The option on the bottom is turned on by default «for a faster experience». Preloading the «new tab» includes cookies, which is quite obviously the reason it's turned on by default.

Funnily enough, the grounds for the false copyright strike is the custom thumbnail attached to the post, and nothing in the video itself.

Seems like the owner of Dave's Garage is very agitated by the facts stated in that video.

I am happy to announce, following the backlash and a strong counter-notification, the false copyright strike was removed, and the video was reinstated. Thank you everyone for your support!
Commonly it takes YouTube ~2 weeks to reinstate the video, but it was reinstated in a day! Assuming YouTube realized the copyright strike was bogus, and they had to step in to remove the strike this early, Dave's channel might have received an warning for abusing the copyright system.
