We thank Counsel(s) for the submission in assistance to the court, this is our unanimous decision as regards both the appeals R5 & R6. Having considered the submissions of parties, we are of the view that there are no merits to both appeals.
The learned High Court Judge have applied the correct test and principles in granting leave.
The change of circumstances whilst having some impact on some of the relief sought cannot be said to disentitle the Respondents entirely from proceedings to be heard on the substantive merits of the JR (judicial review) application. Hence the appeals are dismissed with no order as to costsβ

Kenapa kita berjaya di Mahkamah Tinggi dan Mahkamah Rayuan?

Hari ini pengadu yang berdepan tuntutan RM150k dari Celcom gara-gara pelanggan didaftarkan melaluinya tidak melunaskan bil bulanan buat follow up kes.
Pengadu dikatakan melakukan penipuan berkaitan 346 nombor yang didaftarkan padahal bagi pendaftaran telco pelanggan perlu kemukakan Mykad.
Ini antara modus operandi syarikat gergasi dalam menindas ejen atau dealer mereka hanya kerana pelanggan yang didaftarkan tidak bayar bil bulanan.
