every time competency is brought up in any big news trial people get angry as if this would allow the defendant to just walk free. that is not how this works

if you are deemed incompetent but able to be rehabilitated to the point that you can stand trial then you are committed to an institution until you are deemed competent, then your trial commences. if you are found guilty, your time while committed for rehabilitation is not counted towards your time served.

if you are deemed incompetent and not able to be rehabilitated you are either freed (only for minor nonviolent offenses) or you are involuntarily committed indefinitely. being sent to the looney bin forever is a much worse fate than prison. they dont drug you in prison, they also dont strap you down to you bed every night. beatings by guards in prison are less severe and much less common than in a mental health facility.
