Companies are taking a more calculated approach to who they sponsor for work visas and how they do so, attorneys told Business Insider.
Divij Kishore, an immigration attorney at New York-based Flagship Law, which represents clients across various sectors, including tech, healthcare, and energy, told Business Insider that he has seen a 40% to 50% drop in H-1B sponsorship inquiries compared to previous years.

A federal judge ruled Monday that the Trump administration can resume sharing location data about undocumented immigrants receiving public health insurance benefits with Immigration and Customs Enforcement, starting next month.

The Trump administration is only allowed to share Medicaid data about people unlawfully living in the United States, meaning ICE can’t access personal information collected from other immigrants receiving Medicaid.

Starting Jan. 1, seven new countries are being added to the U.S. travel ban list. 

It's an effort by President Trump and the White House to ban travel from foreign countries to protect national security and prohibit immigrants from overstaying their visas. 

It's something Executive Director of the Hmong American Center Bee Van Her disagrees with. 
"We're family oriented, we stay connected, even though we're overseas where everybody's in a different country, we stay connected as much as we can," Her said. "So that's tearing apart, for sure, the family relationships."

Her says the ban makes it difficult for people who still have family in Laos. 

Wisconsin is home to more than 70,000 Hmong people.

3. تقلب یا ارائه اطلاعات نادرست: گزارش شده که افسران USCIS تناقض‌ها در افشاهای گذشته را که می‌تواند نشان‌دهنده تقلب باشد با دقت بررسی می‌کنند و این امر خطر بازداشت در جریان مصاحبه را بالا می‌برد.
4. تصمیم‌های نامطلوب مهاجرتی: افرادی که درخواست‌های قبلی‌شان رد شده یا با تصمیم‌های نامطلوب دیگر مواجه بوده‌اند—به‌ویژه اگر با عوامل خطر دیگر همراه باشد—بیشتر احتمال دارد در مصاحبه‌ها با اقدامات اجرایی روبه‌رو شوند.
5. نقض قوانین مهاجرتی: متقاضیانی که بدون بازرسی وارد آمریکا شده‌اند یا اقامت غیرقانونی (unlawful presence) داشته‌اند نیز در معرض خطر هستند. برای متخصصان مهم است که میان «اقامت غیرقانونی» و «وضعیت غیرقانونی» تمایز قائل شوند، زیرا هرکدام پیامدهای متفاوتی دارند.

اقدامات اجرایی در دفاتر USCIS
گزارش‌ها حاکی از افزایش هماهنگی میان USCIS و ICE است که به تغییرات رویه‌ای انجامیده و امکان اجرای اقدامات اجرایی را در حین مصاحبه یا اندکی پس از آن فراهم می‌کند. ممکن است فهرست‌های مصاحبه‌شوندگان از پیش توسط ICE غربال شود تا افرادی که در اولویت‌های اجرایی قرار می‌گیرند شناسایی شوند. در جریان مصاحبه، افسران خدمات مهاجرت (ISO) موظف‌اند اطلاعاتی درباره وضعیت متقاضی—از جمله سلامت و قابلیت بالقوه برای رسیدگی به فرم I-485—را به ICE منتقل کنند؛ اطلاعاتی که می‌تواند بر تصمیم ICE برای بازداشت اثر بگذارد.

A Libyan doctor – emailing the Guardian anonymously at the request of his lawyer – said his green-card application had been halted despite having worked in the US for 10 years after entering on an O-1/EB-1 (extraordinary ability) visa.
“I never imagined that in the United States I would be targeted because of my nationality and religious background, particularly by the authorities,” wrote the doctor, whose medical work is focused on developing AI diagnostic and treatment tools for lung cancer.
“I invested years of relentless effort in this journey … I pursued the American dream in good faith, believing in this country as a land of opportunity.
“Now, as I reach the final stages of my permanent residency process, an expensive and lengthy process, my future appears jeopardized solely because of my country of origin. I can’t describe to you the uncertainty, fear, disappointment and confusion I feel right now.”

“If there’s an [interview] cancellation without any rescheduling within a reasonable period of time, I would say that a court would be interested in or willing to entertain a writ of mandamus in federal court for the government failing to act in terms of rescheduling this within a timely manner,” Aust said.
A writ of mandamus is a court order requiring a government official to properly fulfill their duties, and is considered by the U.S. Department of Justice “an extraordinary remedy” to be used only in exceptional circumstances. 
According to Feist and Aust, the likelihood of success is unknown, and the timeline of the mandamus would not be based on any specific legal or statutory mandate.
