1◾️Is Photography a subject of differing?◾️

📝🔹Question:

O Shaykh, may Allah preserve you, there are some people that say that photographic picture taking is a subject of differing, and that the differing is taken into consideration, and that we are not to rebuke those that see it to be permissible, due to them being preceeded by scholars.

How do we reply to this?

📩🔸Answer:

The subject of taking picture of that which contains souls is not from the affairs of 'ijtihād' due to the presence of extensive legislative texts in clarification of its impermissibility and the warning of it.

Nawawi, may Allah have mercy upon him, in his 'Sharh Muslim' after mentioning the Ahadeeth surrounding picture taking, said:

"These Hadiths are clearcut in prohibiting picturing animals, and it is severe in prohibition."
[End of speech]

And this encompasses all types of picture taking, and whoever draws distinction between the different types [of picture making] has to provide evidence.

📩🔸Answer:

The correct principle is:

"There is no rebuke in areas of ijtihād"

The affairs where there is ijtihād there is no rebuke upon he who opposes, there's no ijtihād if there was to be legislative textual evidence, here the opposer is rebuked.

📝🔹Question:

Oh sheikh, are the words 'mama' and 'baba from the Arabic language?
Abu zaid Al-ansaari mentions in his book 'An-nawaadir':
"they are both Arabic words and they are not foreign words like some of us may assume, the arabs of old used to say: "the verb 'ba'ba'aa' (on the scale of fa'lala) refers to a toddler saying baba and 'ma'ma'aa' refers to a toddler saying mama"
Al-jaahith said:
"the 'meem' and 'baa' are the first letters which are easy for the toddler to say like when they say: 'mama' and 'baba', because these 2 letters appear by the meeting of the 2 lips and have nothing to do with the tongue."

📩🔸Answer:

There is no rejection if a toddler speaks by using these words and he calls his mother and father by them, as for someone who is older then it's upon him to learn the words which coincide with the Quraan and the Sunnah and the Arabic language.
As for (mama) and (baba) then we do not affirm that they are foreign words just like the way we do not affirm they are Arabic for they are words which are shared between the tongue's of the Arab toddlers and the tongue's of the foreign toddlers."

Oh sheikh Abu Hamza -may Allah preserve you-, if someone enters the masjid while the imaam is giving the khutbah (Friday sermon) should he sit down and listen to the khutbah or pray 2 rak'ah (units of prayer) first?

📩🔸Answer:

He prays 2 rak'ah due to the generality of the hadeeth:
"If one of you enters the masjid then let him not sit until he has prayed 2 rak'ah"
And the hadeeth: "If one of you comes (to the masjid) and the imaam is giving the khutbah or he has left, should pray 2 ra'kah"

Are the clothing which have traces of fluid on them from sexual intercourse impure?

📩🔸Answer:

Yes it is considered to be impure because the wetness which is produced from the private part of the woman, due to foreplay or sexual intercourse, is pre-seminal fluid and this is impure, and it's why the man has been ordered to wash himself from it, as it comes in the hadeeth of 'Ubay bin Ka'ab -may Allah be pleased with him- he said: "I asked the Prophet ﷺ about the man that has sexual intercourse with his wife then becomes lazy, he said : "he should wash himself from the sexual fluid of his wife..."

📩🔸Answer:

If one was to fast the six days consecutively and forms his intention (for all six) on the night before the first fast only then this is sufficient, but if he was going to split up the days then he forms an intention for each night separately.

It incumbent to form the intention the night before the fast, because this a specific type of (voluntary) fast.

📝🔹Question:

Note: A mas'alah fiqheeyah:
['Not hastening in fasting the 6 days of shawwaal']:
Abdur-razzaaq As-san'aani was asked regarding the one who fasts the second day after eid Al-fitr, he thought about it and rejected it very harshly.
Abdur-razzaaq said "I asked m'amar about fasting the six days of shawwaal which is after Eid al-fitr, so the people said to said to him " fast them a day straight after al-fitr!?"
So he said "Allahs refuge is sought! These days are only for eid and eating and drinking" [reported in the musannaf of abdur-razzaaq 316/4]
So that which seems apparent, and Allah knows best:
That one should not over burden himself by fasting the six days (of shawwaal) close to the first day (eid). Whether it may be permissable in terms of its originality, however one may lose out on that which is more virtuous than hastening in fasting(the six days of shawwaal), like visiting close friends and relatives and tieing kins of kinship, and spending generously on your family and kids, and one is able to fast these days after the first few days (after eid al-fitr) as it's time is spaced out and all praise is for Allah.
And Allah is most high and most knowledgeable.
Our noble sheikh may Allah preserve you, what is your opinion in this ( that which was just mentioned) and what is the correct opinion?

📩🔸Answer:

This is good and Allah knows best.
If the benefits which are transitive, necessitate one not fasting the first few days then he shouldn't hasten and if not then he should hasten with the fast due to the generality of Islamic proofs which indicate to hastening to acts of worship.

◾️The ruling on a husband drinking his wife’s milk◾️

📩🔹Question:

What is the ruling of the man if he sucks milk from the breast of his wife during sexual intercourse?

📩🔸Answer:

There is no sin upon him, no suckling makes marriage unlawful except the suckling of the toddler who is within the age of 2 due to the hadeeth:

"Breastfeeding (which makes marriage impermissible/establishes suckling relationships) is that which satifies hunger"

And the story of Sahlah with Saalim the slave of Abu Huthayfah (1)is a specific incident and has no generality to it and this is the opinion of the majority of the scholars and Allah the most high knows best.

(1)the hadeeth of Aaisha-may Allah be pleased with her- said:

sahlah the daughter of suhail came to the prophet-may Allahs peace and blessing be upon him- and said:

“Oh messenger of Allah, verily I see (signs of disgust) on the face of abu Huthayfah due to the entering of saalim ( who was abu Huthayfah's freed slave and used to live with them from young and at this point had reached the age of puberty) so the prophet said to her "breastfeed him" whereupon she replied "how can I breastfeed him and he is a grown man?" So the prophet smiled and said "I know he is a grown man"...

And in the narration of muslim: she then said "(I did that) and by Allah I did not see (any sign of disgust) on the face of abu Huthayfah after that"

Reported by Albukhaari and muslim in their saheeh.
