Her Majesty's Government is planning on βReplacing the GDPR with a new UK framework for data protectionβ.
Article 22 of the GDPR, provides
"Automated individual decision-making, including profiling"
The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces mated legal effects concerning him or her or similarly significantly affects him or her.
Article 22 prohibits automated (Artificial Intelligence) decision-making.
By Her Majesty's Government proposing to scrap Article 22 of the GDPR and intending upon not providing this prohibition into a new National Framework on regulating data protection, will eliminate the decision-making process of Human Review by replacing it with, a process where Artificial Intelligence reviews, and makes decisions, on our data.
There are indeed good reasons why human review is required for algorithmic decision-making. First of all, this requirement does not apply to any use of Artificial Intelligence, but only to decisions that produce legal effects or otherwise significantly affect individuals.
If a decision that produces a legal obligation wasnβt reviewable, Artificial Intelligence would effectively become a backdoor to justify any kind of abuse: think of a company claiming a debt against you based on an automated decision that cannot be understood, or Government denying benefits to an individual based on criteria that cannot be scrutinised.
