There is a traveler who has shortened and combined the prayer due to him being a traveller and then entered the masjid before the 'asr prayer and sat through the 'asr prayer and did not pray with the congregation, and when I enquired concerning this he replied "I have already shortened and combined [the prayers]".
What's the ruling of this action of his?
📩🔸Answer:
Him sitting in the masjid while the people are praying is a mistake, the correct thing to do was to pray the prayer with the people and it would've been supererogatory.

What is the ruling of plucking white hairs from ones head?
📩🔸Answer:
It's disliked upon the position of the majority of the people of knowledge.
The Prophet ﷺ said:
(لَا تَنْتِفُوا الشَّيْبَ، فَإِنَّهُ نُورُ الْمُسْلِمِ، مَا مِنْ مُسْلِمٍ يَشِيبُ شَيْبَةً فِي الْإِسْلَامِ إِلَّا كُتِبَ لَهُ بِهَا حَسَنَةٌ، وَرُفِعَ بِهَا دَرَجَةً، أَوْ حُطَّ عَنْهُ بِهَا خَطِيئَةٌ)
"Don't pluck the white hairs, for it is the light of a Muslim, there is not a Muslim that grows a white hair while in a state of Islam except that Allah writes for him a reward, and raises him by way of it a level or removes a mistake from him by way of it."
[Reported by Ahmed, Abu Dauud, by way of 'Abdullah bin 'Amr]
And Anas bin Malik, may Allah be pleased with him, said:
"It's disliked for a man to pluck his white hairs from his head and beard."

If a husband was practicing at the beginning of the marriage then he befriended bad company, and became negligent in regards to the prayer in the masjid and merely prays in the house whenever he likes, and does not ever listen to advise.
How is he to be treated baring in mind she got children with him?

She reminds him of Allah, and those early days when he used to be upon good, while supplicating for guidance for him.

📝🔹Question:
We heard your warnings from Shaykh Rabee' Al-Madkhali, whereby you said he is not upon correctness and that he has disunited the callers in Yemen due to his approach on affairs, but do we free ourselves from him and his followers and deal with them in line with the principle of Walaa wal baraa (allegiancing and disallegiencing for the sake of Allah)?
And what do we understand from the statement of Al-Albaani: "we are with Rabee' in knowledge but not in approach."?
📩🔸Answer:
Ahlusunnah likewise, until very recently, were with Shaykh Rabee'. They venerated and loved him, until he aided the trialed Baraamikah in their assault against the dawah of our Shaykh, Shaykh Muqbil and the dawah of our Shaykh, Shaykh Yahya and Dammaj, the centre of knowledge, as well as the men of the Salafi Da'wah in Yemen. So this bore its affect on him, and aid is sought with Allah.

▪️ Which is more virtuous, to lead the prayer or performing the athaan?▪️

📝🔹Question:
Our sheikh Abu Hamza may Allah bless you, which is more virtuous, the imaam or the mua'thin (the one who makes the call for prayer)?
📩🔸Answer:
The people of knowledge have differed in regards to which is more virtuous into various opinions:
The first of them:
That leading the prayer is more virtuous, this is the mathab [the position] of the Hanafeeyyah (those who attribute themselves to Abu Haneefah) and the most commonly known opinion of the Maalikeeyyah (those who attribute themselves to Imaam Maalik) and some of the Shaafi'eeyyah (those who attribute themselves to Imam Ash-Shaafi'ee), and it is one of the reported positions of Ahmad.
The second:
That making the Athaan (call to the prayer) is more virtuous, this is the opinion of Ash-Shaafi'ee and the majority of his companions, and it is one of the reported positions of Ahmad, and this is the opinion that Imaam An-Nawwawi and Shaykhul Islaam have chosen.
The third:
They are both the same in virtue, this is one of the opinions of the Hanifeeyah and Maalikeeyah and Shaafi'eeyah.
The fourth:
If he knows that he is able to fulfill all the rights of being the imaam and all of its characteristics then it is more virtuous, and if he is not able, then the Athaan is more virtuous, this has been said by the Maalikeeyah and Shaafi'eeyah.
Those who have given preference of the Imaam over the Mua'tthin have used as evidence that the Prophet ﷺ and the rightly guided caliphs were Imaams and were not from those who performed the Athaan and likewise the major scholars after them.
And also from the evidences they use is that only the one who is most fit and most virtuous is to be chosen to lead (unlike the athaan) as it has come in the hadeeth of Maalik Ibn Al-huwayrith - may Allah be pleased with him - whereby he said: the Prophet ﷺ said to us:《"...one of you perform the Athaan and the eldest of you should you lead the prayer."》
And the hadeeth of Abi Mas'ood Al-Ansaari -may Allah be pleased with him- said: the Prophet ﷺ said:《"the one who is well versed in the book of Allah is to lead the people (in prayer), and if they are equally versed, then the most knowledgeable of them of the sunnah, if they are equal in that, then the one who made hijrah (migration from the lands of sin and disbelief to the lands of obedience and Imaan) first, and if they are equal in hijrah then the earliest one to accept islaam."》
And those who have preferred the Athaan have used as evidence, all of that which has been affirmed from the Ahaadeeth which show the virtues of the Athaan.
And they have answered ( to which was previously mentioned) of the adherence of the Prophet ﷺ to leading and likewise those who came after him from the caliphs and the scholars that they did not perform the Athaan as they were busy rectifying the affairs of the muslims, the job which nobody could have done except them, so they had no time to do the Athaan nor keep track of its time, as for leading the people, then they would of had to pray, and that which supports this explanation is the statement of Umar Ibn Al-Khattaab -may Allah be pleased with him- reported by Al-Bayhaqi with a authentic chain of narration that he said "if i could have endured the responsibilities of the Athaan whilst being a caliph then I would have performed the Athaan." End of speech from the book 'Al-majmoo3' (3/78)
Shaikh Al-islaam -may Allah have mercy on him- said:
"as for his leadership ﷺ and the leadership of the rightly guided caliphs, then this was something assigned for him, for it is indeed a job for the greatest Imaam, and it was not possible to combine between being the Imaam and performing the Athaan, thus being the Imaam in their respect was more virtuous than the Athaan due to their specific roles, even if it may be that the Athaan is better according to the majority of the people"

The correct opinion is that there is no prohibition in it, and all of the Ahaadeeth of prohibiting sleeping on the stomach are not authentic.

📝🔹Question:
What is your opinion, Oh Shaykh, in regards to the one who wants to bring down Shaykh Yuusuf Al-'Inaabi due to his refutation against Shaykh Rabee' Al-Madkhalee, may Allah reward you with good?
📩🔸Answer:
No one is able to bring down anybody rather this affair, all of it, is for Allah alone, He endues with honour whom He wills and He humiliates whom He wills, so long as the slave adheres to the true religion of Allah and is truthful in his adherence to it then Allah will raise him, [Allah said]:
{يَرْفَعِ اللَّهُ الَّذِينَ آمَنُوا مِنْكُمْ وَالَّذِينَ أُوتُوا الْعِلْمَ دَرَجَاتٍ}
"Allah will exalt in degree those of you who believe, and those who have been granted knowledge."
[Surat Al-Mujaadila:11]
However if he inclines towards falsehood and opposes the truth then Allah will humiliate him, [Allah said] :
{إِنَّ الَّذِينَ يُحَادُّونَ اللَّهَ وَرَسُولَهُ أُولَٰئِكَ فِي الْأَذَلِّينَ}
"Those who oppose Allah and His Messenger, they will be among the lowest (most humiliated)."
[Surat Al-Mujaadila:20]

📝🔹Question:
Are the people on the day of judgement called by the names of their father's or their mother's?
📩🔸Answer:
Ibn Al-Qayyim, may Allah have mercy upon, said in his book (Tuhfatul-Mawluud):
"The tenth part in clarification that the creation are called, on the day of judgement, by the names of their father's, not their mother's:
This is that which is correct, and that which the authentic, clear, sunnah points towards, and which has been textually mentioned by the Imaams; the likes of Bukhari, and other than him, Bukhari in his 'Saheeh', said:
"The chapter of the people, on the day of judgement, being called by the names of their fathers and not their mothers."
He then mentioned in the hadeeth of Ibn 'Umar saying:
"The Messenger of Allah ﷺ said:
(إذا جمع الله الأولين والآخرين يوم القيامة يرفع الله لكل غادر لواء يوم القيامة فيقال هذه غدرة فلان بن فلان)
"When Allah gathers the early comers and the late on the day of judgement, each group will be made to raise a banner, by Allah, on the day of judgement, and then someone will say: this is group is that of 'so-and-so the son of so-and-so'."
And in the 'sunnan' of Abu Dauud, with an excellent chain of narration, by way of Abu Dardaa, wherein he said:
"The Messenger of Allah ﷺ said:
(إنكم تدعون يوم القيامة بأسمائكم وأسماء آبائكم فحسنوا أسماءكم)
"You will be called out, on the day of judgement, by your names and the names of your father's, so chose good names."
And some of the people claimed that they will be called out by the names of their mothers and they took as a evidence a hadeeth which is not authentic, and it is found in the 'Mu'jam' of Tabaraani, by way of Abu Umaamah from the Prophet ﷺ, that he said:
(إذا مات أحد من إخوانكم فسويتم التراب على قبره فليقم أحدكم على رأس قبره ثم ليقل يا فلان بن فلانة فإنه يسمعه ولا يجيبه ثم يقول يا فلان بن فلانة فإنه يقول أرشدنا يرحمك الله)
"When one of our brothers dies and you even out the sand on his grave, let there be one of you who stands at the head part of the grave and say "Oh so-and-so the son of -mother's name-", because he can hear you but is not able to reply, then let him say [again] "Oh so-and-so the son of -mothers name-" for he will say "Direct us, may Allah have mercy upon you"."
And [the aforementioned source] likewise [mentions] the hadeeth:
"A man said: Oh Messenger of Allah[ﷺ], how about if his mother's name is not known?, he ﷺ then said:
(فلينسبه إلى أمه حواء يا فلان ابن حواء)
"He is attributed to his mother Hawwaa [the wife of Prophet Adam ﷺ], Oh so-and-so the son of Hawwaa."
They [those that hold this position] likewise said, it is possible that a man's lineage is not established for him in what relates to his father, like the one who was denied this by accusation of fornication and the cursing of the spouses which takes place in the negation of a son belonging to him, or a child born from fornication [ both parties involved not being married], then how is one called by his father's name?
The answer to this is, that the hadeeth is unauthentic by consensus of the people of knowledge, as for he who has been deprived of lineage through his father then he is called out upon, on the day of judgement, with that which he is called out upon in the Dunyaa [this worldly life], either by his father or by his mother, and Allah knows best."

📩🔸Answer:
Ibn Al-Qayyim, may Allah have mercy upon, said in his book (Tuhfatul-Mawluud):

(فلينسبه إلى أمه حواء يا فلان ابن حواء)
"He is attributed to his mother Hawwaa [the wife of Prophet Adam ﷺ], Oh so-and-so the son of Hawwaa."
They [those that hold this position] likewise said, it is possible that a man's lineage is not established for him in what relates to his father, like the one who was denied this by accusation of fornication and the cursing of the spouses which takes place in the negation of a son belonging to him, or a child born from fornication [ both parties involved not being married], then how is one called by his father's name?
The answer to this is, that the hadeeth is unauthentic by consensus of the people of knowledge, as for he who has been deprived of lineage through his father then he is called out upon, on the day of judgement, with that which he is called out upon in the Dunyaa [this worldly life], either by his father or by his mother, and Allah knows best."

▪️When does 'thuhr' start?▪️
Answered by Shaykh Abu Hamza Hassan bin Muhammed Ba Shu'ayb - may Allah preserve him- on the 28th, Shawwaal, 1440H
📝🔹Question:
What time does 'thuhr' begin?
And how does one know the time the sun begins to descend?
With some elaboration, may Allah reward you with good.
📩🔸Answer:
Nawawi, may Allah have mercy upon him, said:
"The Ummah have unanimously agreed that the entrance the time period [called] 'thuhr', is at the decline of the sun [from its peak], the unanimous agreement has been relayed by a large body [of scholars]."

And the description of the decline of the sun, Nawawi, may Allah have mercy upon him, said:
"Our companions, may Allah have mercy upon them, have said:
The declining of the sun is the leaning away of the sun from the centre of the sky after reaching mid-day, and the sign of this is that the shadow appears after disappearing [due to an object being directly under the sun], and that is when, [for example], a person's shadow at the start of the day starts long, and as the sun rises, it's length decreases, and when it reaches mid-day, the shadow stops [beneath the person], then when the sun starts to decline the shadow is now reappearing or growing.
If you wanted to know; has the sun declined from [it's] mid-day [position] or not, then place a stick, or anything else, into the ground, on flat even ground, in line of the sun, then place an indicator to where the shadow is at that moment in time, then start watching it, if the shadow starts to decrease then you know the sun has not reached the point where after it will start it's decline, continue watching it until the shadow starts to grow, you will know the sun's decline when the shadow starts to grow [in the opposite direction it came from].
Our companions have stated:
The amount of shadow at the point of the sun decline differs at different times [seasons, etc] and places [countries, provinces, etc], the shortest the shadow, at the decline of the sun, will be at is in the summer, due to length of the day in the summer, and the longest the shadow will be at, is in the winter, due to the shortness of the days in the winter."

There is another way to know when the sun declines from its mid-day peak, and it's by counting the hours of the day.
Ibn 'Utheymeen, may Allah have mercy upon him, said:
"As for knowledge of the decline of the sun, from it's mid-day peak, using hours [units of time]; is by halving the hours between sunrise and sunset, this is when the sun declines from it's mid-day peak, if we was to say that the sun rises at six o'clock, and sets at six o'clock, then the decline of the sun from its mid-day peak would be at twelve o'clock."
