Preemptive pardons are indeed legal under US law. The Philadelphia Constitutional Convention considered adding “after conviction” to the pardon clause, but this was rejected.

The standard legal texts presenting the law of the Executive Branch addresses this matter (see, for example, The Law of the Executive Branch - Louis Fischer, pages 91-).
