Right to Walk on Footpaths
The Supreme Court has held that the Right to Walk on safe, demarcated footpaths is a Fundamental Right under Article 21, read with Articles 19(1)(a), 19(1)(b), 19(1)(c) and 19(1)(d), and pedestrians have priority over motorised vehicles.
More Facts:
The Court directed governments to ensure construction, demarcation and maintenance of footpaths wherever roads exist.
Violation of this right can entitle citizens to constitutional remedies, compensation and restitution.
The judgment arose from a motor accident compensation case but expanded into a landmark ruling on pedestrian rights
