The fact that Twitter was so backed into a corner in the Berenson suit, that they actually settled with him and allowed him back on the platform, is enough for the FG claim of “guidance” to be moot. Using 230, they consistently threatened the social media companies to comply when they didn’t want to. There is also the argument that the private sector was working in CONCERT with the government when their views aligned. You don’t need to threaten when there’s a partnership. At times there wasn’t.

I am still not sure why they think showing the court that both parties have advocated for reforms to Section 230 is some benefit to them. Here they go on to detail “TRUMP DID IT TOO!!”

Also, they say, the rights of INDIVIDUALS are at stake here, judge! Not the rights of the STATES, so the INDIVIDUALS should be suing. This completely disregards the individuals on the lawsuit. Is the government asking for a class action? They know what the chances of a lone citizen trying to take on this behemoth successfully is.

Here they begin to address some of the targeting and threats I spoke about earlier. What the FG is advocating here is that no one, ever, at any time, could have standing to take action against censorship, because they will never (under these standards and precedent) be able to show harm. This is a mind blowing interview that every American should listen to.
