THE VOTE IS INVALD - IT MUST BE SET ASIDE.
Opinion
Let me explain. THIS is the provision in Bunreacht na hEireann 1937 pertaining to "opting in" by triggering the mechanism of Protocol 21 [linked below] which was and is annexed to the TFEU [Treaty on the Functioning of the European Union] as a condition of entry into force of the Lisbon Treaty [linked below], in THIS state.
"Article 29.7.iii
7° The State may exercise the options or discretions—
iii under Protocol No. 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, so annexed, including the option that the said Protocol No. 21 shall, in whole or in part, cease to apply to the State,
but any such exercise shall be subject to the prior approval of both Houses of the Oireachtas."
So, the requirement, in order to trigger the provisions of Article 21 are clear, "............but any such exercise shall be subject to the prior approval of both Houses of the Oireachtas."
Currently these are the actual number of members of BOTH Houses of the Oireachtas"
"Dáil Éireann and Seanad Éireann
The Members of Dáil Éireann, the lower house of the Houses of the Oireachtas, are elected by the people of Ireland. The current Dáil has 160 Members who represent 39 constituencies. The current Dáil is the 33rd Dáil Éireann.
There are 60 Members of Seanad Éireann, the upper house, and they are elected to five vocational panels and two university panels, or they are nominated by the Taoiseach. The current Seanad is the 26th Seanad Éireann."

There is NO PROVISON for abstentions contained within Article 29.7.iii it is EXPLICIT - both Houses in their TOTALITY MUST VOTE in order for any "vote" to approve an exercise of the "opt-in" mechanism provided for with regard to Protocol 21 in order for this "vote" to be valid and CONSTITUIONAL.
The "result" of the vote taken last night 26th June 2024 show the DAIL "vote" was 79 = TA, 73 = NIL, this represents a total DAIL "vote" of just 152, which is minus 8 votes - meaning that "......both Houses of the Oireachtas" in TOTAL did NOT vote as required pursuant to the provisions of Article 29.7.iii.
I say that this "vote" is invalid, repugnant to the provisions of Article 29.7.iii, Ultra Vires and MUST be set aside, the vote IS INVALID.

IN the alternative. The consolidated version of the TFEU clearly shows that Protocol 21 is an intrinsic part of the TFEU and cannot be separated from it - meaning that ANY change to the substance of the TFEU OR any of its terms INCLUDING any Protocol MUST be subject to a Referendum, in my opion, notwithstanding the provisions of Article 29.7.iii, because in order for the TFEU to be "ratified" in this State, INCLUDING Protocol 21 a Referendum was required, and was held for the second time on the 2nd October 2009, The PEOPLE approved its "ratification" by 67.1% yes to 32.9% no, having previously rejected it in June 2008 with a No vote of 53.4% and a yes vote of 46.6% BY THE PEOPLE, whose approval was required, as it is with ALL "Treaties" pertaining to the EU.
ALL of the above speaks to the incompetence, arrogance, democratic deficit and tyranny on display within BOTH Houses of the Oireachtas, who have flaunted their utter contempt and disregard for OUR Constitution, and it is OURS - NOT theirs, not just over the life of this renegade "Dail" but successive over successive "Houses of the Oireachtas.
The VOTE IS INVALID, Ultra Vires and REPUGNANAT to the clear provisions of Article 29.7.iii, in my opinion.
