✅ در اول اکتبر 1920[نهم مهر 1299]، #مجلس_ملی_موسسان اتریش مصوبه قانون اساسی فدرال را تصویب کرد که از 10 نوامبر همان سال [18 مهر 1299] لازم الاجرا شد. این زمان تقریباً دو سال پس از تاسیس #جمهوری_اول اتریش است.

❇️ بسیاری در ابتدا انتظار داشتند که قانون اساسی فدرال اتریش یک قانون اساسی انتقالی باشد، اما به مدت 100 سال (به جز در دوره‌های فاشیسم اتریش و سوسیالیسم ملی از سالهای 1934 تا 1945 که به‌طور غیرقانونی کنار گذاشته شد) همچنان در حال اجرا است. با وجود اینکه این قانون دارای برخی از ویژگی‌های غربی است اما از آنجا که تاریخ آن قدیمی تر از این سنت است، در نتیجه به قاره اروپا تعلق دارد، ویژگی‌های مهم متمایز کننده آن عبارتند از:

📍 نخست، قانون اساسی فدرال پس از بازنشر در سال 1930 تا کنون، 128 مرتبه اصلاح شده است که بسیار بیش از آن است که هر قانون اساسی می‌تواند ادعا کند.

📍 دوم، قانون اساسی فدرال خود تنها یکی از حدود 500 بخش قانون اساسی است که قانون اساسی فدرال اتریش به طور کلی از آن تشکیل شده است.

📍 سوم،‌ قانون اساسی فدرال، بدنه اصلی قانون اساسی را تشکیل می‌دهد، اما مصوبات قانون اساسی، مقررات واحد قانون اساسی در قوانین عادی، معاهدات بین المللی آورده شده در قانون اساسی داخلی (مانند کنوانسیون اروپایی حقوق بشر)، قوانینی که قبل از سال 1920 تصویب شده‌اند،‌ که قدمت آنها تا سال 1862 بازمی‌گردد و حتی توافق نامه های بین دولتی بین فدراسیون و نه قلمرویی که دارای وضعیت #قانون_اساسی هستند.

✅ در چند روز گذشته دو کشور، جمهوری پرتغال و پادشاهی تایلند وضعیت اضطراری اعلام کردند اما دلیل هرکدام متفاوت بوده است. #جمهوری_پرتغال به دلیل شمار بالای مبتلایان به بیماری کووید۱۹ اعلام وضعیت اضطراری کرد. مقررات خاص مربوط به این وضعیت از روز ۲۴ مهر به مدت ۱۵ روز اعمال خواهد شد. اعلام این وضعیت به دولت اجازه می‌دهد که محدودیت‌های بیشتری در مورد رفت ‌و آمدهای عمومی وضع کند و مقررات شدیدتری در سایر عرصه‌ها به اجرا بگذارد. از جمله گردهمایی بیش از ۵ نفر در مکان‌های عمومی ممنوع خواهد بود.

❇️ #پادشاهی_تایلند اما برای مقابله با تجمعات دمکراسی‌ خواهی و ضد سلطنتی، وضعیت اضطراری اعلام کرد. این فرمان علاوه بر محدود کردن اجتماعات به چهار نفر محدودیت‌هایی را برای رسانه‌ها ایجاد می کند. انتشار اخباری "که می‌تواند ترس ایجاد کند یا اطلاعات را عمداً تحریف کند یا سوء تفاهمی ایجاد کند که بر امنیت ملی یا صلح و نظم تأثیر می‌گذارد" ممنوع است. همچنین به مقامات اجازه می‌دهد تا هر منطقه را برای عموم مردم محدود کنند.

✅ دیوان عالی جمهوری کلمبیا در حکمی با دفاع از حق همه مردم در اعتراض و تظاهرات، وظیفه مقامات را "جلوگیری، ممانعت و مجازات مداخله نظام‌مند، خشونت خودسرانه نیروی انتظامی در تظاهرات و اعتراضات" دانست. در ادامه دیوان، به وزیر دفاع 48 ساعت مهلت داد تا از اقدام خود در نوامبر سال گذشته عذرخواهی کند.

❇️ این پرونده در پی شکایت گروهی از شهروندان، سازمانهای اجتماعی، مدافعان حقوق بشر، دانشجویان، روزنامه نگاران، اساتید دانشگاه، بستگان قربانیان و قربانیان خشونت نیروی انتظامی در دیوان عالی کلمبیا مطرح شده بود.

❇️ The Transnational Legal Theory Journal is publishing a special issue of articles on transnational legal feminism. They invite you to submit an abstract (due 15 December 2020) for consideration for the journal. Selected authors will be invited to submit papers (subject to peer review) that will be published in the Transnational Legal Theory Journal and presented in a virtual conference to be held on March 25th and 26th, 2021 in collaboration with the London South Bank University and the Cornell Law School.

YOUR ROLE: The applicant is able to represent intellectual property law in various contexts, not only but in particular in the context of technical and IT innovation, and is able to participate in the international discussion regarding the intersection of IP law with antitrust and other legal domains.
