10 U.S.C. § 12406 is a federal statute titled “National Guard in Federal service: call.” It authorizes the President to call members and units of a state’s National Guard into federal service under three limited circumstances.

Whenever—
(1) the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
(2) there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or
(3) the President is unable with the regular forces to execute the laws of the United States;
the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.

•Enacted: Added by the National Defense Authorization Act for Fiscal Year 1995 (Pub. L. 103–337, § 1662(f)(1)), effective December 1, 1994. Similar earlier provisions were in former 10 U.S.C. §§ 3500 and 8500.
•Amendment: A 2006 change (Pub. L. 109–163) updated the wording in paragraph (1) from “Territories, Commonwealths, or possessions” to “Commonwealths or possessions.”
•Purpose: It is the statutory mechanism implementing Congress’s constitutional power (Article I, Section 8, Clause 15) to provide for calling forth the militia (here, the National Guard) to execute the laws, suppress insurrections, and repel invasions. Orders must go through the relevant state governors (or the D.C. National Guard commander).

A Coup Attempt is unfolding in Poland and their Sovereignty is at Stake!
Coup d'état allegations have erupted in Poland after the head of the country's top constitutional court was suspended, plunging the country into a political crisis because of PM Donald Tusk. The showdown became serious enough that Poland's president turned his plane around mid-flight, canceled a trip to Africa and rushed home.

It's a genuine legal dispute about which legal order is supreme — Polish constitutional law or EU law — and the October 30 crisis is the domestic flashpoint of that argument!

Judge Anna Korwin-Piotrowska — one of five judges elected by PM Tusk's parliamentary majority that President Karol Nawrocki refused to swear in — announced she was suspending Constitutional Tribunal President Bogdan Święczkowski and Vice-President Bartłomiej Sochański for one month and taking charge of the court herself.

The Tribunal's official account called the move a "coup d'état", stating Korwin-Piotrowska is not a legitimate judge (she was never sworn in) and that "all persons participating in these actions are committing the crime of a coup d'état."

Tusk and cohorts should be prosecuted under the Law:
Article 128 of the Polish Criminal Code, "Attack on a constitutional organ of the Republic of Poland"
