“Traditionally, there has been a tendency to place legal responsibility on the highest authority possible. For instance, according to the legal doctrine of respondeat superior (“let the master respond”), the employer is liable for employees’ negligent acts that occur in the course of their work. This liability by one person or agency for the actions of another is called vicarious liability. According to the doctrine of the “borrowed servant,” a physician may be liable for wrongful acts committed by employees under the physician’s orders.”
“In recent years, however, the “rule of personal responsibility” has been increasingly applied. This means that each person is liable for his or her own negligent conduct. Under this rule, the law does not allow the wrongdoer to escape responsibility even though someone else may be legally liable as well.”
