New dimension in this case in Supreme Court (Can be used as example elsewhere)
⏹ In Article 370 case, Kapil Sibal - appearing for petitioners - argued that union government has not taken opinion of people in J&K. Indicating toward Brexit, he claimed that even though there was no constitutional provision for referendum, still they sought opinion.
▶️ CJI, D.Y. Chandrachud responded and clarified that as a constitutional democracy, India seeks its public opinions through established institutions such as Parliament and not through Brexit-type referendums.
What does it mean? (analytical inference): It means parliament is the mouthpiece and reflection of people at large. Now a valid question arises here, if parliament represents public opinions, then why the ability of parliament is limited through "Basic structure doctrine"? It can be used to criticize Basic structure doctrine.
