❇️ The Law Department of the European University Institute (EUI) is delighted to share this call for papers for a two-day Doctoral Forum on International Law which will be held at the Department of Law, Villa Salviati, Florence, on 23 – 24 November 2020 with the support of the European Society of International Law.

❇️ International lawyers entering the field today are met with challenges such as the rise of populism, growing economic inequality, climate change, and unraveling global cooperation. In addressing these challenges, the situation of international lawyers⎯e.g. their race, gender, or position in the field⎯and its influence on how they think and address these challenges has been seldom considered overtly. Building on this reflexive attitude, long productively discussed in the social sciences, this Forum invites contributors to explore practising reflexivity in their own work and in the field of international law.

❇️ The practice of reflexivity takes the international lawyer as an object of research, examining their situation and how it influences what they do or think, and it can also extend to an examination of the field itself and the scholarly endeavour. In particular, this Forum seeks to investigate how the practice of reflexivity could uncover disciplinary routines and create possibilities for new or alternative interventions in response to the field’s most pressing challenges.

Abstracts of around 500 words should be sent together with a CV to DFIL@eui.eu on 13 September 2020. Selected presenters will be notified via email by the end of September.

The authors of selected papers will be required to submit an extended abstract/paper of at least 2,500 words by 15 November 2020. An eventual volume on the theme of the Forum may be considered.

the historical influence of pay inequalities;

the regulation of work and care relationships;
family allowances, taxation and pensions;
the use of AI; and
related topics (in consultation with the organisers).
The deadline for abstracts (up to 200 words) is 30 September 2020.

🔶 سه سال زندان در مصر؛ مجازات دختری که در تیک‌تاک رقصید

منار سماع، دختر مصری در خانه با یک ترانه مشهور می‌رقصد. رژ لب قرمز زده و موهای بلند و تیره‌اش را روی تی‌شرتی رها کرده که شکم‌اش را نمی‌پوشاند. او با موبایل از حرکات خودش فیلم می‌گیرد و در اینترنت منتشر می‌کند. فیلم با استقبال خوبی روبرو می‌شود و در پورتال ویدئویی "تیک تاک" هزاران مرتبه لایک می‌خورد.

البته همه کسانی که فیلم را می‌بینند، نظر مساعدی به آن ندارند. از جمله آقای اشرف فرهت، وکیل دادگستری که حرکات منار را "قبیح" می‌داند و گزارش آن را به مقامات می‌دهد. کمی بعد دادستانی قاهره حکم بازداشت دختر جوان را به اتهام "وهن جامعه مصر" و "نقض عفت عمومی" صادر می‌کند.

منار قبلا مهماندار هواپیما بوده و بعد از ورود به عرصه مدلینگ، به چهره‌ای مطرح و تاثیرگذار در شبکه‌های اجتماعی مبدل شده است. مادرش زنی دین‌دار و سنتی است، اما منار همیشه به او اطمینان داده که عکس یا فیلمی پست نمی‌کند که به عزت خانواده لطمه بزند.

در هنجارهای غربی، رقص و رفتار منار، می‌تواند کاری بی‌ضرر، بامزه یا حتی الکی باشد، اما اشرف فرهت می‌‌گوید یک دختر مصری حق ندارد "حرکات شنیع" انجام دهد: «نجابت یک دختر تنها به باکرگی نیست، بلکه دختر باید شرم و حیا داشته باشد. بی‌ناموسی است که دختر تن و بدن خودش را به دیگران نشان دهد.»

دادگاه هم با تبعیت از همین گزاره، برای منار سه سال حبس بریده است.

💢آیا در صورت به تعویق افتادن انتخابات آمریکا بایدن رئیس جمهوری می‌شود؟

دونالد ترامپ، رئیس جمهوری آمریکا تمایل خود را برای به تعویق انداختن انتخابات ریاست جمهوری پیش رو اعلام کرده و به جز پیش‌بینی گسترش کرونا، برخی از تحلیل‌گران یکی از انگیزه‌های او از این کار را شگرد تبلیغاتی برای خودش دانسته‌اند.

تمایل ترامپ که به تازگی در توییتی از آن پرده برداشت، هر دلیلی که داشته باشد نمی‌تواند به دست خود او عملی شود، زیرا بر مبنای قانون اساسی آمریکا، صلاحیت به تعویق انداختن انتخابات در شرایط بسیار ویژه در دست کنگره است و رئیس جمهوری چنین صلاحیتی ندارد. اما اگر به هر دلیل انتخابات ریاست جمهوری آمریکا که قرار است در ۳ نوامبر (۱۳ آبان) برگزار شود، به تعویق بیفتد، باید جانشینی برای ترامپ معرفی شود. در شرایط بسیار خاصی این فرد می‌تواند جو بایدن، رقیب ترامپ از حزب دموکرات باشد. چگونه؟

✔️ Federalism, Identity and Public Policy in Challenging Times: The Baxter Family Competition on Federalism 2020-2021

❇️ For this edition, participants are invited to submit an original essay related to Federalism, Identity and Public Policy in Challenging Times, by 1 February 2021.

❇️ This broad theme should allow for reflections about the impact of federalism on the current COVID-19 crisis – and vice versa –, without being limited to this context. Comparative perspectives are particularly encouraged.

❇️ Made possible through the generous support of Rachel Baxter (BSc’84, BCL’88) and Colin Baxter (BCL’90, LLB’90), the Baxter Family Competition on Federalism seeks to promote informed debate on federalism by students and young professionals from around the world. For the first time in 2021, the Competition will be open to law and political science students/PhD candidates, junior scholars and practitioners who graduated in these disciplines.

❇️ The three winners will have the unique opportunity to present their papers at a Symposium in May 2021 in Montreal (circumstances allowing). First-, second- and third-place winners will receive prizes of $5,000, $3,000, and $1,000 (CAD) respectively.

✔️ میانگین آزادی های فردی در کشورهای اسلامی

✅ نتیجه تحقیق درباره وضعیت آزادی های فردی در ۴۰ کشور اسلامی نشان می دهد که آزادی شهروندان در چهار کشور اسلامی بوسنی و هرزگوین، جمهوری آلبانی، بورکینافاسو و جمهوری قرقیز از میانگین جهانی بیشتر است. در پژوهشی که موسسه کیتو منتشر کرده است از داده های شاخص آزادی بشر در سال ۲۰۱۹ استفاده شده است.

❇️ در این پژوهش سطح آزادی های فردی در کشورهای اسلامی براساس معیارهای مختلف از جمله:

1) #آزادی_های_مذهبی
2) #آزادی_بیان
3) #آزادی_تجمع
4) #آزادی_زنان

❇️ از صفر تا ۱۰ سنجیده شده است و رقم صفر به معنای کمترین سطح آزادی و ۱۰ به معنای بیشترین میزان آزادی فردی است. در رتبه بندی سطح آزادی های فردی در کشورهای اسلامی از ۵۱ کشور #اسلامی تنها ۴۰ کشور رده بنده شده اند زیرا از ۱۱ کشور داده های کافی در دست نبوده است. جمهوری اسلامی ایران در میان این ۴۰ کشور از نظر سطح آزادی های فردی با نمره ۴.۴۸ جایگاه سی و چهارم را به دست آورده و به این ترتیب تنها شش کشور پادشاهی عربستان سعودی، جمهوری سودان، جمهوری عربی مصر، جمهوری عراق، جمهوری یمن و جمهوری عربی سوریه از نظر میزان آزادی های فردی وضعیتی پایین تر از جمهوری ایران دارند.

❇️ شماری از کشورهای همسایه یا مجاور ایران در منطقه از جمله دولت کویت، #پادشاهی_بحرین، #جمهوری_ترکیه، #جمهوری_تاجیکستان، #جمهوری_اسلامی_پاکستان، #دولت_قطر و #امارات_عربی_متحده در جایگاه‌های بالاتر از ایران قرار گرفته اند.

❇️ از سوی دیگر ایران در فهرست کشورهای اسلامی از نظر میزان آزادی مذهبی در جایگاه سی و سوم قرار گرفته است. از نظر سطح آزادی بیان ایران کمی وضعیت بهتری در فهرست دارد و در جایگاه سی ام قرار دارد. ایران از نظر آزادی تجمع نیز در جایگاه سی ام قرار گرفته است. اما موقعیت ایران در فهرست کشورهای اسلامی از نظر سطح آزادی زنان با قرار گرفتن در جایگاه سی و چهارم تنها از شش کشور دیگر بهتر است. ایران در میان کشورهای اسلامی از نظر آزادی اقتصادی نیز در جایگاه سی و دوم قرار دارد.

❇️ اما بهترین رتبه ای که #جمهوری_اسلامی_ایران در این تحقیق به دست آورده است به «رعایت حکومت قانون» بر می گردد. جایگاه ایران در فهرست کشورهای اسلامی از این نظر هفدهم است.

❇️ در حالی که بوسنی و هرزگوین از نظر آزادی های فردی با کسب نمره ۸.۰۴ در جایگاه اول کشورهای اسلامی قرار دارد سوریه با نمره ۲.۵۳ کمترین نمره را در میان این کشورها کسب کرده است. بررسی های این موسسه نشان می دهد که آزادی های فردی در کشورهای اسلامی از دیگر کشورهای جهان محدودتر است و این نوع آزادی ها تنها در چهار کشور بوسنی و هرزگوین، جمهوری آلبانی، بورکینافاسو و جمهوری قرقیز از میانگین جهانی بیشتر است.

📍Kuşkonar massacre

The Kuskonar massacre, a.k.a. the Kuskonar and Kocagılı massacre (Turkish: Kuşkonar Katliamı, Kurdish: Komkujiya Kuşkonar‎) is the name given to the 26 March 1994 event in which 38 Kurdish villagers were killed and the villages of Koçağılı and Kuşkonar near the province of Şırnak were destroyed as a result of the Turkish Armed Forces' heavy bombardment.The families of victims who appealed to the Turkish court weren't convinced from the court decision that the PKK was responsible for the massacre.

❇️ The government bombed and killed residents of villages who refused to join the government forces. The government spread pictures of dead children in newspapers and blamed the PKK. Turkey was condemned for carrying out the massacre of Kurdish civilians in the ECHR.
