ጥያቄ❓
የአንድ ፕሮጀክት Defect Liability period (365 ቀናት) ተጠናቆ ሲያበቃ Retention እንድንከፍል ስንጠየቅ የተፈጠረው Structural Defect ከተያዘው ገንዘብ በላይ ቢሆን ምን እናደርጋለን?

#መልስ-

በconstruction contract administration ውስጥ በጥንቃቄ መያዝ ያለበት ጉዳይ ነው። Defect Liability Period (DLP) 365 ቀን መጠናቀቁ ብቻ ማለት የStructural Defect ኃላፊነት በራሱ ያበቃል ማለት አይደለም።

በተለይ Structural Defect ከRetention ገንዘብ በላይ ከሆነ፦

1. Retention በቀጥታ አትክፈሉ። መጀመሪያ defect-ው በቴክኒክ እንዲረጋገጥ ያድርጉ።

2. Structural assessment/investigation በብቃት ባለው Structural Engineer/consultant ያስደርጉ። የdefect-ው መንስኤ፣ ክብደት፣ የመጠገኛ ወጪና የህንፃው ደህንነት ይረጋገጥ።

3. Contractor በcontract መሠረት እንዲያስተካክል በጽሑፍ ይጠየቅ። ችግሩ በContractor's defective workmanship/material/design ምክንያት ከሆነ፣ የመጠገን ኃላፊነቱ በRetention መጠን ብቻ አይወሰንም።

4. Retention ከጠየቀው ገንዘብ በላይ የሚያስፈልግ የrepair cost ካለ፣ በcontract ውስጥ ያሉ ሌሎች security/remedy provisions መሠረት ይመርመሩ። ለምሳሌ Performance Security አሁንም ተፈጻሚ ከሆነ ሊጠቀሙበት ይችላሉ።

5. ተጨማሪው ወጪ ከContractor እንዲመለስ የሚያስችለው የcontract clause ካለ መሠረቱን በግልጽ ይያዙ። Retention ብቻ እንደ “maximum liability” መቆጠር አይገባም፣ ይህ ግን በተፈረመው contract ቃላት ይወሰናል።

6. ክፍያ ለመልቀቅ ከመወሰን በፊት የFinal/Completion Certificate፣ defect notification፣ inspection report፣ structural assessment፣ repair estimate እና contract clauses አንድ ላይ ይመርመሩ።
በተለይ የሚለየው
DLP = 365 days ማለት በዚያ ጊዜ ውስጥ የታዩ defects እንዲታረሙ የContractor's contractual obligation የሚታይበት ጊዜ ነው። ነገር ግን ከ365ኛው ቀን በኋላ የተገኘ Structural Defect ላይ ኃላፊነት አለ/የለም የሚለው በContract Particular Conditions, GCC/PCC, applicable law እና defect-ው በመጀመሪያ መነሻው ላይ ይወሰናል።

ስለዚህ በጉዳዩ ላይ “365 ቀን አልቋል፣ Retention ክፈሉ” ብሎ ብቻ መወሰን ትክክል አይሆንም። Structural defect-ው በcontractor ኃላፊነት ውስጥ መሆኑ ከተረጋገጠ በመጀመሪያ የrepair/remedy ጉዳዩ መፍትሄ ማግኘት አለበት።

The Peak annual turnover for Water Supply System and Toilet renovation: -
The Bidder shall submit audited financial statements for the last 4 (Four) years (From January 2022 up to bid submission date) demonstrating a minimum Average Annual Revenue of ETB 20,000,000.00 Birr; calculated as total received for contracts in progress and/or completed within the last Five years divided by 5years and the report must be done by Chartered Certified Auditor
