🎙️ Shaykh Hassan Ba Shu'ayb, may Allah preserve him and grant him a long life upon His obedience.

🍂🍃 Should the people being led in prayer say Ameen during the Qunoot of Witr?🍃🍂

[Q] Is (saying) “Ameen” recommended for those being led in prayer during the Qunoot of Witr?

[A] Yes, it’s recommended for the congregation to say Ameen, and if a person does so, then it is like they supplicated as how the Imām did. And if they don’t say Ameen, then it is like they confided only to the supplication of the Imām. But if a person was to say Ameen, then it’s as if the Imām supplicated and the person themselves also supplicated. That’s because the meaning of Ameen is “O Allah, accept”. Accept this supplication of which the Imām has supplicated. Thus, every supplication a person hears, they should say Ameen to it.

And since Al-Fatiha ends with supplication, then saying this word is Sunnah after the Imām says: “Walaadth tha Leen”. This word is a Sunnah for the Imām to say, and the congregation, likewise the Angels also say it. The Prophet ﷺ said: “If the Imām says Walaadth thaa Leen”, then say Ameen, for verily whoever’s Ameen coincides with the Ameen of the Angels, their sins of what occurred previously get forgiven”.

In fact, the word Ameen is prescribed to say after the recitation of Al-Fatiha comprehensively as what’s composed in the books of Fiqh. The person praying alone says Ameen, and the Imām leading the prayer says Ameen, and those being led in prayer say Ameen. Rather, those being led in prayer say the Ameen twice in the audible prayers of the first and second Rakah. They say Ameen after the recitation of Al-Fatiha by the Imām, then they are required to also recite Al-Fatiha themselves and say Ameen after it. They recite Al-Fatiha themselves seeing as it’s a pillar of which the prayer is invalid without it, then they say Ameen. Therefore, if the Imām supplicates and makes audible the supplications during the Qunoot Nāzila or the Qunoot of Witr, the congregation say Ameen with him or after him.

📩🔹Question:

What's your statement about the ruling of covering the face for the Muhrim?

📩🔸Answer:

That which the majority of the people of knowledge are upon is the permissibility of covering the face for the Muhrim, and the Hadith;

(وَلَا تُخَمِّرُوا رَأْسَهُ، وَلَا وَجهه)

“Do not cover his head nor his face.”

The addition (his face) is an irregular addition and Allaah knows best.

So upon this there's no harm from wearing the face mask.

It’s not accepted, due to the statement of the Most High:

وَلَوْ أَشْرَكُوا لَحَبِطَ عَنْهُم مَّا كَانُوا يَعْمَلُونَ
But if they had joined in worship others with Allah, all that they used to do would have been of no benefit to them.

📩🔹Question:

I’m a sister that’s began adhering to the religion recently. My husband doesn’t adhere, and sometimes he fears my adherence to the religion may be excessive in his eyes. He doesn’t prevent me from the religion, but he doesn’t always agree with me following religious lessons online that are only specific for women in matters of Aqīdah, Fiqh, and the Arabic language; despite me being in need to learn my obligations and strengthen my Imān.

Would I be considered disobedient to my husband if I proceeded with these lessons considering they are beneficial and are supervised and they don’t contain free-mixing?

May Allah reward you with good.

📩🔸Answer:

There’s no harm for you in this. Verily, obedience is only in what is good.

A female questioner says: is it considered a sin for a woman to undergo cosmetic surgery of the breast due to the changes of which occurred to it after breastfeeding?

📩🔸Answer:

If this surgery will be carried out by another woman, then it’s fine and Allah knows best. As for if it’s by way of a man, then it’s not permissible, and that’s due to the lack of dire necessity.

📩🔹Question:

A person over eighty years old lives alone, and finds difficulty in making ablution, particularly when raising his feet to wash them or when bending down, which at times causes him to delay Salatul Fajr until after the sun rises.

What is the ruling on that?

📩🔸Answer:

It’s not permissible for him to delay the prayer until its time departs. It’s not permissible for him to perform Tayamum because he’s still able to use water.

We have learned from your fatwa regarding the current situation that it is not permissible to purchase any looted items from the military camps. Some of them mentioned that the weapons from the 1994 war were looted and sold. I would like an answer to this statement.

📩🔸Answer:

In the 1994 war, the socialists abandoned those weapons when they fled, and the scholars ruled with its permissibility for the people. As for these, then all of it is the wealth of the government, so the scholars ruled with the obligation of its preservation and the impermissibility to loot or steal it.

Oh Sheikh, may Allah preserve you!
My father shouts and wishes for death every day without any illness, just because of the hardships of life and its burden and severity on us. So with what should I advise him?

📩🔸Answer:


It is not permissible for him to wish for death. Upon him is to fear Allaah and patience. If it is a must, he should make du‘aa with what is mentioned in this Hadith:
From Anas bin Maalik, may Allah be pleased with him, the Prophet ﷺ said: “None of you should wish for death due to a calamity that has befallen him. If it is a must, then let him say: ‘O Allaah, keep me alive as long as life is good for me, and take my soul, if death is better for me.’
[Narrated by Al-Bukhaari and Muslim]

And also, what’s come with Tirmidhi and with Imām Ahmad, from the Hadith of Abu Huraira, may Allah be pleased with him, that the Prophet ﷺ was asked: “What (deed) mostly gets people admitted into Jannah? He (ﷺ) said: Taqwa of Allah and good character. Then it was said: O Messenger of Allah: What (deed) mostly gets people admitted into Hell-Fire? He said: “The mouth and the private parts”.

The mouth and the private parts. Desires what relates to the mouth (i.e the tongue) which are prohibited (such as backbiting, lying, etc), and desires of what relates to the private parts that are prohibited. These are what mostly enters people into the Fire.

▪️Chapter: Who is obliged to pray:

[Imam Muhammad bin Ali Ash-Shawkaani, Rahimahullah, in Ad-Durar Al-Bahiyyah:] "Prayer is not obligatory for the non-accountable, and it ceases to be obligatory for one who is unable to gesture or who loses consciousness until the time for it has passed. The sick person prays standing, then sitting, then on his side". End.

▪️Who is obliged to pray:

The Allaamah Al-Hajjaawi, may Allah have mercy on him, said in his book "Zaad Al-Mustaqni'": "It is obligatory for every accountable Muslim, excluding a menstruating woman and a woman in postpartum bleeding". End of speech from "Al-Hashiyah Al-'Uthayminiyyah ala Zad Al-Mustaqni', p.53".

Imam Ash-Shawkaani, may Allah have mercy on him, said: As for it not being obligatory for the non-accountable, this is because the address of obligation does not include the non-accountable, and there is no disagreement regarding this concerning legislative obligations. As for regarding what has been reported about teaching children and training them, the address in that is for the accountable individuals; the obligation is upon them, not upon the children". ▪️If a boy reaches puberty after having prayed, is he required to repeat the prayer?

Imam Ibn Qudaamah, may Allah have mercy on him, said: "If he prays within the time (of the prayer), then reaches puberty within that time after completing it, or during it, then he must repeat it. This is also the view of Abu Hanifah. Ash-Shaafi'i said: "It suffices him, and he is not required to repeat it in either case, because he performed the duty of the time, so he is not required to repeat it, just like an adult". Our evidence is that he prayed before it became obligatory upon him, and before the cause of its obligation existed for him, so it does not suffice him for what the cause of its obligation has come into effect for him, just as if he prayed before the time (entered). Also, because he prayed a supererogatory prayer, so it does not suffice him for the obligatory one, just as if he intended it as supererogatory. Also, because he reached puberty during the time of the worship and after performing it, so repeating it becomes obligatory for him, like Hajj. The duty of the time for an adult, such as Dhuhr, is obligatory, and he has not performed it". End of speech from "Al-Mughni, 3/50".

Ibn Uthaymeen, may Allah have mercy on him, chose the view that he is not required to repeat it. He said: "The reasoning for this is that he performed the act of worship in the manner required of him, so the requirement is fulfilled by it. Based on this, repeating it is not obligatory upon him. This is supported by the fact that this situation occurs frequently, and it has not been recorded that the Companions, may Allah be pleased with them, used to command those who reached puberty during the time of a prayer to repeat it". ▪️If an insane person regains consciousness, is he required to make up for the prayers he missed?

Ibn Qudaamah, may Allah have mercy on him, said: "The insane person is not responsible, and he is not required to make up what he missed during his state of insanity, unless he regains sanity during the time of a prayer, in which case he becomes like a boy who reaches puberty. We know of no disagreement regarding this. The Messenger of Allah ﷺ said: "The pen has been lifted from three: from the sleeper until he wakes up, from the boy until he reaches puberty, and from the insane person until he regains sanity". Reported by Abu Dawud, Ibn Maajah, and Tirmidhi, who said it is a Hadith Hasan.

Also, because his period (of insanity) is often lengthy, so requiring him to make it up would be difficult, so he is excused from it". End of speech from "Al-Mughni, 3/50".

▪️Does a menstruating woman or a woman in postpartum bleeding make up for missed prayers?

On this is the Hadith of Mu'aadhah, she said: "I asked Aisha, saying: "Why does a menstruating woman make up for missed fasts but not for missed prayers?". Aisha replied: "Are you a Haruriyyah?". I said: "I am not a Haruriyyah, but I am simply asking". She said: "That used to happen to us, and we were commanded to make up for the fasts, but we were not commanded to make up for the prayers".". Reported by the Jamaa'ah.

Imam Ash-Shawkaani, may Allah have mercy on him, said: "Ibn Al-Mundhir, An-Nawawi, and others have transmitted the consensus of the Muslims that it is not obligatory for a menstruating woman to make up the prayers, while it is obligatory for her to make up the fasts

Ibn Abdulbarr reported that a group from the Khawarij used to obligate a menstruating woman to make up the prayers. It is also reported from Samurah bin Jundub that he used to command it, but Umm Salamah disapproved of that.

Al-Haafidh said: "However, the consensus has been established on the absence of obligation, as stated by Az-Zuhri and others".

The basis for this consensus is this authentic Hadith. However, using the absence of a command as evidence for the absence of the obligation to make up the prayers could be contested, due to the possibility that the general evidence indicating the obligation of making up prayers might suffice. It is more appropriate to use as evidence what Al-Isma'ili narrated through another chain with the wording: "She (i.e., Aisha) did not use to make them up", the meaning of which is mentioned in Fath Al-Bari. The contestation regarding the inference from the absence of a command for the non-obligation of making up prayers cannot be sustained unless it is conceded that making up is obligatory based on evidence for performing the prayer on time, or that there is evidence indicating the obligation of making up prayers which includes the menstruating woman. Both of these premises are disputed.

The Majority, as stated by An-Nawawi, hold that making up prayers is not obligatory for a menstruating woman unless there is new specific evidence.

An-Nawawi said in his commentary on Sahih Muslim: "The scholars said: The difference between the two (i.e., fasting and prayer) is that prayers are many and repeated, so making them up would be difficult, unlike fasting, which is obligatory only once a year, and menstruation might last only a day or two".

Know that the Khawarij have no evidence except the point we have conceded: that the absence of a command does not necessarily imply the absence of the obligation to make up, and that they rely on the general evidence for making up. If they mean by "evidence for making up" the Hadith about the one who sleeps through a prayer or forgets it, how does that relate to the issue under dispute? And if they mean other evidence, what is it? Moreover, if the evidence for making up were sufficient, then why did the Legislator specifically command them to make up the fasts and not the prayers? The Khawarij do not deserve prolonged debate or argument, especially regarding such a statement that breaches consensus and is rejected by all Muslims without dispute. However, because some later scholars, due to their innate love for presenting oddities, elevated the status of this opinion, we have mentioned a portion of the discussion on this issue".
