SC Judgement on Article 370
[1] Article 370 was a Temporary Provision: The court held that Article 370 was a temporary provision and that the State of J&K had no internal sovereignty.
[2] Governor's role: The CJI said that the governor (President in J&K’s case) can assume “all or any” roles of the state legislature and such action must be tested judicially only in extraordinary cases.
[3] President can cease Article 370: Referring to Article 370(3), the president can unilaterally notify that Article 370 ceases to exist and there was no requirement for the President to secure the concurrence of the State govt in this regard.
[4] Executive function during president rule: Parliament in a State under the President’s rule was not restricted to mere lawmaking. It also extended to executive action.
[5] Conduct Elections & Restore Statehood: The court stated that J&K’s statehood should be restored as soon as possible.
