✅ The fourth conference in the “Modern Studies in the Law of Trusts and Wealth Management” series will take place virtually via Zoom on 22-23 July 2021. The daily conference proceedings will take place between: 8 am and 1 pm (UK time); 5 pm and 10 pm (Melbourne/Sydney time); 3 pm and 8 pm (Singapore time). The 2021 conference will be co-organised by the Centre for Commercial Law in Asia Singapore Management University, the University of York, and the Asian Law Centre Melbourne Law School.

✅ دیوان قانون اساسی:

✔️ تاسیس و ادامه کار دفتر تحقیقات فساد مقامات عالی رتبه نظام مطابق قانون اساسی است.

❇️ دیوان قانون اساسی جمهوری کره در دادرسی اساسی خود نسبت به مطابقت تاسیس دفتر تحقیقات فساد مقامات عالی رتبه نظام با قانون اساسی، آن را مطابق اساسی اعلام کرد.

✅ دیوان عالی:

✔️ حکم ۲۰ سال حبس، رئیس کشور پیشین این کشور که از طریق استیضاح برکنار شده بود و به اتهام فساد مالی و سوء استفاده از قدرت از سوی دادگاه به ۳۰ سال زندان محکوم شده بود، تایید گردید. #ریاست_کشور #رئیس_کشور #ریاست_دولت #رئیس_دولت

✅ دیوان عالی همچنین احکام جریمه مالی و جبران خسارت، در مجموع به مبلغ ۱۶ میلیون یورو را که در دادگاه بدوی برای او تعیین شده بود، تایید کرد.

خانم پارک گئون های، یازدهمین رئیس جمهوری کره جنوبی و اولین زن که در کره به این مقام رسید، در مارس سال ۲۰۱۷ با رای استیضاح مجلس از قدرت برکنار و سپس به اتهام فساد مالی محاکمه شد. خانم پارک که بارها این اتهامات را رد و شیوۀ دادرسی به اتهاماتش را مغرضانه توصیف کرده بود، در جلسه دادگاه حاضر نشد. او همچنین به دلیل نقض قوانین انتخاباتی به دو سال زندان محکوم شد. به این ترتیب 68 ساله باید مدت ۲۲ سال را در زندان سپری کند.

📍 نظام اساسی جمهوری کره، عالی ترین مقام کشور را رئیس جمهور( رئیس کشور) قرار داده، وی همزمان رئیس دولت نیز هست. در این نظام، یک مجلس سیصد نفره به قانون‌گذاری می پردازد که اختیار استیضاح و برکناری رئیس کشور را دارد. در نظام قضایی، دیوان قانون اساسی به دادرسی اساسی می پردازد و همزمان دیوان عالی نیز دارای صلاحیت اختصاصی مربوط به خود است. #قوای_مستقل #قوه_قضائیه #استقلال_قضا

✅ The Law Department of HEC Paris invites applications for a tenure-track faculty position (assistant professor) starting with 1st September 2021. The successful candidate is expected to undertake research that combines law, IA and data analytics. This includes research around Regulation of IA, Smart Law, Blockchain, Smart Contracts, Predictive Justice, LegalTech, Ethics of IA, Privacy and Data for Good. The resulting research is expected to lead to publications in top peer-review law journals. The applicant is also expected to be an excellent teacher.

❇️ CANDIDATE PROFILE:

🔰 سلطان عمان، هیثم بن طارق، با صدور حکم حکومتی، برای نخستین بار در تاریخ سلطنت عمان، آیین انتصاب جانشین ریاست کشور را تعیین کرد. مطابق این فرمان، «اختیار قدرت از سلطان به بزرگترین پسرش، و سپس به بزرگترین پسر این پسر منتقل خواهد شد.»

✅ قانون اساسی #سلطنت_عمان مصوب 1996 است که پیشتر در 2011 بازنگری شده است. این قانون اساسی #بدون_مقدمه است و در اصل یکم تصریح می کند: «سلطان نشین عمان یک کشور عربی، اسلامی، مستقل با حاکمیت کامل و مسقط پایتخت آن است.» مطابق قانون اساسی در عمان، ریاست کشور را بر عهده سلطان قرار داده شده و در اصل پنجم تاکید گردیده که #سلطنت امری موروثی است. اصل دوم: «دین دولت اسلام است و شرع اسلامی اساس قانونگذاری است.»

❇️ رئیس کشور و عالی‌ترین مقام رسمی کشور عمان با عنوان #سلطان، در حال حاضر هیثم بن طارق آل سعید نام دارد. وی پس از درگذشت پسرعمویش سلطان قابوس به این مقام رسیده است.
