❇️ زنان فقط در طول حیات خود می‎توانند از دارایی‌هایی به جا مانده از والدین خود مطالبۀ ارث کنند.

✅ بر اساس حکم نهایی شورای عالی قضایی جمهوری اسلامی پاکستان در ۲۳ سپتامبر ۲۰۲۱، زنان فقط در طول حیات خود می‎توانند از دارایی‌هایی به جا مانده از والدین خود مطالبۀ ارث کنند. طبق این حکم، فرزندِ هیچ زنی پس از مرگ وی، حق چنین ادعایی را از پدربزرگ و دایی‌های خود ندارد.

✅ شورای عالی قضایی این حکم را در برابر ادعای فرزندان دو خواهر فوت شده از اهالی شهر پیشاور، مبنی بر مطالبۀ میراث از پدربزرگ‌شان، صادر کرد. عیسی خان، پدربزرگ این دو جوان، برای هیچ یک از دخترانش حق راث در نظر نگرفته بود و در سال ۱۹۳۵، تمامی دارایی و املاک خود را به اسم فرزند ذکور خود، عبدالرحمن انتقال داده بود. هیچ یک از دو دختر عیسی‌خان، در طول حیات خود ادعای حق میراث از دارایی پدر نکرده بودند و در مورد انتقال تمامی دارایی پدر به برادرشان نیز انتقاد و شکایتی نداشته‌اند. با این حال، فرزندان خواهرانِ متوفی، در سال ۲۰۰۴ برای دریافت سهم میراث مادر خود از املاک و دارایی پدربزرگ‌شان، به دادگاه شکایت کردند و آن دعوی از سوی دادگاه مدنی محلی پیشاور پذیرفته شد و به نفع ایشان حکم صادر شده بود. پس از تجدید نظرخواهی از جانب عیسی‌خان، دادگاه عالی پیشاور حکم دادگاه مدنی را رد کرد و فرزندان خواهران متوفی را مستحق میراث ندانست.

✅ نوه‌ها و نتیجه‌های عیسی‌خان با نپذیرفتن حکم دادگاه عالی پیشاور، به شورای عالی قضایی پاکستان شکایت بردند؛ اعضای شورای عالی قضایی، با رد درخواست تجدید نظر آنان، حکم دادگاه عالی پیشاور به نفع عیسی‌خان را تائید کرد. در حکم دادگاه عالی آمده است: «زنان باید در طول زندگی خود از والدین‌شان مطالبۀ حق وراثت کنند، در غیر آن، فرزندان‌شان از این حق محروم خواهند شد.» یکی از قضات دادگستری رسیدگی کننده به این موضوع گفت: «قانون از حقوق زنان در امر ارث حمایت می‌کند. با این حال، باید دید که وقتی زنان خود از حقوق خود چشم‌پوشی کنند و آن را مطالبه نکنند، چه خواهد شد؟»

✅ Possible topics of interest include but are not limited to:

The impact of structural racism, mass incarceration, policing practices, and the criminalization of immigration on Muslim communities, including the unique experiences and contributions of Black Muslims in the United States

📍The Journal of Islamic Law is interested in essays of between 6,000 and 8,000 words. We will also consider articles of up to 25,000 words. The Faculty of Law of the National University of Singapore (NUS Law) is one of the premier places for legal research in Asia. It has an active research culture with seven research centres, an intense and diverse array of research events and seminars, and large numbers of eminent researchers visiting it from around the world. In 2020, it was ranked the top Law School for research in Asia by the QS and Times Higher Education rankings, and 10th and 21st globally.

We invite applications for Post-Doctoral Fellowship positions commencing in AY2022-2023. These Post-Doctoral Fellowship positions may be held generally within NUS Law or, for candidates with appropriate backgrounds and expertise, within the Centre for Asian Legal Studies, Centre for Banking and Finance Law, Centre for Legal Theory and the EW Barker Centre for Law and Business. Successful applicants will commence their Fellowships at the start of August 2022 and conclude them at the end of July 2023.


📎 BENEFITS:
1. Fellows will be appointed to the full-time position of Post-Doctoral Fellow at NUS Law on a one-year contract (with the possibility of re-appointment up to a maximum term of 2 years, subject to re-application and consideration by the Faculty), and with a fixed remuneration of S$78,000.

2. Fellows will be reimbursed for a return economy class airfare (by the most economical and direct route) up to a maximum of S$2,000 to and from Singapore.

3. Fellows will be allocated a Faculty Research and Conference Fund allowance of S$3,000 to support attendance at academic conferences. Fellows attached to Research Centres will have a similar allowance, subject to the funding conditions required.

4. Fellows will be allocated shared office space at NUS Law or within the Centres.

5. Fellows may be given the opportunity to present their research in NUS Law’s Research Seminar Series or other seminars hosted by the named Centres.

🔸تیم شورای قانون اساسی سوریه متشکل از 45 نماینده از دولت سوریه، گروه های مخالف و انجمن های مردمیست و وظیفه آن تهیه پیش نویس قانون اساسی جدید سوریه برای برگزاری انتخابات تحت نظارت سازمان ملل متحد است.

❇️ ممنوعیت ذبح شرعی، مطابق قانون اساسی است.

✅ پس از سال های متمادی، دیوان قانون اساسی پادشاهی بلژیک احکام مصوب مناطق فلاندر و والونیا را که ذبح شرعی حیوانات را ممنوع کرده بود را مورد دادرسی اساسی قرار داد و ضمن تایید ممنوعیت این نوع از ذبح حیوانات، احکام صادره در این دو منطقه را مبنی در ممنوعیت ذبح شرعی را تایید کرد و مطابق قانون اساسی اعلام کرد.

✅ دیوان قانون اساسی، بالاترین مرجع قضایی در پادشاهی بلژیک است که به طور متمرکز به دادرسی قضایی امور مربوط به قانون اساسی می پردازد. مقررات اتحادیه اروپا به دولت‌های عضو اجازه می دهد ذبح مذهبی بدون بی حسی پیشین حیوانات را ممنوع نمایند.

✅ پیشتر مجالس منطقه‌ای بلژیک در فلاندر و والونی، ممنوعیت ذبح مذهبی را به تصویب رسانده بودند که عده ای از یهودیان این ممنوعیت را "یهودستیزانه" توصیف کردند و مصوبات آن نیز مورد اعتراض گروهی دیگر از یهودیان واقع شده بود. گروه دوم با توجه به دستورات شرعی مبنی بر ذبح مذهبی{kosher}(کوشر) این مصوبات را مورد اعتراض جهت دادرسی اساسی و مطابقت آنها با قانون اساسی قرار داده بودند و در دیوان استدلال کرده بودند که براساس حق‌آزادی مذهب (آزادی دین) نوعی حقوق بشر است که در دیوان اروپایی حقوق بشر نیز معافیت هایی را بر اساس دلایل مذهبی جهت کشتار بدون بی حسی حیوانات را در کشتارگاه‌های مجاز، مطابق آزادی مذهب و مجاز می شمرد.

✅ دیوان در حکم خود اعلام کرد که آزادی اندیشه، وجدان و دین یکی از پایه های یک جامعه دمکراتیک است و در رای خود نیز تصدیق کرده است که ممنوعیت ذبح بدون بیهوشی محدودیت بر آزادی مذهبی یهودیان و مسلمانان ایجاد می کند، اما این مسئله "پاسخ به نیازی فوری و اجتماعی است و متناسب با هدف مشروعی است که در پی ارتقای سلامت حیوانات است". علاوه بر این"امکان بی حسی برگشت پذیر در هنگام تشریفات ذبح شرعی را نمی توان به عنوان تجویز نحوه انجام یک مراسم مذهبی تفسیر کرد."

📎The program takes three years to complete and awards a Ph.D. degree to graduates.
