◾️Difference between Major and Minor Shirk◾️

Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him- on the 29th, Jumaada Al-Aakhirah, 1440H

📝🔹Question:

Is this correct, that major shirk renders false all actions and minor shirk only renders false the specific action it took place in?

📩🔸Answer:

Yes that’s correct. The proof for the first is the statements of Allah -the Most High-:

(ولو أشركوا لحبط عنهم ما كانوا يعملون)
"If they had joined in worship others with Allah, all that they used to do would have been of no benefit to them."

And

(لئن أشركت ليحبطن عملك ولتكونن من الخاسرين)
"If you join others in worship with Allah, (then) surely (all) your deeds will be in vain, and you will certainly be among the losers."

The proof for the second, the Hadith (Qudsi):

مَنْ عَمِلَ عَمَلًا أَشْرَكَ فِيهِ مَعِي غَيْرِي تَرَكْتُهُ وَشِرْكَهُ
"Whoever does an action in which he associates anyone else with Me, I shall abandon him and his polytheism."
[Abu Hurayrah, Sahih Muslim]

📝🔹Question:

Is it permissible to swear by "Amaanah", and is swearing by "Amaanah" considered minor shirk?

📩🔸Answer:

It’s not permissible, this is considered minor shirk due to the hadith:

من حلف بغير الله فقد أشرك
"Whoever swears by other than Allah has committed Shirk"

And it’s come in another hadith:

من حلف بالأمانة فليس منّا
"Whoever swears by Amaanah is not from us"

Minor shirk due to the view of some of the scholars being that it enters into the generality of the statement of Allah:
(إن الله لا يغفر أن يشرك به ويغفر ما دون ذلك لمن يشاء)
"Verily, Allah forgives not that partners should be set up with him in worship, but He forgives except that (anything else) to whom He pleases"

He should make Wudhu (ablution) when the prayer is near and there’s no blame on him if something comes out from him during the prayer.

He should either live with her upon goodness or release (divorce) her with kindness.

As for visiting the graves it’s legislated and recommended but without specifying it to a particular day.

▪️One or two 'Eid Khutbahs?▪️

Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him- on the 8th, Thil-Hijjah, 1439H

📝🔹Question:

Is it permissible for me to give two khutbas on 'eid or do I suffice with one?

📩🔸Answer:

You suffice with one, as it's the (dhaahir) apparent of all the ahadeeth, and they are many, that it's only one khutbah.
Likewise there has not come, not a single letter in regards to the separation [between the two khutbahs], as it occurred with the two khutbah on jumu'ah (friday) with the period of sitting between the two khutbahs.

As for what relates to the unanimous agreement which has been relayed in this affair, then it's not clear cut.
It was merely the case that a number of affairs of 'eid was mentioned by Ibn Hazm in "Al-Muhala", from them being the two khutbahs, and then said: "There is no differing in regards to all of this."

Due to this some scholars took the position of there only being one khutbah, like As-San'aani and Al-Albaani and our shaykh Al-Waadi'ee, may Allah have mercy upon them, and they are from those whose positions consideration is paid to in regards to the [claim of] unanimous agreement.

Ibn 'Utheymeen, may Allah have mercy upon him, said: "Whoever was to look into the Sunnah of that which it's authenticity is agreed upon, the likes of what is in the two saheehs and elsewhere, it would become clear to him that the Prophet ﷺ did not perform but a single khutbah."

And he also said: "The Sunnah is; for there to be only one khutbah, if two khutbahs was to take place; there is no harm."

And our shaykh Muqbil, may Allah have mercy upon him, said: "I challenge anyone to say: it has authentically been reported from the Prophet ﷺ that he gave two khutbahs for 'eid."

The proofs of those that take the position of there being two khutbahs are unauthentic ahadeeth, and an analogy with the jumu'ah khutbah for the 'eid khutbah.

Our shaykh Muqbil said: "Why haven't they drawn an anology with the kusuuf (lunar eclipse), it only has a single khutbah, why haven't they drawn an anology with other affairs which only have one khutbah."

📝🔹Question:

May Allah bless you O Shaykh.
I want to begin memorising the Quran. How is this accomplished, and what do you advise me to do?

📩🔸Answer:

(a)I advise you to learn and memorise under the supervision of a proficient teacher.

(b)Whereby he recites to you a set portion to memorise, starting with a few (verses), not exceeding a quarter of a page.

(c)Then if you have accurately grasped it's recitation, you proceed to memorising it.

(d)After memorising it, you go over it by repeating it 30 times or more whilst looking at the page, then you repeat it without looking at the page in a similar fashion.

(e)Then you present it to your teacher (to then repeat the process)

(f) You should also find a partner who you revise daily with of that which you have memorised.

📝🔹Question:

Does the divorce of ones wife while she is in a state of purity (i.e not menstruating nor experiencing post natal bleeding) and having had intercourse with her, count as a divorce?

May Allah reward you with good.

📩🔸Answer:

This is a talaaq bid'ee (an innovated divorce/a divorce in opposition to the sunnah), it is a must for him to take her back, and a single divorce (out of three towards the irrevocable divorce) is used up.

▪️Covering of the face for the female pilgrim▪️

Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him - on the 17th, Ramadhaan, 1440H

📩🔹Question:

We need clarification on the unveiling of the face when performing the pilgrimage of hajj and 'umrah, because many of the women reveal their faces while in the state of 'ihraam', so what is it's ruling?

📩🔸Answer:

It's not permissible for women to uncover their faces in front of non-mahram men, even if they are in a state of 'ihraam'.
This is due to there not being any correct proofs preventing women who are in a state of 'ihraam' from covering their faces, and the basis is permissibility [in doing so].

Asmaa, may Allah be pleased with her, said:

(كنا نغطي وجوهنا من الرجال وكنا نمتشط قبل ذلك في الإحرام)
"We would cover our faces from the men and would also comb our hair while in the 'ihraam'."

[Reported by Haakim with an authentic chain of narration]

And Faatimah bint Al-Mundhir said:

(كنا نخمر وجوهنا ونحن محرمات ونحن مع أسماء بنت أبي بكر)
"We would veil our faces while we were in 'ihraam', and we would be with Asmaa bint Abi Bakr."

[Reported by Maalik in Al-Muwata' with an authentic chain of narration]

What they are prevented from is the wearing of the niqaab.

Shaykh-ul-Islaam Ibn Taymiyyah, may Allah have mercy upon him, said:

"If a woman was to cover her face with something which would not touch her face; this would be permissible by consensus. And if it was to touch the face; then what is correct in this subject is that it's also permissible.

In addition, the women are not to be burdened with keeping the cloth away from her face, by using a piece of wood, a hand or anything else, because verily Prophet ﷺ didn't differentiate between her face and her hands, both [in the 'ihraam'] are like the body of the man, not like his head, and his ﷺ wives would cover their faces without continuesly keeping the cloth away from their faces.

And it hasn't been reported by any of the people of knowledge from the Prophet ﷺ that he ﷺ said:

“The 'ihraam' of the women is that of her face.", this is merely a statement of some of the salaf but the Prophet ﷺ forbade the women from wearing the niqaab or wearing gloves."

📝🔹Question:

What is the ruling of drinking by placing one's mouth directly on the water-vessel, especially if the vessel is only used by the person himself?

📩🔸Answer:

It is disliked, regardless if it was only used by you, and Allah knows best, because multiple reasons have been mentioned regarding the prohibition of this act.

Shaykh Muhammed bin Abi Jamrah said in what may be summarised as follows:
'They differed concerning the reason for this prohibition, some said: for fear that there may be an animal in the vessel [unbeknownst to its owner], (others said) it could pour out with force and choke the person, (others said) it could damage the weak veins which run close to the heart leading to one's demise, (others said) it may be due to the breath and the orifice of the vessel, (others said) perhaps because of a person's saliva may mix with the water and so it becomes off-putting for others, (others said) it's a common cause for containers to become ruined, hence it becomes a form of wasting money.'

And he said: 'thoughtful consideration & correct understanding would suggest that the prohibition is due to the combination of all of these reasons."[end of speech]

He doesn’t have the right to seperate his children except if there was a major legislated benefit that he sought to obtain or an evil he sought to avert, and Allah knows best.
