the evolving landscape of AI technologies while upholding KYC integrity.

The Indian government will take on the role of regulating the online gaming industry
According to IT rules, online real money games must be approved by a regulatory body, while those without monetary involvement do not need such approval. The government will regulate the online gaming sector directly, as opposed to through a self-regulatory organization (SRO).
The Ministry of Electronics and Information Technology (MeitY) will develop a framework for certifying money-involved online games. Initially, MeitY had proposed SROs but found them to be industry-dominated, prompting rejection. Without a neutral SRO, government regulation remains in place. The framework under development by the government is yet to be detailed.
Expected SROs would include diverse expertise beyond gaming, but submitted proposals failed to meet requirements. A group of ministers has been formed to discuss regulatory frameworks, but clarity may only emerge post-general elections.
Companies and industry associations seek guidance on responsible gaming, player protection, and other aspects, advocating for a regulatory structure similar to Sebi.

UK parliament sees heated debate on affordability checks for online gambling
During a lively debate in the UK Parliament, Philip Davies MP vehemently criticized the Gambling Commission's proposed financial risk checks for online gambling, labeling them as "completely unacceptable." Davies, a former chair of the All-Party Parliamentary Group on Betting and Gaming, expressed deep concerns about punter autonomy and the potential adverse effects on the horse racing industry, a cornerstone of British sports.
In his impassioned speech, Davies stressed the importance of considering the perspectives of punters, who often find themselves caught in the crossfire between the betting industry and anti-gambling campaigners. He staunchly opposed the notion of allowing government bodies and bookmakers to unilaterally determine punters' spending limits without their input.
Responding to Davies, Carolyn Harris MP underscored the paramount importance of safeguarding vulnerable individuals from the harmful effects of gambling addiction. While acknowledging her fondness for the racetrack and bingo halls, Harris emphasized the need to prioritize consumer protection. She argued that implementing financial risk checks is a responsible measure aimed at preventing harm and promoting responsible gambling behavior.
Despite the spirited debate, it is unlikely to sway government policy. The Gambling Commission plans to proceed with a pilot program for enhanced financial risk assessments, which will involve collaborating with credit reference agencies and select gambling operators. Meanwhile, the Department for Culture, Media & Sport (DCMS) revealed projections indicating a potential decrease in gross gambling yield due to forthcoming maximum stake limits for online slots.

Online gambling projects often encounter various challenges, with fraud being a prominent concern. Advancements in technology have led to increasingly sophisticated methods of deceiving online casinos and poker platforms, making fraud prevention a daunting task. This poses significant financial risks for project owners, as exemplified by 888poker's $363,000 payout to fraud-affected players in 2023. According to Statista, the global cost of cybercrime soared to $8.15 trillion in the same year.
Addressing this issue necessitates effective data analysis. Data analysis plays a crucial role in uncovering security vulnerabilities and swiftly identifying anomalies, such as rare occurrences or software errors, which may not be immediately apparent to platform administrators but can lead to substantial financial losses. Netherlands doubles number of self-excluded players in 2023
The Netherlands saw a significant rise in self-excluded players from gambling, with numbers doubling from 30,806 to 60,902 between January 2023 and January 2024. In total, 76,000 individuals self-excluded during 2023, although most did so for periods lasting less than a year. Of the new exclusions in 2023, around 20,000 ended automatically during the year, while approximately 26,000 players chose to terminate their exclusion periods themselves, leaving nearly 61,000 still registered with the Netherlandsβ Cruks self-exclusion system by the year's end.
When opting for self-exclusion, Dutch gamblers can choose durations ranging from a minimum of six months to 'for life' periods of 99 years. In 2023, there was a notable decrease in customers choosing the minimum six-month period, with only 21.8% opting for it compared to 35% in 2022. This trend was accompanied by a significant increase in the average duration of self-exclusion chosen, rising from 13 years in 2022 to 22 years and eight months in 2023.
Licensed operators in the Netherlands are required to check new sign-ups against the Cruks register before allowing customers to play. The number of checks surged to 40.3 million per day in December 2023, up from 31 million per day in January.
Cruks was the primary reason for public contact with the Netherlands Gambling Authority (KSA) in 2023. The KSA received 5,534 contacts from the public during the year, compared to 3,999 in 2022. Of these, 3,873 enquiries were related to the Cruks self-exclusion register, highlighting its significance. The surge in Cruks-related enquiries was attributed to adjustments made to the register and its website, including the introduction of an eight-day cooling off period to prevent impulsive decision-making for players seeking removal from the register.

Brazil betting regulation to be ready by end of July
Brazil's Ministry of Finance has announced plans to implement fixed-odds betting in four stages, with the process expected to conclude by July 2024, marking a significant step towards regulatory framework in the country.
Outlined in Brazil's Official Gazette of the Union, the new ordinance details the implementation of regulations approved in Bill 3,626. The Regulatory Policy of the Prizes and Betting Secretariat (SPA), a ministry of finance body, will oversee the process and provide clarity on legal aspects while prioritizing necessary measures.
The phased roll-out will focus on key areas:
- Stage one: Until end of April 2024, regulations on technical, payment, and security requirements for operators will be published, along with guidelines for license applications.
- Stage two: Until end of May 2024, policies addressing anti-money laundering, anti-terrorist financing, and operator responsibilities will be unveiled.
- Stage three: Until end of June 2024, technical and security requirements for online gaming and procedures for monitoring gambling advertising will be announced.
- Stage four: Until end of July 2024, procedures for industry contributions to socially responsible causes will be outlined.
The industry welcomes this development after years of uncertainty. While the schedule appears practical, there are concerns about how the concept of fixed-odds betting will be defined. President Luiz Inacio Lula da Silva's signing of Bill 3,626 into law in December 2023 marked a significant milestone, although controversies remain, particularly regarding tax rates, which have seen adjustments along the way.

Colombian Gaming Authority Advocates for Unified Regulatory Approach in Latin America
During the GAT Expo Cartagena's academic day on April 9, Marco Emilio HincapiΓ©, the president of Coljuegos, proposed the formation of an international commission to collaboratively develop regulations for games of chance across Latin America.
HincapiΓ©'s proposal was introduced in the lecture titled 'Where are the games of chance in Latin America heading?', marking the opening of GAT Expo's academic agenda. The aim is to create a group of regulators from various countries to standardize criteria for updating regulations and address deficiencies in countries lacking constitutional support to monopolize games of chance, as Colombia does.
In his presentation, HincapiΓ© also highlighted Coljuegos' efforts against the black market and its contributions to health services. He shared that in 2023 alone, Coljuegos transferred close to COP 1.4 trillion ($365.8 million) to health services, emphasizing Colombia's leadership in gaming regulation and revenue generation.
Furthermore, HincapiΓ© stressed the importance of advancing legislation at the Latin American level to regulate virtual games, cryptocurrencies, artificial intelligence in betting, blockchain technology, and virtual reality. The initiative aims to foster collaboration among regulators and ensure a more cohesive regulatory landscape across the region.

Belgium's Gambling Advertising Ban Leads to Rise in Illegal Online Gambling
Since the introduction of a near-total ban on gambling advertising in Belgium on July 1, 2023, the country has witnessed a surge in illegal online gambling activities, according to a report by Gaming1.
The ban, which was implemented following a legal challenge by a consortium of sports teams and gaming operators, has faced criticism from Belgium's gambling trade body, Bago. The government's decision to proceed with the ban against the advice of the countryβs Gambling Commission has been a point of contention.
Gaming1's report highlights findings from surveys conducted by Nepa in 2023, revealing a 6% increase in online players using illegal websites and a 4% rise in deposits made on unauthorized gaming platforms in the months following the ban.
The report also draws attention to two significant studies. The first, conducted by the Belgian Gaming Commission (BGC), maintains a blacklist of 500 illegal gambling sites to date. The second study, conducted by Yield Sec, indicates a 4.4-fold increase in illegal operators in 2023, identifying 2,214 unauthorized sites.
The data underscores the challenges faced by regulators in channeling players towards legal and regulated operators amid increasing illicit online gambling activities in the absence of advertising.
