She was originally granted bail on September 1 after she was arrested but refused to sign a bail undertaking because of strict conditions including a curfew and the removal of some material from social media.
The 33-year-old woman is the founder of Reignite Democracy Australia and applied to have bail conditions varied in the Supreme Court of Victoria on Wednesday.
Ms Smitβs lawyer, Peter Chadwick, QC, told Justice Elizabeth Hollingworth that police were attempting to use laws, which place conditions on peopleβs behaviour when they are granted bail, to silence Ms Smit, and that conditions, such as a curfew, were onerous.

POLICE: IT'S TIME TO CHOOSE YOUR SIDE
Two ex-policemen are speaking out & saying things that many in the force are thinking but too afraid to say.
Buck (NZ) & Alexander (Aus) have both had a crisis of conscience and are unable to remain silent.
The police are being used, on behalf of governments to implement policies which serve foreign corporate powers & not the wellbeing of people.
Police are now expected to act in a fascist manner, with coercion, fear tactics and in Australia, they are now using force & firing rubber bullets & tear gas on protestors, for simply holding their ground in peace.
At some point, each police officer will have to ask themselves who they truly want to serve - freedom of the people or a state who disregards human rights, serving corporate interests.

The Counterspin Crew has put in a MASSIVE effort this past week and is still catching up on sleep, so we are putting our time into getting things primed behind the scenes, for some more epic interviews this week with a nurse, an ex-policeman and ANZAC patriots from Melbourne.
Since being locked out of the Auckland prison, we have had to set up a make shift home studio, which is coming along nicely.
We will also be covering a few events in Whangarei like zombie walks & vax protests.
