تكمن المشكلة الكبرى بمنع وتجريم الإهانة في أنّ الكثير من الأشياء يمكن تفسيرها على أنها مهينة وساخرة. يمكن تفسير النقد لبعض الجهات بسهولة على أنّه إهانة لها.
