Re: Cancellation of Smart Metering Service at: (Add Your Road Your Town Postcode )
I am exercising my right to cancel the installation of smart metering services at the above property address with immediate effect (within the cancellation period) pursuant to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
I understand that there are no measures in the Energy Act 2023, which compel installation of smart meters, or other smart energy appliances and that there remains "no legal obligation on consumers to accept a smart meter."
I understand that you hold sufficient indemnity to cover any eventuality arising under your provision of services, including claims for breach of duty and claims for damages whether material, non-material or both.
Accordingly, please take notice that in the unlikely event that a smart meter will be or has been left at the property, this will indicate that you agree to incur an accommodation charge of £20 GBP per hour (beginning from the date of first installation until removal.
The charge will become immediately due and payable in cleared funds and you will be under a duty to clear any outstanding balance.
You also agree to keep any occupier, stranger or visitor fully indemnified at all material times, against all liabilities and all claims arising from any effect of the matters described in this cancellation letter pursuant to the Occupiers' Liability Act 1957 (as amended).
It is kindly requested that you update your records to reflect any legal effect arising from the representations made in this letter and seek relevant legal advice as required.
However, upon an academic assessment of the position, it would be in the bests interests of the parties that if any replacement meter is required, then a conventional replacement meter without smart meteringtechnology, should be proposed and the specifications expressly agreed in accordance with any relevant legislation, in advance of any appointment for installation.
Please acknowledge receipt of this cancellation letter and respond to the points raised by written correspondence only.
