📍Scotiabank Postdoctoral Fellowship, AI and Regulation

❇️ Fellowship Description
We are seeking a skilled and enthusiastic #Postdoctoral Fellow to pursue an innovative research program focused on shaping the regulation of Artificial Intelligence (AI) in a global context.

The successful candidate will be supervised throughout the postdoctoral fellowship by leading technology law, ethics and policy scholars at the University of Ottawa AI + Society Initiative, notably Dr Michael Geist, Dr Florian Martin-Bariteau and Dr Teresa Scassa.

Emerging artificial intelligence tools are constantly complicating previously straightforward areas of domestic and international policy, and call for comparative studies.

Applicants are encouraged to propose creative ideas for a postdoctoral fellowship, emphasizing how they plan to contribute to new knowledge within the domain of the regulation of AI and automation.

✅ Regulating AI and Ethics: The research would look at different initiatives to regulate AI and incorporate human rights and ethical values in the development of AI, notably beyond the usual black letter law, such as rules of professional conduct, norms and standards.
Data Governance and AI: The research will look at current practices and legal frameworks regarding data governance for data sharing and AI development, study use cases to derive insights, propose principles and frameworks, and recommendations for law and policy reform at the provincial and federal levels.
Copyright and AI: The research would look at the social, economic and cultural implications at the intersection of copyright and artificial intelligence, and explore policy avenues (barriers to AI innovation; AI and creativity; and bias concerns that arise from the reliance on “low risk” data sets for machine learning purposes.

❇️ The postdoctoral fellowship will result in a better understanding of the current AI context and challenges. Research outputs (e.g. policy recommendations and framework proposals) will be disseminated through a series of publications, white papers and other knowledge mobilization activities. The postdoctoral fellowship will focus on research dissemination and knowledge translation both within and outside the academy, and with public and private sector actors.

❇️ The successful candidate will be registered as a postdoctoral fellow at the University of Ottawa and will enjoy all associated privileges. This individual will have a strong background in law and, in addition, it would be helpful but not necessary to have training in ethics and/or policy.

🏛️دادگاه لاهه در پرونده محاصره هوایی قطر، به نفع این کشور رأی داد

 دیوان بین‌المللی دادگستری در شهر لاهه (دادگاه لاهه) هلند به اتفاق آرا، دفاعیه چهار کشور تحریم‌کننده قطر را رد کرد.

شورای مذکور ژوئیه ۲۰۱۸ با درخواست تجدیدنظر چهار کشور عربستان سعودی، بحرین، امارات و مصر مبنی بر عدم صلاحیت رسیدگی ایکائو به شکایت قطر از چهار کشور مذکور، به دلیل آثار منفی و خسارت‌های به وجود آمده در زمینه پرواز‌ها، امنیت ملی و امنیت هوایی قطر، مخالفت کرده بود.

کشورهای یاد شده بعد از این تصمیم شورای ایکائو، همزمان خواستار تجدیدنظر در تصمیم مذکور آن هم در دیوان بین‌المللی دادگستری شدند و این دیوان امروز با این درخواست آن‌ها مخالفت کرد.

قطری‌ها رأِی امروز دیوان لاهه به نفع خودشان را «پیروزی دیگری» در برابر محور سعودی دانستند.

به گزارش الجزیره، دفتر ارتباطات دولتی قطر در واکنش به رأی دیوان لاهه، گفت که این رأی کشورهای تحریم کننده را در عرصه بین‌المللی مجبور به پاسخگویی خواهد کرد.

روابط چهار کشور عربی مذکور از خرداد ۹۶ (۲۰۱۷) با قطر به دنبال اتهام آن‌ها علیه این کشور مبنی بر حمایت دوحه از تروریسم تا به امروز قطع بوده و مصر، عربستان سعودی و امارات و بحرین ضمن بستن حریم هوایی خود بر روی قطر، این کشور را محاصره و تحریم کردند. قطر برای عبور از این تحریم‌ها، از حریم هوایی ایران استفاده کرد.

به دنبال این تنش در خلیج فارس که تا انحلال شورای همکاری خلیج فارس نیز پیش رفت، قطر همان سال ۲۰۱۷ دو شکوائیه در شورای ایکائو علیه کشورهای تحریم کننده آماده و ارائه کرد؛ شکایت نخست بر اساس ماده ۸۴ توافق هواپیمایی بین‌المللی سال ۱۹۴۴ موسوم به توافق شیکاگو بود و شکایت دوم به موجب بند دوم ماده ۲ توافق بین‌المللی خدمات عبور و مرور هوایی ۱۹۴۴ بود.

در این دو شکوائیه قطر، جزئیات اقدامات چهار کشور را که نقض توافقین به شمار می‌رفت به شورای ایکائو اراه کرد و از این سازمان خواست در این قضیه رأی صادر کرده و اقدامات آن‌ها را غیر قانونی دانسته و مجبور به پرداخت غرامت کند.

چهار کشور عربستان سعودی، بحرین، امارات و مصر بعد از قطع روابط خود با قطر اعلام کردند، تا زمانی که دوحه شروط سیزده‌گانه آن‌ها را که یکی از آن‌ها بستن شبکه پربیننده الجزیره بود، نپذیرد، به قطع روابط خود با قطر ادامه خواهند داد. بحران قطر به رغم تلاش‌ها برای پایان دادن به آن، همچنان پابرجاست و دوحه گفته که تن دادن به این شروط، استقلالیت قطر را از بین میبرد.

🔶 مجارستان باید تغییر جنسیت مهاجران را به‌رسمیت بشناسد

در پی شکایت یک مرد ترانس ایرانی‌تبار از دولت مجارستان، دیوان حقوق بشر اروپا دولت این کشور را موظف کرد، تغییر جنسیت مهاجران و پناهندگان را در شناسنامه آنها ثبت کند.

دیوان حقوق بشر اروپا (ECHR) روز جمعه، ۲۷ تیر (۱۷ ژوئیه) دولت مجارستان را به دلیل سر باز زدن از ثبت تغییرجنسیت شهروندی در مدارکش محکوم کرد.

ارگان قضایی اروپایی معتقد است که دولت مجارستان حقوق اساسی مرد ترانس ایرانی‌تبار را نقض کرده است.

بر اساس حکم دیوان، مجارستان باید به شاکی شش هزار و ۵۰۰ یورو خسارت بپردازد و هزینه دادگاه را نیز بپذیرد.

طبق مدارکی که به دادگاه ارائه شده، او در سال ۱۹۸۷ به عنوان زن در ایران به دنیا آمده و در سال ۲۰۱۵ به دلیل خطر آزار و اذیت ناشی از تراجنسی از ایران گریخته و در مجارستان پناهندگی گرفته است.

🔶 حکم دادگاه قانون اساسی آلمان: دولت در دسترسی به داده‌های شهروندان آزاد نیست

دادگاه قانون اساسی آلمان رأی داده است که مسئولان اجازه ندارند با دستاویز مقابله با بزهکاری یا پیکار با تروریسم، به داده‌های سایبری شهروندان در اینترنت و تلفن هوشمند به طور نامحدود دسترس داشته باشند.

قانون به دستگاه امنیتی اجازه داده است که در تحقیقات مرتبط با فعالیت‌های تبهکارانه و عملیات تروریستی به داده‌های شخصی افراد دسترسی داشته باشند. دادگاه قانون اساسی اکنون می‌گوید دسترسی به داده‌های شخصی شهروندان باید محدود باشد.

قاضیان دادگاه قانون اساسی در کارلسروه گفته‌اند: دسترسی نامحدود مأموران پلیس و دستگاه امنیتی به داده‌های شخصی شهروندان خلاف قانون است؛ زیرا حقوق اساسی آنها را مبنی بر مصونیت اطلاعاتی و حفظ رازهای ارتباطی در استفاده از تلفن و اینترنت، پایمال می‌کند.

تاکنون پلیس، اداره جنایی فدرال و دستگاه خدمات اطلاعاتی آلمان حق داشتند از شرکت‌های تلفنی و اینترنتی برخی از اطلاعات اولیه مانند نام، نشانی، تاریخ تولد و همچنین آدرس IP رایانه آنها را دریافت کنند.

✅ گرجستان لایحه اصلاح قانون اساسی راجع به مقررات نظام انتخاباتی را به تصویب رساند. سالومه زورابیویشویلی رئیس جمهور و رئیس کشور گرجستان، نیز قانون اصلاح نظام انتخاباتی را امضا کرده است. در نتیجه تصویب و اجرایی شدن این قانون، انتخابات مجلس آینده طبق مقررات جدید برگزار می شود.

❇️ مجلس گرجستان لایحه اصلاحات قانون اساسی را برای تغییر نسبت قانونگذاران قابل انتخاب از طریق یک سیستم متناسب و رأی اکثریت از 77-73 به ترتیب به 120 تا 30 تغییر تصویب کرد.

Georgian President Salome Zourabichvili said she had signed the legislation on introducing constitutional amendments that will see the upcoming parliamentary election held under new rules. Earlier, the Georgian parliament adopted a bill on constitutional amendments to change the ratio of lawmakers electable via a proportional system and a majoritarian vote from 77-73, respectively, to 120-30.
