๐Ÿ”— Repealed Genocide Act Precludes Indicting UK Government Officers To ICC - credit for this article: The Bernician

Difficult though it may be for many to believe, given the events of COVID-1984, British diplomats played an important role in the debates that led the United Nations in 1948 to adopt the Convention for the Prevention and Punishment of the Crime of Genocide.
However, like the United States, Britain failed to give effect to the Genocide Convention in domestic law until many years after its promulgation, in technical breach of Article V of the Convention, which stipulated that:

โ€œThe Contracting Parties undertake to enact, in accordance with their respective Constitutions, the necessary legislation to give effect to the provisions of the present Convention and, in particular, to provide effective penalties for persons guilty of genocide or of any of the other acts enumerated in article III.โ€

It was not until 1969, eighteen years after the Convention came into force in 1951, that Parliament passed โ€œan Act to give effect to the Convention on the Prevention and Punishment of the Crime of Genocide.โ€

Moreover, since the purpose of the Act was specifically to give legal effect to the articles set forth in the Convention, it naturally follows that they were of no legal effect under UK law prior to that Act of Parliament being passed.

UN Genocide Convention
The Genocide Act gave effect to Article II of the Convention on the Prevention and Punishment of the Crime of Genocide, which defined the most serious of all crimes against humanity as:

(a) Killing members of the group;

(b) Causing serious bodily or mental harm to members of the group;

(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

(d) Imposing measures intended to prevent births within the group;

(e) Forcibly transferring children of the group to another group.

Furthermore and most importantly, it also implicitly gave effect to Article IV, which stated that:

Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.

In other words, the Genocide Act 1969 enabled the prosecution of any and all Officers of the Crown in the International Criminal Court [ICC] for crimes of genocide, which remained the case for the next 32 years.

History of the Genocide Bill
According to documents contained in the National Archives, in late October 1968, Gordon Rudd prepared draft notes on the clauses of the Genocide Bill, for circulation to the House of Lords before the second reading debate.

These notes were sent to the Parliamentary Clerk for duplication and circulation by the Home Office. Paragraph 2 of the notes confirmed that the Home Office and Parliament understood that Article IV of the Genocide Convention was implicitly covered by the Genocide Bill:

โ€œDuring its first session in 1946 the General Assembly of the United Nations approved two resolutions. In the first, it affirmed the principles of the Charter of the Nuremberg Tribunal. In the second, the Assembly affirmed that genocide was a crime under international law and that those guilty of it, whoever they were and for whatever reason they committed it, were punishable.โ€

In a later section of the notes, the Home Office expressed its support for extraditing persons who had committed genocide crimes under colour of law in their home countries:

โ€œ[โ€ฆ] The most likely situation for the commission of genocide, moreover, is one where the genocidal acts are initiated by some controlling authority within a country which will have taken care to legitimate its actions under the domestic law of that country, e.g. by legalising concentration camps, experimental surgery, etc.

In the view of H.M. Government any practical value of the extradition provisions of the Bill would be substantially impaired if extradition could be avoided in these circumstances. While therefore the Genocide Convention does not expressly require such a provision, it has been thought right to provide that offences of genocide should be extraditable even if they were lawful under the law of the country where they were committed at the time of their commission.โ€

Pinochet Extradition Case
Nevertheless, almost three decades later, when the Spanish Government applied to the High Court to extradite former Chilean military dictator, General Pinochet, Lord Chief Justice Bingham gave the following reasoning in support of the courtโ€™s decision to deny the application:

โ€œ[โ€ฆ] a former head of state is clearly entitled to immunity in relation to criminal acts performed in the course of exercising public functions.โ€

On the purported basis that:

โ€œ[โ€ฆ] when partial effect was given to the Convention in the United Kingdom by the Genocide Act, 1969, Article IV [of the UNGC] was not incorporated in the statute.โ€

However, that decision must be considered void ab initio, on the ground that it failed to take into account section 2(3) of the 1969 Act, the intent of which was to give effect to Article IV of the convention:

โ€œ2(3) It shall not be an objection to any proceedings against a person under this Act in respect of an offence which, if committed in the United Kingdom, would be punishable as an offence of genocide or as an attempt, conspiracy or incitement to commit such an offence that under the law in force at the time when and in the place where he is alleged to have committed the act of which he is accused or of which he was convicted he could not have been punished for it.โ€

International Criminal Court Act 2001
Around three years later, on 01/09/2001, Tony Blairโ€™s New Labour government sponsored the repeal of the Genocide Act 1969, by way of the enactment of the International Criminal Court Act 2001.

Whilst the 2001 Act also adopted the definition of genocide in the 1948 Convention, the lack of a provision echoing the intent of Article IV was and remains treacherously conspicuous by its absence.

Ten days after the Act came into force, the 9/11 black-op was perpetrated on an unsuspecting public, which was immediately used as a pretext for wars of aggression in Afghanistan and then Iraq.

Lest we forget, the justification for the UK and its coalition partners invading Iraq was the Blair governmentโ€™s โ€˜dodgy dossierโ€™, which erroneously claimed Saddam Hussein had weapons of mass destruction with the capability of destroying Britain.

Had it not been for the 2001 Act implicitly rescinding the UKโ€™s commitment to punish โ€œconstitutionally responsible rulers, public officials or private individualsโ€, Blair and his accomplices might well have been indicted and tried at the ICC for crimes of genocide, when it became evidently apparent that their actions breached Article II (a), (b) and (c) of the Convention.

COVID-1984 Crimes
Fast forward two decades to COVID-1984 and the British People can bear witness to crimes of genocide never witnessed on these shores in any previous age.

Despite an abundance of prima facie evidence that Parliament has legislated for the current rogue regime to be held unaccountable for mass murder by government policy, there is currently no existing domestic legal mechanism by which government officers can be extradited by the International Criminal Court to be tried for their horrific crimes against the British people.

Therefore, the only potential remedy for bringing genocidal Officers of the Crown to justice is to lay a Private Criminal Prosecution for mass murder by government policy in a Common Law Court.

DC to Lift Most COVID-19 Restrictions by May 21

Washington Mayor Muriel Bowser said Monday that most COVID-19 restrictions in the nationโ€™s capital will be lifted on May 21, although masks will continue to be mandatory indoors.

Bowser made the remarks at a press briefing, during which she cited โ€œdramatic improvements in our health metricsโ€ as the underpinnings for a rollback of restrictions.

โ€œWeโ€™re very pleased that over the last several days we have seen our case spread, our community spread numbers, venture out of the red, into the yellow, and fast approaching the green,โ€ she said.

The mayor said the seven-day moving average of the daily COVID-19 case rate per 100,000 people stood at 6.6, as of May 8, down from a January peak of 45.9. A slide deck (pdf) accompanying her presentation showed that hospital utilization was at 75.6 percent of available beds without a surge, while noting that the U.S. capital had fully vaccinated over 226,000 residents since December 2020.

Bowser said that Washington will lift most of its capacity and activity restrictions on businesses on May 21 and the remainder on June 11.

Capacity restrictions on schools, โ€œnon-essentialโ€ stores, places of worship, restaurants, office spaces, fitness centers, and several other types of sites will be lifted on May 21. Large sports and entertainment venues will continue under a waiver process until June 11, at which point they will be subjected to no capacity restrictions.

Bars and nightclubs, which will be able to operate at 50 percent capacity on May 21, will see all capacity restrictions lifted on June 11.

Bowser also announced that 50 percent of Washingtonโ€™s government employees will return to in-office work by June 7 and, by July 12, all employees will be back behind their desks.
The mayor also said that all residents, workers, and visitors to Washington, regardless of vaccination status, will be required to follow mask guidance issued by the Centers for Disease Control and Prevention (CDC), which includes vaccinated people having to wear masks indoors.

โ€œIn indoor public spaces, the vaccination status of other people or whether they are at increased risk for severe COVID-19 is likely unknown,โ€ CDC guidelines say. โ€œTherefore, fully vaccinated people should continue to wear a mask that fits snugly against the sides of your face and doesnโ€™t have gaps, cover coughs and sneezes, wash hands often, and follow any applicable workplace or school guidance.โ€

The CDC guidelines say that vaccinated people can engage in outdoor activities without a mask, except in crowded venues and settings.

Sen. Mitt Romney Censured by Utah County Republican Party

Sen. Mitt Romney (R-Utah) was censured over the weekend by the Republican Party of Weber County, Utah, for voting to convict former President Donald Trump in the Senateโ€™s second impeachment trial earlier this year.

The resolution to censure Romney, a former presidential candidate, was passed 116โ€“97 by members of the Weber County GOP, County Party Secretary Jill Koford told the Salt Lake Tribune.

โ€œThe Weber County Republican Convention censures Mitt Romney for his votes to convict President Trump in two U.S. Senate impeachment trials which denied the President due process, allowed falsified evidence, did not provide adequate time for an investigation, and did not follow the U.S. Constitution which states a President may only be impeached for high crimes and misdemeanors,โ€ the Weber County GOPโ€™s resolution said.

The resolution also thanked Utah Republicans, including Sen. Mike Lee and Reps. Chris Stewart, John Curtis, Blake Moore, and Burgess Owens, for voting against the articles of impeachment earlier this year.

โ€œYou have six years between elections of senators, and I think itโ€™s important to let Sen. Romney know the delegates are not satisfied with what heโ€™s doing,โ€ said Bryan Gray, who sponsored May 8โ€™s censure of Romney, according to KUTV.

โ€œIโ€™m not here to divide the party by censuring Mitt Romney,โ€ Gray also said, as reported by The Standard newspaper. โ€œIโ€™m here to make him aware of how he divided the party.โ€

Romneyโ€™s office didnโ€™t respond to a request for comment by press time.

Romney, who voted to convict Trump during his first impeachment trialโ€”the only Republican to do soโ€”said that he voted to convict in February because he believed Trump attempted to โ€œcorrupt an election to keep oneself in powerโ€ with post-Nov. 3 election challenges and statements. The House Democrat-led impeachment said that Trump was partially responsible for the Jan. 6 Capitol breach.

On May 1, the Utah Republican Party narrowly voted down censuring Romney, although the Utah senator was loudly booed during the Utah Republican Party organizational convention.

โ€œNow you know me as a person who says what he thinks, and I donโ€™t hide the fact that I wasnโ€™t a fan of our last presidentโ€™s character issues,โ€ Romney said to the crowd, causing the audience to loudly boo the Republican senator. He was forced to stop his speech before the crowd died down.

โ€œOh yeah, you can boo all you like, but Iโ€™ve been a Republican all my life. My dad was a governor of Michigan, my dad worked for Republican candidates that he believed in. I worked for Republicans across the country and, if you donโ€™t recall, I was the Republican nominee for president in 2012,โ€ he also said.

Last week, Rep. Anthony Gonzalez (R-Ohio) and nine other House Republicans who impeached Trump this year were censured by the Ohio Republican Party, who also called on Gonzalez to resign from office.

Kansas Sheriffโ€™s Office Still Probing 12 Claims of 2020 Election Fraud

The Shawnee County Sheriffโ€™s Office in Kansas confirmed last week that itโ€™s still investigating claims of voter fraud from the 2020 election.

Twelve cases are being investigated, according to the Topeka Capital-Journal, which cited Deputy Abigail Christian, the sheriffโ€™s office spokesperson; she said she couldnโ€™t release more details about the investigations.

State Rep. Vic Miller, a Democrat, had asked Shawnee County District Attorney Mike Kagay to look into the alleged election fraud, noting that 12 people had listed UPS stores and other businesses in Topeka as their places of residence.
Andrew Howell, the Shawnee County election commissioner, said that he doesnโ€™t recall anyone contacting him or the election office about election fraud but said his office is trying to โ€œclean up the list.โ€ He added that using a UPS address or business address doesnโ€™t necessarily mean there was election fraud involved, according to the Journal.

โ€œThere are situations that do occur where people are allowed to use unusual addresses,โ€ Howell said. โ€œIt doesnโ€™t on its face alone prove anything.โ€

The sheriffโ€™s office didnโ€™t immediately respond to a request by The Epoch Times for comment.

In Pennsylvania, several people recently have been charged with election fraud stemming from the Nov. 3 election, including two women in Bucks County who allegedly cast ballots on behalf of their deceased mothers. District Attorney Matthew Weintraub told news outlets that the incidents are isolated and said there was no evidence of โ€œwidespread or systematic election fraud here in Bucks County.โ€

Two weeks ago, a Delaware County man identified as 70-year-old Bruce Bartman pleaded guilty and admitted he โ€œmade a stupid mistakeโ€ when he cast a ballot for his deceased mother.

Since the November election, some GOP state legislatures have passed laws to strengthen the rules around absentee and mail-in ballots. That includes Floridaโ€™s legislature, which last week approved a bill that provides more regulations for ballot drop boxes as well as more identification requirements for voters who request a mail-in ballot, while Texasโ€™s state House passed a similar bill on May 7.

Immediately after the Florida bill was signed into law, Democratic lawyers and other groups filed several lawsuits challenging the measure as unconstitutional.

India Excludes Chinese Companies From Its 5G Trials

NEW DELHIโ€”India has decided to proceed with its fifth-generation (5G) wireless network technology and spectrum trials and has invited equipment makers from various nationsโ€”except China.

Experts say India is keeping Chinese 5G firms such as Huawei and ZTE out of its massive market because of the border dispute last year and because the exclusion will economically hurt Chinese entities.

The Department of Telecommunications of the Indian government on May 4 gave permission to its four telecom service providers (TSP) to conduct trials for the use and applications of 5G technology, according to a release by the Ministry of Communications.

โ€œThese TSPs have tied up with original equipment manufacturers and technology providers which are Ericsson, Nokia, Samsung, and C-DOT. In addition, Reliance Jio Infocomm Ltd. [an Indian company] will also be conducting trials using its own indigenous technology,โ€ the ministry said in the release.

S. Chandrashekhar, a visiting professor at Indiaโ€™s National Institute of Advanced Studies with research interests in telecommunications and national security issues in the Indian context, told The Epoch Times in an email that the exclusion of Chinese firms from the 5G trials in India will hurt the companies economically.

โ€œIndia opting out of the Chinese standardโ€”I am sure the Chinese knew this was going to happenโ€”would definitely hurt them,โ€ Chandrashekhar said. If China would have gotten into the Indian market, the value of Chinaโ€™s 5G would have grown exponentially, he wrote.

Harsh V. Pant, the director of studies and head of the Strategic Studies program at the New Delhi-based Observer Research Foundation, told The Epoch Times over the phone that India was expected to exclude China from the 5G trials because of their turbulent relationship between the two countries.

โ€œIndia remains committed to pursuing a strong line against China. Until early last year, India had indicated that it would be willing to include Chinese companies in the 5G trials,โ€ Pant said. But because of the border crisis at Ladakh, Chinaโ€™s reluctance to address Indiaโ€™s concerns, and its attempts at changing the status quo of the border unilaterally, India decided to fashion its foreign policy accordingly, he said.

โ€œThis is a part of that posture, and India is increasingly worried about the Chinese involvement in critical sectors in India. Thatโ€™s what this decision reflects,โ€ he said.

How โ€˜Network Economicsโ€™ Works

Data, information, and knowledge are going to drive everything in the future world, and everything will get smarter. Success and failure in these products, such as mobile phones and personal computers, are governed by something called โ€œnetwork economics,โ€ in that such devices and services associated with them have value only when theyโ€™re connected, Chandrashekhar said.

The smarter technology โ€œinvolves intelligent sensors, devices, and platforms, and data collection, data processing, data mining, deep learning, AI, and the movement of data, information and knowledge throughout the world (land, sea, air, underwater, space, maybe even the moon and planets)โ€”things, people, services, manufacturing, almost everybody and everything will be connected to the internet,โ€ he said.

The channels through which this data and information are transferred and exchanged are a critical element of this infrastructure, Chandrashekhar said.

โ€œ5G is the latest technology to increase the capabilities and capacities for wireless transfer of data, especially between mobile devices to people and things having this capability. It generally provides last-mile connectivity to users and things,โ€ he said.

In network economics, the more connections the devices have, the greater their value, however, this value doesnโ€™t increase linearly but exponentially with the increase in the number of nodes.

โ€œSo a network of 100 nodes will be significantly more valuable than a 50-node network. What this means is that companies that establish an initial large presence with a product that has network attributes have a significant economic advantage,โ€ Chandrashekhar said.

โ€œAfter the initial forays of companies in 1G, this understanding has led to companies getting together to create a common standard which is then used by all of them to build their own products. But since the platform is the same, all things that go into including software and peripherals become compatibleโ€”scale economies come into play depending on the number of nodes in the standardโ€”they compete on the product side but cooperate on the platform side. So competing consortia of companies get together to develop these common standardsโ€”2G, 3G, and 4G all saw these,โ€ he said.

Every new generation has a fresh battle of standards, and the 5G is the latestโ€”itโ€™s expected to transform Indiaโ€™s industrial sectors with an estimated contribution of $450 billion from 2023 to 2040, according to a report (pdf) by Global System for Mobile Communication Association (GSMA).

โ€œI think given the way China has gone about dealing with India, it is good to give them the brush-off,โ€ Chandrashekhar said.

Strategic Implications of 5G in India

5G is a key aspect of economic development, โ€œinfrastructure, manufacturing, services, agriculture,โ€ with both civilian and strategic significance.
โ€œDisrupting it is one way of seriously affecting everyday life. Both the hardware and software and the network itself as well as each node is vulnerable. Many strategists think that there are backdoor entries through the hardware and software that can introduce viruses or other malware into networks that could damage critical parts of the national economy,โ€ Chandrashekhar said.

Last year, while the debate was still on in India about the inclusion of Huawei and ZTE in the Indian telecommunications network, fears were high particularly about potential threats to the Indian defense sector.

โ€œ5G will bring enormous benefits to the Indian armed services over the next decade at least. It is widely regarded to be state-of-the-art technology, which will have a bearing on military operations,โ€ Kartik Bommakanti, a fellow with the Strategic Studies Program of the ORF, wrote in an analysis late last year.
โ€œThe government has identified these companies as likely to install โ€˜trap doorโ€™ or โ€˜back doorโ€™ technologies that could enable Chinese spy agencies to conduct espionage. These technologies, if installed by Huawei or ZTE, will in all likelihood jeopardize Indiaโ€™s national security,โ€ Bommakanti said.

Pant says itโ€™s for these reasons that India would prefer to work with like-minded countries when it comes to strategic technologies.

Chandrashekhar noted that India doesnโ€™t have indigenous 5G capability, and ggthat makes the country vulnerable. He said India should create companies that can compete with the โ€œNokias, Ericssons, or Siemens of the world,โ€ and there should be โ€œproactive supportโ€ for that.
