🇺🇸🇺🇸⚖️🇧🇷⚖️👨‍⚖ — Attorneys for Trump Media, the company associated with U.S. President Donald Trump, have pointed to a procedural maneuver by Brazilian Supreme Court Justice Dias Toffoli that they claim centralized investigations in the office of Justice Alexandre de Moraes

➡️ The issue is raised in the lawsuit filed against Moraes in the United States. In the legal document, six lawyers challenge the legitimacy of the “Fake News Inquiry” (Inquérito das Fake News), which was launched by Toffoli while he was president of Brazil’s Supreme Federal Court (STF). According to the attorneys, Toffoli initiated the inquiry shortly after a report by the Brazilian news outlet O Antagonista linked him to the construction conglomerate Odebrecht.

⁉️ The legal brief notes that just three days after the publication of that report, Toffoli authorized Inquiry No. 4781 — known as the Fake News Inquiry. To do so, he invoked Article 43 of the STF’s internal rules, a provision intended for administrative matters. This allowed the Court itself to begin a criminal investigation without involving the Public Prosecutor’s Office.

💥 The attorneys argue that this interpretation undermines the credibility of the justice system. They also claim that, since then, the Court has accumulated the roles of investigator, prosecutor, and judge — all concentrated in the hands of Justice Moraes.
