👤🇧🇷⚖️Alexandre Files: The social media platform X, owned by American billionaire Elon Musk, disclosed on the platform a January 2023 decision by Alexandre de Moraes, a Justice of the Brazilian Supreme Federal Court (STF), to take down the accounts of presenter Monark, Senator Alan Rick (União-AC), and Federal Deputy Nikolas Ferreira (PL-MG).

💥 The account "Alexandre Files" deemed the decision unconstitutional for five reasons: violation of freedom of expression; it was issued in secrecy without proper justification; the order was not accompanied by a substantiated judicial decision; it allegedly violated the inviolability of any opinions, words, and votes of parliamentarians (Rick and Ferreira); and it infringed the right to informational self-determination by depriving the account holders of "the right to control and even access a series of personal data."

Another illegality committed by Minister Alexandre de Moraes was the decision issued in January 2023, in which he ordered the complete blocking of all social media accounts of certain Brazilian personalities, such as:

- The presenter Monark (known as the “Brazilian Joe Rogan”)
- Brazilian Senator Alan Rick
- Federal Deputy Nikolas Ferreira, the most voted deputy in the country’s history

The decision is unconstitutional for five different reasons:

(1) The decision violates freedom of expression, guaranteed by Article 5, Section IV, of the Federal Constitution.

At this point, it is important to mention that Minister Alexandre de Moraes disregarded previous decisions in which the Supreme Federal Court recognized that freedom of expression encompasses not only the right to express opinions but also the right of individuals to manifest, know, and analyze different points of view on a given subject.

(2) The decision was issued in secrecy, violating Article 5, Section LX, of the Federal Constitution, which states that the law can only restrict the publicity of procedural acts when the defense of privacy or social interest so requires. In the mentioned case, there is no justification for the confidentiality of the decision.

(3) The forwarded determination was not accompanied by a substantiated judicial decision. This circumstance violates Article 5, Section LV, of the Federal Constitution, which guarantees the right to due process and, consequently, the right to appeal. Thus, X does not even know the reason for the account blocks, severely harming the right to appeal.

(4) The decision ordered the blocking of accounts belonging to federal parliamentarians Alan Rick and Nikolas Ferreira, thus violating Article 53 of the Federal Constitution, which guarantees deputies and senators inviolability for any opinions, words, and votes.

(5) The decision violates the guarantee of informational self-determination, provided for in Article 5, Section LXXIX, of the Federal Constitution, which is the right individuals have to control and protect their own personal data. By ordering the blocking of accounts, the minister deprived their holders of the right to control and even access a range of personal data.
