👉The UCC was passed in the Uttarakhand Assembly. It proposes a common law on marriage, divorce, land, property, & inheritance for all, irrespective of their religion in the state, excluding the Scheduled Tribes.
👉👉WHAT WILL BE UNIFORM ACROSS ALL RELIGIONS?👈👈
• Equal property rights to the spouse & children (both sons & daughters). Additionally, equal rights extend to the deceased person's parents.
• Legal age of marriage for Men (21) & Women (18).
• Children adopted, born through surrogacy or born through assisted reproductive technology, & illegitimate children will have equal rights as other legitimate children.
👉👉WHAT IS NOT ALLOWED?👈👈
❌ Halala, Iddat & Triple talaq under Muslim personal laws
❌ Polygamy & Child Marriage
❌ Marriages cannot be performed under prohibited degrees of relationships, which covers immediate family of the father, mother, grandfather & grandmother.
👉👉LAWS FOR LIVE-IN RELATIONSHIP👈👈
• All live-in relationships must be registered within a month & the couples must also register the end of their relationship with a termination statement.
• Neither party can be under 18 & if one or both parties are under 21, their parents or guardians will be informed about their child's decision to enter a live-in relationship.
• Children born to live-in partners will be considered legitimate & receive inheritance rights. Women are entitled to maintenance if deserted in such relation.
👉👉FINES & PENALTIES👈👈
• Both the parties can face up to 3 months jail or fine of 10,000 if Live-in relation is not registered. Providing false information for the same will invite up to ₹25,000 or 3 months jail.
• UCC mandates registration of marriage within 60 days, failing which will attract a fine up to 20,000.
