Ausgangssperre rechtswidrig

München – Die Ausgangssperre in Bayern war rechtswidrig!
Das haben jetzt drei Richter am Bayerischen Verwaltungsgerichtshof so entschieden (Aktenzeichen: 20 N 20.767). Wörtlich heißt es in dem 31 Seiten dicken Urteil: „Es wird festgestellt, dass § 4 Abs. 2 und 3 der Bayerischen Infektionsschutzmaßnahmeverordnung vom 27. März 2020 (BayMBl. 2020 Nr. 158), zuletzt geändert durch § 1 der Verordnung zur Änderung der Bayerischen Infektionsschutzmaßnahmenverordnung vom 31. März 2020 (BayMBl. 2020 Nr. 162) unwirksam war".
Das Gericht folgte also größtenteils der Argumentation der zwei Kläger, die sich unter anderem auch darauf beriefen, dass die Ausgangssperre ein schwerwiegender Eingriff in die Freiheitsrechte sei.
►Im Urteil steht zum Beispiel: „In ihrer konkreten Ausgestaltung war die Ausgangsbeschränkung jedoch keine notwendige Maßnahme im Sinne des § 28 Abs. 1 Satz 1 IfSG. Denn der Verordnungsgeber hat den Ausnahmetatbestand der triftigen Gründe, die zum Verlassen der eigenen Wohnung berechtigen, so eng gefasst, dass die Norm im Ergebnis gegen das Übermaßverbot verstößt. Dem Verordnungsgeber steht zwar grundsätzlich auch im Rahmen des § 32 IfSG ein Rechtsetzungsermessen zu. Er unterliegt aber im Hinblick auf den Verhältnismäßigkeitsgrundsatz, insbesondere das Übermaßverbot, der verwaltungsgerichtlichen Kontrolle".
Zwar sei den Behörden „hinsichtlich Art und Umfang der Bekämpfungsmaßnahmen Ermessen eingeräumt". Das behördliche Ermessen sei jedoch dadurch beschränkt, dass es sich um „notwendige Schutzmaßnahmen handeln muss, nämlich Maßnahmen, die zur Verhinderung der (Weiter- )Verbreitung der Krankheit geboten sind.“
ABER: Darüber hinaus sei dem „Ermessen durch den Verhältnismäßigkeitsgrundsatz Grenzen gesetzt, d.h. die verordneten Maßnahmen müssen auch im Verhältnis zu den mit ihnen verbunden Rechtseingriffen angemessen erscheinen“.

JUDGMENT OF THE ADMINISTRATIVE COURT
Curfew illegal

Munich - The curfew in Bavaria was illegal!
This has now been decided by three judges at the Bavarian Administrative Court (case number: 20 N 20.767). Literally, the 31-page ruling says: "It is established that Section 4 (2) and (3) of the Bavarian Infection Protection Measures Ordinance of March 27, 2020 (BayMBl. 2020 No. 158), last amended by Section 1 of the Ordinance Amending the Bavarian Infection Protection Measures Ordinance of March 31, 2020 (BayMBl. 2020 No. 162) was invalid."
The court thus largely followed the argumentation of the two plaintiffs, who also argued, among other things, that the curfew was a serious encroachment on civil liberties.
The judgment states, for example: "In its concrete form, however, the exit restriction was not a necessary measure within the meaning of Section 28 (1) sentence 1 IfSG. This is because the legislator has formulated the exception of valid reasons for leaving one's own home so narrowly that the standard violates the prohibition of excessiveness. In principle, the legislator also has legislative discretion within the framework of Section 32 IfSG. However, it is subject to administrative court review with regard to the principle of proportionality, in particular the prohibition of excessiveness."
It is true that the authorities have "discretion as to the nature and extent of the control measures". However, the discretion of the authorities is limited by the fact that the measures must be "necessary protective measures, namely measures that are required to prevent the (further) spread of the disease.
BUT: In addition, the "discretion is limited by the principle of proportionality, i.e. the prescribed measures must also appear reasonable in relation to the legal interferences associated with them".
