Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - on the 4th, Muharram, 1436H
📝🔹Question:
Is it considered Taqleed for a person to say "blind-follow a scholar with proof and don't blind-follow him without proof"?
📩🔸Answer:
If it was based upon proof then this isn’t regarded as Taqleed, as blind-following is "following one who isn’t a binding evidence without binding evidence".

Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - on the 29th, Muharram, 1436H
📝🔹Question:
What’s the ruling on urinating while standing, is it prohibited? And is there any clear textual evidence from the Quran or the Sunnah prohibiting it?
📩🔸Answer:
Urinating while standing is permissible due to the hadith of Huthaifa, may Allah be pleased with him:
《أَتَى النَّبِيُّ صلّى الله عليه وسلم سُبَاطَةَ قَوْمٍ فَبَالَ قَائِمًا، ثُمَّ دَعَا بِمَاءٍ فَجِئْتُهُ بِمَاءٍ فَتَوَضَّأَ》

📝 The ruling of urinating while standing:
It’s not disliked to urinate while standing up, even if there wasn’t a need to do so, with two conditions:
1. Safeguarding yourself from any urine sprinkling back on yourself and your clothing.
2. Safeguarding yourself from being seen by anyone else.
And the proof containing the permissibility of urinating while standing up is the narration of Huthaifa bin Yamaan, may Allah be pleased with him, whereby he said:
(أَتَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُبَاطَةَ قَوْمٍ فَبَالَ قَائِمًا ثُمَّ دَعَا بِمَاءٍ فَجِئْتُهُ بِمَاءٍ فَتَوَضَّأَ)
"The Prophet (ﷺ) went to an area designated by some of the people for waste and urinated while standing. He then requested for water and so I brought it to him and he performed ablution."
[Sahih Bukhari 2471, Sahih Muslim 273)
Al-Haafidh, Ibn Hajr may Allah have mercy on him, said:
"It’s been authentically narrated from ‘Umar, ‘Ali, Zayd bin Thaabit, and other than them that they urinated standing, which points to that urinating while standing is permissible without any dislike; as long as one safeguards himself from urine sprinkling back on them, and Allah knows best. Likewise there has not been anything authentically narrated from the Prophet ﷺ prohibiting it."
[End of speech from Fathul bari (330/1)]
As for what relates the Hadith of ‘Aisha, may Allah be pleased with her, wherein she said:
(مَنْ حَدَّثَكُمْ أَنَّ رَسُولَ اللهِ صلى الله عليه وسلم بَالَ قَائِمًا فَلاَ تُصَدِّقُوهُ؛ مَا كَانَ يَبُولُ إِلاَّ جَالِسًا)
"Whoever tells you that the Messenger of Allah (ﷺ) urinated standing up, do not believe him, for he would not urinate except while squatting’’
[Reported by Imaam Nisaa'i]
This Hadith is also authentic, however it only points to ‘Aisha narrating from what she saw predominantly from the Prophet ﷺ that he would urinate while squatting.
Abu Bakr bin Al-Mundhir, may Allaah have mercy on him, said:
"Some of the scholars preferred that the one urinating while sitting to distance themselves further from the people, and they didn’t see anything wrong for the one urinating standing up not being so far from people.
He (Ibn Al-Mundhir) said:
This is due to that urinating standing is more safeguarding to ones rear [from being seen] and less likely to be soiled by [the sprinkling of] the urine.
Sitting while urinating is more beloved to me, and urinating while standing up is permissible, and both have been authentically narrated from the Messenger of Allah ﷺ."

📩🔹Question:
Is it permissible for children to wear Saraweel?
📩🔸Answer:
That which is prohibited to be worn by adults is also prohibited to be worn by the young children, and Saraweel are permissible to be worn by adults.
However trousers is what’s impermissible as it’s from the clothing of the disbelievers. There’s a difference between the two.

▪️Is the Basmalah a verse of the Faatiha?▪️
Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him -
📝🔹Question:
Is the basmalah a verse of the faatiha?
Please provide some proof because there is much dispute in regards to it in our village, and we seek the proofs in its regard.
📩🔸Answer:
That which is considered the most correct position; is that it's not considered a verse of the faatiha, and the proof for this is the hadeeth qudsi narrated by Abu Hurayrah:
"Allah, the Most High, said:
قَسَمْتُ الصَّلاَةَ بَيْنِي وَبَيْنَ عَبْدِي نِصْفَيْنِ وَلِعَبْدِي مَا سَأَلَ فَإِذَا قَالَ الْعَبْدُ { الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ} .
I have divided the prayer into two halves between Me and My servant, and My servant will receive what he asks. When the servant says:
(الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ)
"All the praises and thanks be to Allah, the Lord of the 'Alamin (mankind, jinns and all that exists)."
Allah the Most High says:
حَمِدَنِي عَبْدِي
"My servant has praised Me."
And when he (the servant) says:
(الرَّحْمَنِ الرَّحِيمِ)
"The Most Beneficent, the Most Merciful."
Allah the Most High says:
مَجَّدَنِي عَبْدِي
"My servant has lauded Me."
And when he (the servant) says:
(مَالِكِ يَوْمِ الدِّينِ)
"The Only Owner (and the Only Ruling Judge) of the Day of Recompense (i.e. the Day of Resurrection)"
He says:
"My servant has glorified Me."
And sometimes He would say:
فَوَّضَ إِلَىَّ عَبْدِي
"My servant entrusted (his affairs) to Me."
And when he (the worshipper) says:
(إِيَّاكَ نَعْبُدُ وَإِيَّاكَ نَسْتَعِينُ)
"You (Alone) we worship, and you (Alone) we ask for help (for each and everything)."
He (Allah) says:
"This is between Me and My servant, and My servant will receive what he asks for."
Then, when he (the worshipper) says:
(اهْدِنَا الصِّرَاطَ الْمُسْتَقِيمَ) (صِرَاطَ الَّذِينَ أَنْعَمْتَ عَلَيْهِمْ غَيْرِ الْمَغْضُوبِ عَلَيْهِمْ وَلاَ الضَّالِّينَ)
"Guide us to the Straight Way."
"The Way of those on whom You have bestowed Your Grace, not (the way) of those who earned Your Anger, nor of those who went astray."
He (Allah) says:
"This is for My servant, and My servant will receive what he asks for".
[Narrated by Muslim]
An-Nawawi said:
"Those that took the position of the basmalah not being a verse of the faatihah use this hadeeth as an evidence, and it's the most clear in regards to what they used as evidence.
They said: this is due to it being seven verses by consensus, the first three are praise; the first one being:
(الحمد لله)
"All the praises and thanks be to Allah, the Lord of the 'Alamin (mankind, jinns and all that exists)."
And three supplications; the first one being:
(اهدنا الصراط المستقيم)
"Guide us to the Straight Way"
The seventh being the verse in the middle which is:
(إياك نعبد وإياك نستعيم)
"You (Alone) we worship, and you (Alone) we ask for help (for each and everything)."
And they said: this is due to Allah, the Most High, saying:
قَسَمْتُ الصَّلاَةَ بَيْنِي وَبَيْنَ عَبْدِي نِصْفَيْنِ وَلِعَبْدِي مَا سَأَلَ فَإِذَا قَالَ الْعَبْدُ (الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ) .

"All the praises and thanks be to Allah, the Lord of the 'Alamin (mankind, jinns and all that exists)."
And He didn't mention the basmalah here and if it was part of it, He would of mentioned it..."[end of speech of An-Nawawi]

◾️The authenticity of the Hadīth of the slave girl that was asked where is Allah◾️
Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - on the 1st, Thil-Hijjah, 1440H
📝🔹Question:
Oh Shaykh, is the Hadīth of the slave girl Mudtarib (narrators/narrations of similar or near to similar level, opposing each other to the point of inability to accept the speech of one over the other)?
And how do we reply to those that say it's Mudtarib?
📩🔸Answer:
The Hadīthth of the slave girl is authentic and not Mudtarib.
Imām Al-Albāni, may Allah have mercy upon him, said:
"There is no doubt that the scholars -those of Hadīth & Fiqh-, have come together in agreement upon it's authenticity throughout the different eras, without there being any differing between them on its authenticity, the Hadīth has been declared authentic by the five (Muslim, Abu 'Awānah, Ibn Khuzaymah, Ibn Hibān, Ibn Jārūd) who have reported the Hadīth in their Sahīh's, likewise Al-Bayhaqi, Al-Baghawi, Ad-Dhahabi, Al-Hāfidh and all of them have mentioned the Hadīth and it's chain of narration being authentic.
And additionally all of the different Imāms of Hadīth, Fiqh, Tafsīr, in their respective Madhabs; of those that used this Hadīth as evidence in a chapter of the chapters of the Sharī'ah, because it's not possible that they could of used anything here except that they considered it authentic..."

▪️Singling out the intention for 'Arafah due to it being a specific fast▪️
Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him -
📝🔹Question:
A woman has some days to repay from Ramadhaan, and she wishes to fast the during the ten days of Thil-Hijjah, can she fast the ten days while she has days to make up on from Ramdhaan?
📩🔸Answer:
It's better that she fasts during the ten days with the intention of repaying her missed fasts from Ramadhaan, thereby attaining the virtue of performing righteous action during the ten days and she would have made up her missed days from Ramdhaan.
Except the day of 'Arafah which is fasted with the intention being: fasting the mustahab (recommended) fast of 'Arafah, due to it being a specific fast.
