جهانی شدن حقوق و به زیر کشیدن لیبرال دمکراسی
1️⃣ قانون به عنوان یک رشته به سرعت در حال جهانی شدن است و بسیاری از وکلا، قضات و رهبران سیاسی درگیر یک فرآیند تطبیقی «اقتباس» هستند. اما این شکل جدید جهانی سازی حقوقی دارای جنبه های تاریکی است: زیرا اقتباس، فقط منبع الهام افرادی نیست که به دنبال تقویت و بهبود نهادها و سیاست های دمکراتیک هستند. این شکل از جهانی شدن و اقتباس اساسی به طور فزاینده ای الهام بخش و مشروعیت بخش برای کسانی است که به دنبال فرار از دمکراسی در خفا، تحت عنوان نوعی پوشش لیبرال دمکراتیک مصنوعی هستند.
2️⃣ کتاب اقتباس اساسی جهانی شدن حقوق و به زیر کشیدن لیبرال دمکراسی، این پدیده، چگونگی موفق شدن آن و آنچه را که می توانیم برای جلوگیری از نتایجش انجام دهیم را شرح میدهد.
3️⃣ این کتاب الگوهای فعلی بازسازی سنگرهای دمکراتیک را توضیح میدهد و به بررسی شیوههای مختلف استفاده ناصواب از اساسی گرایی میپردزاد؛ و انواع مختلف و فنآوریهایی که به مشروع سازی نقش ایدئولوژی که به حمایت از حالتها استفاده ناصواب از اساسی گرایی شرح میدهد.

♦️در اکتبر سال گذشته، آموزشگاه رِزوُرِکشِن در شهر لانسینگ میشیگان و دو تن از والدین شاگردان علیه ایالت میشیگان اقامه دعوا کردند و گفتند این ایالت با اجباری کردن ماسک صورت از قانون اساسی، قوانین ایالتی و ایدئولوژی کاتولیک تخطی کرده است.
♦️در ماه ژوئن امسال، گرچن ویتمر، فرماندار میشیگان، کلیه مقررات مرتبط با کووید-۱۹ از جمله اجبار به ماسک زدن را لغو کرد اما ادعای شاکیان که کارشناسان حقوقی میگویند به اثبات صداقت آموزشگاه مذکور در «اعمال اعتقادات مذهبیاش» بستگی دارد، همچنان دردادگاه شنیده خواهد شد.

بنا بر نظر دادگاههای بریتانیا، نظارت مخفیانه بر ارتباطات از راه دور، مغایر قوانین اتحادیه اروپا است. سازمان حریم خصوصی بین المللی موسوم به PI، با به چالش کشیدن رژیم حقوقی حاکم بر ارتباطات در بریتانیا، به بخش 94 از قانون ارتباطات از راه دور استناد می کند که با معیارهای حقوق بشری قوانین اتحادیه اروپا در مغایرت است. بر این اساس، تمامی اطلاعات و داده های گردآوری شده از سوی آژانس های امنیتی بریتانیا غیر قانونی قلمداد می شود. این رویکرد، درست بعد از رای دادگاه اروپایی حقوق بشر در سال 2020 اظهار شده است که مطابق آن جمع آوری و نگهداری داده ها از سوی بریتانیا در راستای تامین امنیت ملی باید تابع قوانین اتحادیه اروپا باشد.

📎 Registration for the Nuremberg Forum 2021 is now open. The forum will take place online on October 15 and 16.
The conference will examine the Nuremberg Principles today and reflect on the legal framework and systems established after WWII to tackle impunity, while critically analyzing whether this framework or system, or the fights against impunity in general, are living up to the Nuremberg Principles.
