Basically, McConnell knows that Pence had the authority to return the contested votes to the states under the Electoral College Act. The language is VERY nebulous and the Constitution doesn't address this. They didn't want him to do that and keep Trump. They wanted Trump gone. But they don't want the Democrats to be able to do the same thing in 2024.
