According to the National Judicial Data Grid (NJDG), out of the 50+ million pending cases:

🔴 Criminal Cases — ~37–38 Million
(≈75% of total pendency)
Includes:
IPC & police charge-sheet cases
Bail applications
Sessions trials
Cheque bounce (NI Act) cases
Motor accident claims
Criminal matters dominate the backlog, especially in district courts.

🔵 Civil Cases — ~11–12 Million
(≈25% of total pendency)
Major categories:
🏠 Land & property disputes (largest civil contributor)
👨‍👩‍👧 Family & matrimonial cases
💼 Contract & money recovery suits
🏢 Service matters
📜 Writ petitions (mainly in High Courts)
Civil cases are fewer in number — but many are long-pending, particularly land disputes.

?

As per latest NJDG snapshots, pendency is not evenly distributed. A few large states account for a major share of India’s total backlog.

🥇 Top States by Absolute Pending Cases
Uttar Pradesh — ~11–12 million (highest in India)
Maharashtra — ~6–7 million
Bihar — ~4–5 million
West Bengal — ~3–4 million
Madhya Pradesh — ~3–4 million

Together, these five states account for a very significant portion of the national backlog
